A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHMOND, CALIFORNIA, APPROPRIATING $1,528,693 TO THE PORT’S FISCAL YEAR 2026-27 BUDGET, AUTHORIZING THE TRANSFER OF PORT FUNDS TO PROJECT CODE 36012, AND APPROVING A CONTRACT WITH W.R. FORDE ASSOCIATES, INC., IN AN AMOUNT NOT TO EXCEED $5,478,693 FOR THE 2026 POINT POTRERO MARINE TERMINAL MAINTENANCE PROJECT.
WHEREAS, the City of Richmond owns and operates the Point Potrero Marine Terminal ("PPMT"), which requires rehabilitation of pavement, storm drainage, utility metering, lighting, and fire water systems to support continued safe and secure terminal operations; and WHEREAS, the 2026 Point Potrero Marine Terminal Maintenance Project includes pavement sealing and repair, storm drain improvements, striping and delineation, LED and solar lighting, electrical and water metering and communication infrastructure, water and fire water valve replacement, and related site improvements; and
WHEREAS, the City advertised the Project through its Bids Online system on August 11, 2026, conducted a pre-bid meeting on August 17, 2026, and received four sealed bids on September 10, 2026; and
WHEREAS, W.R. Forde Associates, Inc. is a Richmond-based business that qualifies for the City's five-percent local bidder preference under the Richmond Business Opportunity Ordinance, resulting in an evaluated bid of $5,204,758.35 and making W.R. Forde Associates, Inc., the lowest responsive and responsible bidder; and
WHEREAS, the contract amount is based on W.R. Forde Associates, Inc.'s submitted bid of $5,478,693; and
WHEREAS, sufficient funds are available in the approved Fiscal Year 2026-2027 Port Budget in the amount of $3,950,000 under Account String 40163080-400708, within Project Codes 36009, 36012, and 36036, and an appropriation of $1,528,693 to the Port Budget for Fiscal Year 2026-2027 under Account String 40163080-400708, Project Code 36012, will provide total funding of $5,478,693 for the contract, with no impact on the General Fund; and
WHEREAS, the term of the Contract shall continue until the City determines that construction maintenance is complete, unless the City elects to terminate the Contract earlier in accordance with its terms; and
WHEREAS, the Project consists of repair, maintenance, and minor alteration of existing terminal facilities, involves negligible or no expansion of existing use, and is categorically exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Section 15301 (Existing Facilities).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richmond, California, as follows:
1. The above recitals are true and correct and are incorporated herein by reference.
2. The City Council hereby appropriates $1,528,693 from the Port’s cash account to the Port’s Fiscal Year 2026-2027 Budget and authorizes the transfer of funds available under Account String 40163080-400708 within Project Codes 36009, 36012, and 36036 to Project Code 36012, resulting in total funding of $5,478,693 in Project Code 36012 for the 2026 Point Potrero Marine Terminal Maintenance Project.
3. The City Council awards and approves a three-year construction contract with W.R. Forde Associates, Inc., as the lowest responsive and responsible bidder, for the 2026 Point Potrero Marine Terminal Maintenance Project in an amount not to exceed $5,478,693.
4. The City Council hereby authorizes any necessary amendments.
5. This Resolution shall take effect immediately upon its passage and adoption.
