STAFF REPORT
SUBJECT: Presentation Of The Key To The City to Doug Lueck PRESENTED BY: Kyle Blades, Council Member
SUMMARY:

Doug has faithfully served this community since he moved here from Victorville in the early 1990s.

He has served for countless years on multiple nonprofit boards. He has served with the Chamber of Commerce and serves as an officer in the Old West Mounted Lawmen group. Doug currently sits on the Desert Empire Fairgrounds and HSUMD board of directors. Chip Holloway said, “Doug’s footprints are everywhere, from bringing the first Demo Derby here and then helping bring it back to more recently helping us manage the most comprehensive and aggressive capital improvement project plan in years. Doug has an incredible corporate knowledge of all things fair and fairgrounds. Doug is always willing to offer sage advice and offer assistance above simply words when called upon.” Doug is the “Father of the Ridgecrest Petroglyph Festival.” He and his wife, Meris, have a passion for the cultural significance of our local petroglyphs and what they mean to our region. Under Doug’s guidance, the festival was created and has grown over the past nine years. He has been instrumental in the petroglyph branding all over town as well.

Doug’s incredible efforts at the RACVB have been influential in keeping Ridgecrest and the entire Indian Wells Valley at the forefront of filming for almost two decades. He has built positive relationships with major film industry players that will pay dividends to our community for years to come. Most importantly, under Doug’s leadership at the RACVB, a “Tourism and Business Improvement District” (TBID) was created, which provided financial independence and sustainability for the RACVB. The TBID has ensured that the crucial work of tourism and filming will continue in Ridgecrest well into the future.

Doug is generous, kindhearted, values relationships, and genuinely cares about people, this community, and the future of this town.

RE: DESIGNATION OF VOTING DELEGATES AND ALTERNATES
League of California Cities Annual Conference & Expo – September 7-9, 2022 Cal Cities 2022 Annual Conference & Expo is scheduled for September 7-9, 2022 in Long Beach. An important part of the Annual Conference is the Annual Business Meeting (during General Assembly) on Friday, September 9. At this meeting, Cal Cities membership considers and acts on resolutions that establish Cal Cities policy.

In order to vote at the Annual Business Meeting, your city council must designate a voting delegate. Your city may also appoint up to two alternate voting delegates, one of whom may vote if the designated voting delegate is unable to serve in that capacity.

Please complete the attached Voting Delegate form and return it to Cal Cities office no later than Friday, September 2. This will allow us time to establish voting delegate/alternate records prior to the conference.

Please view Cal Cities’ event and meeting policy in advance of the conference. • Action by Council Required. Consistent with Cal Cities bylaws, a city’s voting delegate and up to two alternates must be designated by the city council.

When completing the attached Voting Delegate form, please attach either a copy of the council resolution that reflects the council action taken, or have your city clerk or mayor sign the form affirming that the names provided are those selected by the city council. Please note that designating the voting delegate and alternates must be done by city council action and cannot be accomplished by individual action of the mayor or city manager alone. • Conference Registration Required. The voting delegate and alternates must be registered to attend the conference. They need not register for the entire conference; they may register for Friday only. Conference registration will open by June 1 on the Cal Cities website. In order to cast a vote, at least one voter must be present at the Business Meeting and in possession of the voting delegate card. Voting delegates and alternates need to pick up their conference badges before signing in and picking up the voting delegate card at the Voting Delegate Desk. This will enable them to receive the special sticker on their name badges that will admit them into the voting area during the Business Meeting.

Council Action Advised by August 31, 2022
• Transferring Voting Card to Non-Designated Individuals Not Allowed. The voting delegate card may be transferred freely between the voting delegate and alternates, but only between the voting delegate and alternates. If the voting delegate and alternates find themselves unable to attend the Business Meeting, they may not transfer the voting card to another city official. • Seating Protocol during General Assembly. At the Business Meeting, individuals with the voting card will sit in a separate area. Admission to this area will be limited to those individuals with a special sticker on their name badge identifying them as a voting delegate or alternate. If the voting delegate and alternates wish to sit together, they must sign in at the Voting Delegate Desk and obtain the special sticker on their badges.

The Voting Delegate Desk, located in the conference registration area of the Long Beach Convention Center, will be open at the following times: Wednesday, September 7, 8:00 a.m. – 6:00 p.m.; Thursday, September 8, 7:00 a.m. – 4:00 p.m.; and Friday, September 9, 7:30 a.m.–12:30 p.m. The Voting Delegate Desk will also be open at the Business Meeting on Friday, but will be closed during roll calls and voting.

The voting procedures that will be used at the conference are attached to this memo.

Please share these procedures and this memo with your council and especially with the individuals that your council designates as your city’s voting delegate and alternates.

Once again, thank you for completing the voting delegate and alternate form and returning it to Cal Cities office by Friday, September 2. If you have questions, please call Darla Yacub at (916) 658-8254.

STAFF REPORT

SUBJECT: Introduction And First Reading, By Title Only, An Ordinance Of The City Of Ridgecrest City Council Adding Division 3 To Article III Of Chapter 9 Of The Ridgecrest Municipal Code Imposing A Transactions And Use (Sales) Tax Locally Controlled For City Services To Be Administered By The State Board Of Equalization (November 8, 2022 Ballot) PRESENTED BY: Martin Koczanowicz, City Attorney
SUMMARY:

Although the City continues to be a prudent steward of taxpayer dollars and has taken measures to cut costs, the fact is as the cost of providing services continue to increase, so does the need for locally controlled local funding that will stay in Ridgecrest for the City services residents rely on and will not be taken by the state or the county.

