CITY COUNCIL/SUCCESSOR REDEVELOPMENT AGENCY AGENDA ITEM SUBJECT: Review And Approve Recognized Obligation Payment Schedule (ROPS) 2023-24 And Administrative Budget For Fiscal Year 2023-24 Of The Successor Agency To The Ridgecrest Redevelopment Agency And Approval Of Resolution PRESENTED BY: Cheri Freese, Finance Director
SUMMARY: The City Council at their regular meeting of January 11, 2012 adopted Resolution No 12-02, electing to serve as the Successor Agency to the Ridgecrest Redevelopment Agency (“Successor Agency”) for the purpose of winding down the affairs of the former redevelopment agency under state law. Among the legal procedures for this duty, the Successor Agency is required to prepare a Recognized Obligation Payment Schedule (“ROPS”) prior to each 12- month fiscal period, in a manner prescribed by the California Department of Finance (“DOF”), and submit the ROPS to the oversight board, the Kern County Auditor-Controller, the State Controller’s Office, and DOF for review and approval.
As delineated on the proposed ROPS 23-24 attached to the accompanying resolution, the total requested Redevelopment Property Tax Trust Funds (“RPTTF”) for ROPS 2023-24 is $2,921,617. The Successor Agency’s 2023-24 enforceable obligations include the following items:
1. Continuing Disclosure Reporting Fees (ROPS Line #9) of $7,500.
2. Administrative Cost Allowance (ROPS Line #13) of $250,000. Staff has also prepared a budget for Successor Agency services detailing the usage of the full $250,000 budget request. This budget includes $190,000 for staff salaries, benefits and payroll taxes, $10,000 for contracted services with RSG, and $50,000 for insurance and legal services.
3. Senior Housing Loan (ROPS Line #38) totaling approximately $204,773. On the ROPS 22-23, staff requested RPTTF to fund the outstanding loan amount of $3,000,000 and $290,403 for litigation costs related to the loan, totaling $3,290,403. On April 15, 2022, DOF issued a determination letter approving the $290,403 for litigation costs but denied the $3 million loan balance due to the City. On July 7, 2022, DOF issued a revised determination letter approving RPTTF funding for the $3 million loan. However, because the ROPS 22-23A RPTTF distribution had already occurred, DOF moved the $3 million originally requested in the ROPS 22-23A period to the ROPS 22-23B period. According to the Successor Agency’s financial consultant RSG, Inc., the Successor Agency is projected to have a shortfall of $204,773 in the ROPS 22-23B period and will be unable to fund the obligation in its entirety. As such, the Successor Agency is requesting $204,773 to fund the remaining outstanding obligation on the ROPS 23-24. Staff requests authority to revise the requested RPTTF on the ROPS 23-24 when the 22-23B RPTTF distribution amount is published to reflect the actual shortfall amount.
4. Wastewater Loans (ROPS Line #39): Line Item #39 is a loan approved by DOF to be repaid to the Ridgecrest Wastewater Fund/City with an outstanding balance of $1,003,054. By law, these Wastewater Loan payments are subordinate to other enforceable obligations. DOF has a specific formula to calculate the maximum allowable payment per fiscal year for loans to be repaid to a city. Payments on loans made are limited in each fiscal year to one half of the difference between the previous fiscal year’s residual revenue and the fiscal year 2012-13 residual revenue. Pursuant to this formula, no RPTTF is expected to be approved by DOF on the ROPS 23-24.
5. Bond Debt Service Payments (ROPS Lines #42 and 43) totaling $2,454,924. Once the debt service on the 2018 TARB Bonds Series A and B is paid in full after March 2037 the Successor Agency will have completed its obligations and dissolution of the former redevelopment agency would be complete and all taxing agencies including the City would receive their full share of these former tax increment/RPTTF funds as property taxes, and
6. Arbitrage Report Fees (ROPS Line #44) totaling $2,000.
7. Fiscal Agent Fees (ROPS Line #45) totaling $2,420.
The staff has prepared the Successor Agency ROPS 2023-24 and Fiscal Year 23-24 Administrative Budget and is recommending approval by the Successor Agency and its submission to the Oversight Board and then DOF.
Oversight boards have broad authority to determine meeting dates at which successor agencies must submit items, to set administrative budgets, to approve enforceable obligations, and otherwise to direct the successor agency to perform activities to wind down the former redevelopment agencies. Therefore, after the ROPS 23-24 and the Administrative Budget have been approved by the Successor Agency, both will be sent to the Oversight Board for approval.
FISCAL IMPACT: Upon approval by the Successor Agency, Oversight Board, and DOF, ROPS 23-24 would request RPTTF funding needed for the Successor Agency to timely remit payments on enforceable obligations due during Fiscal Year 2023-24. The City and other affected taxing agencies are entitled to receive the balance (“residual”) of any RPTTF available after each of the two RPTTF distribution periods based on their respective shares.
The ROPS must be completed within prescribed deadlines or the City would face potential fines.
The ROPS for July 1, 2023 through June 30, 2024 (“23-24”) is due to DOF by February 1, 2023 and the City of Ridgecrest (“City”) is subject to a civil penalty equal to $10,000 per day for every day the ROPS is not submitted to DOF.
ACTION REQUESTED: Review and approval of ROPS 2023-24 and Fiscal Year 2023-24 Successor Agency Administrative Budget and corresponding resolution.
CITY MANAGER / EXECUTIVE DIRECTOR RECOMMENDATION: Action as requested.

