STAFF REPORT
SUBJECT: Request for Sponsorship of the Petroglyph Rock Art Festival PRESENTED BY:

Ricca Charlon, City Clerk
SUMMARY:

The Petroglyph Rock Art Festival will be held November 5-6, 2022. Business leaders from the Ridgecrest community are planning the Petroglyph Rock Art Festival to highlight the rock art in the area and to brand the Ridgecrest area as the rock art capital of North America. With the Petroglyphs in Little Petroglyph Canyon, the area is widely known for having some of the finest Petroglyphs in North America and Little Petroglyph Canyon is designated as a national historic landmark.

The festival has been established as an annual event and is a tremendous draw to bring tourists to the Ridgecrest area to stay in our hotels, eat in our restaurants and shop at local businesses. Once tourists have been to Ridgecrest, we envision many of them coming back again because there is much to see within a short drive of the Ridgecrest area.

The Petroglyph Education Foundation has been actively raising donations to fund the event and this year has made a request for the City of Ridgecrest to sponsor the event through in-kind services including traffic and crowd control.

FISCAL IMPACT: In-kind contributions to be determined

SUBJECT: A Resolution To Approve The Professional Service Agreement With Willdan Engineering For An Amount Not To Exceed $217,073.00 For Preliminary/Construction Engineering Services For The City Clean CA Leroy Jackson Improvements And Authorize The City Manager To Sign The Agreement PRESENTED BY: Nerissa Wegener, Parks and Recreation Director SUMMARY:

The City of Ridgecrest has been awarded $1,840,000.00 from Cal Trans for the Local Clean CA grant on February 1, 2022 to make improvements at the Leroy Jackson Sports Complex.

This project will consist of completion of the walking path, to include solar lighting and shade huts along the path, lighting at the tennis courts, new drinking fountains, Dial-a-ride enclosure, shaded kiosk for educational signage, trash, recycle and compost receptacles, and lots of new trees and plants for additional shade, and ADA improvement in the existing Northern Parking Lot.

In this agreement Wildan will also assist with the design and construction of repair/replacement of 6 tennis courts making 3 of the courts usable for tennis and pickle ball using the ARPA funding. The tennis court project was approved by council on May 4, 2022.

The City of Ridgecrest requires professional environmental, Civil design, architectural, mechanical, and construction engineering services. The proposed Engineering Services are on a time and materials basis for an initial not to exceed estimated fee with a clause to allow for written amendments with council approval.

This is a full service contract, which will provide City staff with valuable assets to complete this project per the grant timeline and aid in the reporting and invoicing process. With the current project load on both Parks & Recreation and Public Works we felt it necessary to utilize a consultant firm to further City Staff and keep the limited personnel we have doing their day to day tasks
The City of Ridgecrest solicited one engineering firm, as specified in the grant guidelines for proposals, and hand selected Willdan Engineering due to the short turn around period and the amount of staff Willdan had available to tackle a project such as this. Willdan Engineering Currently works with the City on many other Public Works Projects and has a proven track record for delivering projects.

The consultant fee for the project is $217,073.00. Staff negotiated the price after an in house cost estimate for design services was prepared. Staff got the original proposal down roughly $7,000.00 from the original presented fee. After negotiations and project Discussion with Deputy Director Mike Bustos, staff feels the fee is fair for the task at hand.

Staff recommends that the City Council approves the project and authorizes the City Manager to execute the agreement with Willdan Engineering for all services previously mentioned.

FISCAL IMPACT: $217,073.00 for all Engineering services associated with the project. (100% reimbursable through the Clean California Grant).

ACTION REQUESTED:

1. Award a Professional Services Agreement to Willdan Engineering for Engineering Services for the Clean California Leroy Jackson Improvement Project.

2. Authorize the Finance Director to amend the budget to reflect all appropriate capital, revenue and transfer accounts and create an initial purchase order in the amount of $217,073.00 for Engineering Services from the Capital Improvement fund.

3. Authorize the City Manager to execute the Contract for Engineering Services in the amount of $217,073.00 for the Leroy Jackson Improvement Project.

WHEREAS, the proposed Engineering Services are on a time and materials basis for a not to exceed fee; and,

Ricca Charlon, City Clerk
August 1, 2022 (Revised August 8, 2022)
Mr. Travis Reed
Public Works Director
City of Ridgecrest
100 West California Avenue
Ridgecrest, CA 93555
Subject: Professional Engineering Services for Leroy Jackson Park in the City of Ridgecrest
Dear Mr. Reed:

Willdan Engineering (Willdan) has been pleased to currently provide engineering services for the above referenced project. For your consideration, Willdan Engineering has prepared the following proposal for the City’s planned improvements to Leroy Jackson Park. Willdan provides a complete range of building and safety staffing, building plan check, code compliance, land development, engineering, planning consulting, construction engineering, and labor compliance services to local agencies – often on an as-needed basis. Willdan has pioneered the extension of staff services in California since our inception.