This item introduces an Ordinance adding Division 3 to Article III of Chapter 9 of the Ridgecrest Municipal Code imposing a transactions and use (sales) tax of one cent (1¢) within the City of Ridgecrest for a period of nine (9) years.

Over the last year, the City held community discussions and engaged residents through The Ridgecrest Community Conversation to ensure to listen to resident feedback and ensure that the feedback is incorporated as part of the City’s budget process. With nearly 1,000 residents and several community groups engaged, this robust community conversation identified important City service needs and priorities residents want to see prioritized.

Additionally locally controlled funding will allow the City to address infrastructure and facility needs, such as parks, sports fields and recreation centers, which are essential to maintaining Ridgecrest’s quality of life and providing local youth programs, which are essential to keeping kids away from gangs.

Residents also prioritized keeping both Ridgecrest fire stations open full-time, replacing Pinney Pool, continuing to fix potholes on neighborhood streets and City street repair, maintain 911 emergency response times and maintaining recreation programs for all ages. If approved, this locally controlled funding measure could provide the funds for these services that residents have told us they want prioritized.

As the City continues to repair local streets and roads, residents continue to give the feedback that they want these repairs escalated. It is also fiscally responsible to maintain the City’s streets, roads and potholes now, so they don’t deteriorate and become more costly to fix in the future.

The proposed Ordinance follows a ballot measure seeking approval from the electorate to impose the one-cent or 1% sales and use tax – this local funding will keep the tax dollars in Ridgecrest and not the state or the county. The proposed Ordinance will not take effect until 30 days after adoption at a future meeting. Once introduced, the Ordinance will be placed on the Council agenda for a meeting Ridgecrest City Council

immediately after the results of the election on November 8, 2022 are certified, and only if the electorate approves the measure with a vote of approval over 50%.

The Proposed Ordinance mirrors the language of an existing temporary sales and use tax measure that will be expiring soon. The new tax Ordinance also creates a new Citizen Oversight Committee that is independent from any existing oversight committees. The new oversight committee is appointed by the City Council and is tasked with:
(1) Reviewing all appropriations of revenues received by the city from the sales and use taxes to determine whether such funds are to be used as provided for in the voter-approved measure (2) Reviewing the audit prepared by an independent auditor retained by the city to perform the city's comprehensive annual financial report to determine whether such funds have been spent as provided for in the voter-approved measure; and,
(3)Prepare and issue the committee's own annual report setting forth their findings in regard to the foregoing.

The following two motions are required:

Motion To Waive Reading In Full Of An Ordinance Of The City Of Ridgecrest City Council Adding Division 3 To Article III Of Chapter 9 Of The Ridgecrest Municipal Code Imposing A Transactions And Use (Sales) Tax Locally Controlled For City Services To Be Administered By The State Board Of Equalization (November 8, 2022 Ballot)
Motion To introduce, By Title Only, An Ordinance Of The City Of Ridgecrest City Council Adding Division 3 To Article III Of Chapter 9 Of The Ridgecrest Municipal Code Imposing A Transactions And Use (Sales) Tax Locally Controlled For City Services To Be Administered By The State Board Of Equalization (November 8, 2022 Ballot)
FISCAL IMPACT:

The Finance Department estimates that the proposed sales and use tax will bring in approximately $5.9 Million annually to the General Fund.

FINANCING AUTHORITY/HOUSING AUTHORITY AGENDA ITEM
SUBJECT: Second Reading And Adoption, Ordinance 22-03, An Ordinance Of The Ridgecrest City Council Authorizing An Amendment To The Contract Between The City Council Of The City Of Ridgecrest And The Board Of Administration Of The California Public Employees' Retirement System (CalPERS)
PRESENTED BY: Ricca Charlon, City Clerk
SUMMARY: Pursuant to CalPERS regulation, Resolution No. 22-38, a Resolution of Notice of Intent to approve an amendment to the contract between the Board Of Administration of California Public Employees Retirement System and the City Council of the City of Ridgecrest was approved on June 1, 2022.

An Ordinance adopting the amendment to the contract with CalPERS was presented to City Council for first reading and introduction by title only on July 6, 2022. The City of Ridgecrest is obligated to comply with all CalPERS requirements including Government Code Section 7507.

During a recent CalPERS audit of all contracts, our exclusion of part-time employees was flagged for review. This was because we have one part-time position in our retirement system.

Our contract language initially excluded all part-time employees; however, in 2013, during an audit, CalPERS determined that our PACT Coordinator position consistently works more than the CalPERS allotment of 999 hours for a part-time employee not to be included in the CalPERS retirement and, therefore, must be included in the retirement system.

This contract change removes the exclusion of all part-time employees from our contract. This contract change will not alter when a part-time employee is entered into the CalPERS retirement system if they have gone over the allotted part-time hours. It simply removes the exclusion to avoid confusion in the future.

The following two motions are required:

1. Motion To Waive Reading In Full of Ordinance 22-03, An Ordinance Of The Ridgecrest City Council Authorizing An Amendment To The Contract Between The City Council Of The City Of Ridgecrest And The Board Of Administration Of The California Public Employees' Retirement System (CalPERS)