The Franklin Ave. Improvement Project was solicited on October 4th, 2022. Bids were received on November 3
rd, 2022 and were opened at the Finance Counter by City Staff in the presence of contractor representatives. After the presentation an apparent low bidder, Bowman Asphalt, Inc. was announced with the caveat that bids were subject to review by the City’s selected Engineering Firm, Willdan Engineering, and the Engineer in Responsible Charge of the project, Mr. Mike Bustos.
After Mr. Bustos’ review it was recommended that the Contract be awarded to the Lowest responsible bidder, Bowman Asphalt. Staff reviewed the Additive Bid Alternate 1 for high tensile fiber, and is recommending the inclusion of this in the project. Staff believes that with the traffic volumes on this street the addition of high tensile fiber to aid in tensile strength will increase the longevity of the road, and will save future costs by adding valuable time to the life span of the road.
Staff bid this project in two ways. The conventional method, remove and replace, and with newer technology which utilizes existing asphalt grinds in an attempt to preserve valuable dollars.
Unfortunately, the recycled method still yielded higher prices than the traditional method.
Staff recommends the contract be awarded for the base bid (Schedules A and B) with the addition of the additive alternate (Schedule D), to the lowest responsible and responsive bidder. Said recommendation is to award the construction contract to Bowman Asphalt, the low base bid for schedule A+B in the amount of one million three hundred and forty-seven thousand three hundred and seventy-two Dollars and no Cents ($1,347,372.00), and accept Additive Bid Alternative 1 in the amount of forty-five thousand seven hundred and thirty Dollars and no cents ($45,730.00).
Therefore, Staff recommends the approval in the amount of one hundred and thirty-nine thousand three hundred and ten dollars and twenty cents, ($139,310.20), or ten percent (10%), for Construction Contingencies crucial to the successful completion of the project from Measure V Funds. Said funds will be treated as not to exceed without future authorization from Council. These funds will be utilized for work that may arise during the construction process which was unforeseen at the time of bidding.
If Council approves, a purchase order will be issued to Bowman Asphalt for the total contract amount of $1,532,412.20 ($1,347,372.00 (Base Bid)+ $45,730.00 (Additive Alternate 1) + $139,310.20 (contingency))

STAFF REPORT
The FY22 Measure V Chip Seal Project was solicited on October 25 th, 2022. Bids were received on
November 21st, 2022 and were opened at the Building Counter by City Staff in the presence of Contractor Representatives. After the presentation an apparent low bidder, Pavement Coatings Co., was announced with the caveat that bids were subject to review by the City’s selected Engineering Firm, Willdan Engineering, and the Engineer in Responsible Charge of the project, Mr. Mike Bustos.
After Mr. Bustos’ review it was recommended that the contract be awarded to the lowest responsible bidder, Pavement Coatings Co.
Staff and Willdan have extensive experience with Pavement Coatings Co., thus an extensive reference check was not performed. It is both staff and Willdan’s position that Pavement Coatings Co. is a responsible contractor capable of completing the project.
Staff recommends the contract be awarded for the base bid to the lowest responsible and responsive bidder. Said recommendation is to award the construction contract to Pavement Coatings Co., the low base bid in the amount of One Million One Hundred Seventy-eight Thousand Seven Hundred and Sixty Dollars and no Cents ($1,178,760.00).
Staff also recommends the approval of a contingency in the amount of 5%, less than our typical 10%, due to the fact that all the required work is above ground and there should not be any major change orders. Said costs will come from Measure V; these costs are not to exceed Fifty-eight Thousand Nine Hundred Thirty-eight Dollars and no cents, ($58,938.00), or Five percent (5%), without authorization from the council. Construction contingencies are crucial to the successful completion of a project.
Staff took special precaution and did extensive research, conducted field walks, and site survey etc. to limit the unknowns, but with every construction project, we don’t know what we don’t know. These funds will be utilized for work that may arise during the construction process which was unforeseen at the time of bidding.
In closing, all the bids were very close in terms of cost. This not only is an indicator of the market, but also is an indication that Staff did their jobs in preparing a comprehensive bid set that all of the contractors viewed the work in a similar light.
If Council approves, a purchase order will be issued to Pavement Coatings Co. for the total contract amount of $1,237,698.00 ($1,178,760.00 + $58,938.60) inclusive of: the base bid price and contingency.
FISCAL IMPACT: $1,237,698.00 for construction costs and contingency funded from Measure V.