Project Understanding
Willdan understands that the City would like to improve Leroy Jackson Park with a number of renovations and replacements, including:
 Clean California Grant Funded Improvements
o Repairing and completing an ADA accessible walking path o Installing solar lighting along the walking path
o Xeriscape with native plants and shade trees
o Installing (2) drinking fountains with bottle fillers o Replacing/adding benches with shade structures along the path o Adding waste receptacles with proper labeling
o Installing lighting for tennis courts with timer switch o Adding educational signage (litter abatement and native plants) o Adding a Dial-A-Ride transit stop with shaded seating  ARPA Grant Funded Improvements
o Tennis court resurfacing
The existing Leroy Jackson Park Sports Complex is bounded on the north by Drummond Avenue and on the east by French Avenue. The limits of proposed improvements on the south side will be the existing Skate Park and on the west side will be just beyond the westerly edges of the existing field areas. There will be no improvements made to the existing parking lot, except for changes to the striping, including moving ADA stalls. The existing stalls need to be checked for ADA compliance and if they are not compliant, they need to be restriped at an alternate location that is compliant. The existing park has tennis courts, parking lot, concession/restroom building, pavilion lighting, sidewalks, sports fields, and sports park lighting. There is also existing curbing installed around the proposed walking path. There are some areas of the existing curbing that are damaged and will need repair. There are also some areas where there are gaps in the existing curbing that need to be filled in with new curb. Three of the existing six tennis courts will be resurfaced and the three southerly courts will require a new post-tension slab to be designed. The City of Ridgecrest
August 1, 2022 (Revised August 8, 2022)

Page 2 ends

three northerly tennis courts are to be striped for pickle ball and tennis courts after the resurfacing is complete.

Topographic survey is only anticipated to be needed for any non-compliant ADA ramps and for the ADA walking path, and all survey data will be provided by the City. The City will be furnishing an aerial survey of the entire site, along with supplemental ground survey for conforms.

The City has State funding (ARPA and Clean California) to construct the proposed project. The State funding is allocated through Caltrans and the grant administration is only anticipated to require project cost accounting and reimbursement invoicing to Caltrans. Separate consultant invoices will be provided for the two grant funding sources. The construction documents will also include separate bid schedules for each funding source.

We appreciate the opportunity to submit our proposal and look forward to discussing the tasks shown below with you.

SCOPE OF WORK

PRESENTED BY: Travis Reed, Public Works Director
SUMMARY:

The City of Ridgecrest previously entered into an agreement with Willdan Engineering Inc. to provide Design Engineering Services for the Phase II Sewer Project, and a detailed engineering report. The previous scope of work was as follows: Design a multi-year Capital Improvement Plan (CIP) update for replacing/repairing all remaining Grade 4 and 5 class defects in the sewer collections mains and trunks, corresponding rehabilitation of the connecting manholes to accomplish repairs to the sewer trunks in China Lake Boulevard between Argus and California Avenue, and in California Avenue between China Lake Boulevard and Richmond Avenue. The specific project included inspection/evaluation of about 8,500 feet of existing sewer pipe and the corresponding 29 manholes, asset assessment, defining the best repair approach for the condition identified, estimating of probable construction costs, scheduling of construction projects, and preparing an updated engineering report.

With the acceptance of this proposal this will include the analysis of class 3 defects for the Phase II project, as well as the CIP update and the engineers report. Willdan will prepare revised preliminary estimate for the City of Ridgecrest’s review and approval, prior to the changes, revise plans and estimates as necessary; and revise the engineers report and update the multi-year CIP program. The design effort will be significant, since the CCTV Videos and the report have to be reviewed a second time to locate the point repairs, that previously were not addressed.

The fee for the project amendment is $11,578.00. City Council previously authorized a Professional Services agreement in the amount of $157,487.00 via. Resolution 2020-48.

The new amended total, if approved shall be $166,065.00. The fee will be funded with Wastewater Enterprise Fund, and staff feels it is a very fair price for the work which is necessary.

Staff recommends that the City Council approves the amended agreement and authorizes the City Manager, Ron Strand, to execute the amended agreement with Willdan Engineering Inc.

WILLDAN – PHASE II SEWER
This Amendment No. 1 to the Consultant Agreement ("Amendment No. 1") is entered into as of September 7, 2022 ("Effective Date"), by and between the City of Ridgecrest, a municipal corporation ("City"), and Willdan Engineering, a California corporation (“Willdan”). City and Willdan are sometimes hereinafter referred to individually as a "Party" and collectively as the "Parties."

RECITALS
A. Pursuant to Resolution 20-48, on January 7, 2021, City and Willdan entered into a Consultant Agreement for Professional and Engineering Services to provide design for the multiyear Capital Improvement Plan (CIP) update for replacing/repairing all remaining Grade 4 and 5 class defects in the sewer collection mains and trunks, and corresponding rehabilitation of the connecting manholes for the trunk sewer. (“Master Agreement”). The Master Agreement” which is attached hereto as Attachment “B”. Phase II Sewer Line Rehabilitation encompasses China Lake Boulevard between Argus and California Avenue, and in California Avenue between China Lake Boulevard and Richmond Avenue, and various point repairs in the City of Ridgecrest. After the first draft of plans were submitted, the City found it necessary to change direction and alter the scope of work to include Grade 3 defects and change rehabilitation methods to a complete replacement if we had more than four (4) point repairs between existing manholes. With this Willdan has prepared a cost differential for the additional work as apparent in Attachment “A” B. Section 20 (Integration) of the Master Agreement, states that the agreement “may not be modified or altered except in writing, signed by both parties”.

C. As commenced, the City has requested Willdan to submit a Change Order proposal to detail the additional requested work. The Change Order is attached hereto as Attachment “A”.

D. The Parties now desire to amend the Master Agreement to provide for certain professional and engineering consulting services related to design services including Class 3 defects/repairs in the CIP project and the engineers report. Capitalized terms not otherwise defined herein shall have the meanings assigned to them in the Master Agreement.

A G R E E M E N T
NOW, THEREFORE, in consideration of the foregoing Recitals and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, City and Willdan hereby agree to amend the Master Agreement by this Amendment No. 1 as follows:

1. Additional Design Services. Subject to the terms and conditions of this Amendment No. 1, Willdan will provide through its professionals, the necessary professional and engineering services, as indicated by the tasks enumerated in Attachment “A” to this Amendment No. 1 consistent with applicable laws and good industry practices. For purposes of this Amendment No. 1, the aforementioned scope of additional services and tasks for design services as indicated in Attachment A shall hereinafter be referred to generally by the capitalized term “Work”. Work shall only be authorized and commenced for specific tasks and projects as provided for in Section 2(c) of the Master Agreement.

The Scope of Services, additional tasks, and their respective funding allocations shall be amended as indicated in Attachment A.

3. Miscellaneous.
(a) Effect of Amendment. The term "Agreement" when used in this Amendment No. 1 or the Master Agreement shall mean the Master Agreement as amended, modified, and supplemented by this Amendment No. 1 unless the context would require otherwise. Except to the extent the Master Agreement is modified by this Amendment No. 1, the remaining terms and conditions of the Master Agreement shall remain unmodified and in full force and effect. In the event of conflict, between the terms and conditions of the Master Agreement and the terms and conditions of this Amendment No. 1, the terms and conditions of this Amendment No. 1 shall prevail and control.
(b) Entire Agreement. The Master Agreement, together with this Amendment No.1, embodies the entire understanding between City and Willdan with respect to its subject matter and can be changed only by an instrument in writing signed by City and Willdan. City of Ridgecrest

Ridgecrest, CA 93555
Subject: Contract Amendment Request No. 1 for Professional Engineering Services for the Ridgecrest Phase 2 Sewer line Rehabilitation Project, PO #21-302 Dear Mr. Reed:

Per previous discussions, this letter is to request authorization to modify the budget for our original design engineering services contract for the City’s Multi-Year Sewer Repair and Replacement Program and Phase Two Sewer Line Rehabilitation, Repair or Replacement Project. The City has engaged the services of Willdan Engineering to provide design engineering services, for the multi-year Capital Improvement Plan (CIP) update for replacing/repairing all remaining Grade 4 and 5 class defects in the sewer collection mains and trunks, and corresponding rehabilitation of the connecting manholes for the trunk sewer. Willdan included an additional street segment on Shamrock as part of the OES improvements. Willdan included a point repair, inspected the manholes and provided design for manhole lining.

Willdan’s original budget of $154,487.00 (PO #21-302) included the design for grade 4 and grade 5 class defects.

City desired to analyze class 3 defects and include the class 3 repairs in the CIP project and the engineers report.

Contract Amendment Request No. 1 would provide additional compensation for the extended scope in the amount of $11,578, making our current amended contract amount $166,065.

The design effort was significant since the CCTV videos and the reports had to be reviewed again to locate the point repairs, prepare preliminary estimate for City’s review and approval prior to the changes, revise the plans, estimates, the engineers report and update the multi-year CIP program to include class 3 repairs.

Based on the aforementioned items, Willdan’s Contract Amendment Request No. 1 provides compensation for the required extended contract engineering services outside of the original scope of work.

STAFF REPORT
SUBJECT: Second Reading And Adoption, Ordinance 22-04, An Ordinance Amending Chapter 102 Of The City Of Ridgecrest Municipal Code By Setting Forth An Expedited, Streamlined Permitting Process For Electric Vehicle Charging Stations As Required By Government Code Section 65850.7 and 65850.71
PRESENTED BY: Travis C. Reed, Public Works Director
SUMMARY:

In 2015, the State of California adopted Assembly Bill 1236 (2015, Chiu, Codified as Government Code Section 65850.7), which requires local jurisdictions with a population less than 200,000 residents to adopt an ordinance to create an expedited, streamlined permitting process for electric vehicle charging stations on or before September 30, 2017. (Yes we are a Little late to the Party) An electric vehicle charging station is any level of electric vehicle supply equipment station which deliver electricity from a source outside an electric vehicle into a plug-in electric vehicle. AB 1236 may refer to the recommendations in the most current version of the “Plug-In Electric Vehicle Infrastructure Permitting Checklist” of the “Zero-Emission Vehicles in California: Community Readiness Guidebook” published by the Governor’s Office of Planning and Research.

Background
Assembly Bill 1236, which amended Government Code Section 65850.7 to require jurisdictions with a population less than 200,000 residents to establish procedures for expedited, streamlined processes for permitting of electric vehicle charging stations. The amendments to Section 65850.7 include the requirement for a jurisdiction to adopt an ordinance for the expedited, streamlined process on or before September 30, 2017. The ordinance shall include the requirement that a jurisdiction adopt a checklist of requirements with which a permit application for an electric vehicle charging station will be eligible for expedited review.

This process includes the establishment of a checklist containing objective requirements for the installation of an electric vehicle charging station and a process for electronic submittal of permit applications. The content of the checklist requires the permit applicant to check the features of the existing electrical service such as rating in amperes, system voltage, connected or calculated load, spare capacity in amperes, voltage and ampere rating of the electric vehicle supply equipment, circuit rating of the electric vehicle supply equipment, location of the electric vehicle supply equipment, if ventilation is/or is not required, and clearances of the charging equipment to comply with all applicable building and fire safety laws. The checklist also assists the applicant in confirming that the location of the electric vehicle supply equipment will comply with any vehicle clearance requirements in the City’s Zoning Ordinance. Section 65850.7 requires that the City’s checklist may be based on the “Plug-In Electric Vehicle Infrastructure Permitting Checklist” of the “Zero-Emission Vehicles in California: Community Readiness Guidebook” of the Governor’s Office of Planning and Research.

Assembly Bill 1236 (2015) also clarifies that a jurisdiction shall not condition approval of a permit for an electric vehicle charging station based on the approval of an association as defined in California Civil Code, Section 4080.

Staff recommends that City Council introduce for First Reading the attached ordinance, given Government Code Section 65850.7’s requirement that local agencies adopt such an ordinance to create an expedited, streamlined permitting process for electric vehicle charging stations on or before September 30, 2017. Most of the procedures, such as electronic submittal of plans are currently in place and comply with the requirements of the Assembly Bill and staff is assuring that successful implementation of an expedited, streamlined process will be available to permit applicants, staff has begun undertaking allowing Electronic Plan Submittals as required by this and expects to be rolling that out in early 2023.

Building and Safety Commission Action
The Building Officer and Fire Marshal held a public meeting with the Building and Safety Commission where the Commission heard staff’s proposed procedures for an expedited, streamlined process for electric vehicle charging stations. The Commission provided comments regarding balancing the requirement for expedited processing while verifying the fire, life and safety aspects of electric vehicle charging stations and maintenance of public protection. Staff intends for the application and checklist process to create a standardized system of issuing permits for compliant installations. Staff assured the Commission that all requirements of fire-life-safety will be verified during the review and inspection for the electric vehicle charging stations.

Introduction and first reading occurred on August 17, 2022.

Next Steps
Concurrent with Council’s adoption of the ordinance, staff, is taking the measures to meet all requirements of Assembly Bill 1236 (2015). This includes finalizing the application checklist in conjunction with the “Plug-In Electric Vehicle Infrastructure Permitting Checklist” of the “ZeroEmission Vehicles in California: Community Readiness Guidebook”, measures for electrical compliance, and standard items for fire prevention safety. Building and Fire inspection staff are also developing procedures for expedient and thorough inspection of the electric vehicle charging stations.

FISCAL IMPACT: NONE
ACTION REQUESTED: Staff recommends that the City Council adopt the attached Ordinance 22-04 which sets forth an expedited, streamlined permitting process for electric vehicle charging stations.