SUMMARY:
On Thursday, October 20th, 2022 bids were opened to construct the FY 22 Measure V Paving Project Bids Contained four (4) bid schedules; (A, B, C, and D) and were compared for purposes of evaluating the lowest bid based on the totals of Schedules A Plus C (CCPR Alternative) and Schedules A plus D (HMA Alternative). In all instances, the lowest bid from each bidder was the total of Schedules A Plus D. STAFF REPORT
The FY22 Measure V Paving Project was solicited on September 23rd, 2022. Bids were received on October 20th, 2022 and were opened at the Finance Counter by Staff in the presence of Contractor Representatives. After the presentation an apparent low bidder, Griffith Company, was announced with the caveat that bids were subject to review by the City’s selected Engineering Firm, Willdan Engineering, and the Engineer in Responsible Charge of the project, Mr. Mike Bustos.
Prior to Mr. Bustos’ review, and upon seeing the drastic increases due to inflation, staff contacted Griffith and told them it was necessary that we hold off awarding any projects until we received, Franklin Ave., and the Chip Seal project bids and could best assess how to spend our valuable Measure V Tax Dollars. With Mr. Bustos’ bid analysis still to be completed, staff informed Griffith if they were in fact the Lowest Responsible Bid, there would be a high possibility that two streets would be cut from the project. Griffith staff indicated they would be ok if some items were cut to keep the City within budget.
After Mr. Bustos’ review, it was recommended the contract be awarded to the lowest responsible bidder, Griffith Company.
An extensive background was not conducted on Griffith Company, since over the past 10 years Griffith has successfully completed multiple projects for the City.
With all the road work proposed and the cost increases we have seen, Staff did extensive research on the amount of Measure V funds available for road work this fiscal year. After consultation with the Finance Director Freese and City Manager Strand, Staff found that approximately $2,330,000.00 was still remaining in Measure V reserves after the budget for this Fiscal Year was presented. Staff feels completing these major road projects (Measure V Paving, Chip Seal and Franklin Ave.) is a must. After receiving all the Project Bids, we compiled our numbers and have made necessary cuts across a couple projects to get us to approximately $400,000.00 remaining within the Measure V reserve fund.
This project saw two streets cut:
1. Reeves Ave. From Inyo St. to Mahan Ave.
2. Fairview St. From Drummond Ave. to Felspar Ave.
With these cuts, staff removed +/- $544,289.85 from the project and feels we have left an ample reserve should something additional come up.

Griffith has worked very closely with staff and is agreeable to the scope changes to meet the City’s needs. Therefore, Staff recommends the contract be awarded for the revised base bid to the lowest responsible and responsive bidder. Said recommendation is to award the construction contract to Griffith Company, in the amount of $4,611,445.15.
Together with the award of the contract, Staff is also requesting a Five (5%) percent contingency for unknowns which we may encounter on the project. Anytime you are digging you are bound to run into something. We hope to only need a small portion of this, but being this is in older part of town where as-builts are not the greatest, we would like to cover all of our bases. Said 5% amount is $230,572.26.
Additionally, Staff requests the processing of an Amendment for Construction Engineering in the amount of $108,000.00 for Willdan Engineering. This extra work can be attributed to the growing size of the project which utilized a 75 working day estimate when it was prepared, and now is a 100 working day contract. Also contributing to this is staff felt it was in the best interest to separate the Chip Seal and Paving Projects so we could save money and have multiple prime contractors. This Amendment will insure that all work being performed meets all of our specifications and will also provide valuable experience to our Engineer 1 who has never been involved with a construction project of this magnitude.
If Council approves, a purchase order will be issued to Griffith Company for the total contract amount of $4,842,017.41 ($4,611,445.15 + $230,572.26) inclusive of: the REVISED base bid price and contingency. An additional purchase order amendment will be issued to Willdan Engineering for the purpose described previously in the amount of $284,099.00 plus the $108,000.00 amendment for a grand PO total of $392,099.00.

On Thursday, November 17th, 2022 bids were opened to construct the Phase II Sewer Project. A total of one bid was received as follows:
Bidder Base Bid Total Bid
EverLevel Holdings $6,294,235.00 $6,294,235.00

The Phase II Sewer Project, was solicited on October 10th, 2022. Bids were received on November 17th, 2022 and were opened at the Finance Counter by City Staff in the presence of Contractor Representatives. After the presentation an apparent low bidder, Everlevel Holdings Inc., was announced with the caveat that bids were subject to review by the City’s selected Engineering Firm, Willdan Engineering, and the Engineer in Responsible Charge of the project, Mr. Mike Bustos.
Prior to Mr. Bustos’ review, Everlevel made it apparent that they were willing to work with the City to remedy the cost discrepancy from the Engineer’s Estimate to their bid in an attempt to lower the cost. Staff met with Everlevel on November 21, 2022 and discussed numerous potential impacts they felt could be mitigated. Staff will be calling Caltrans to discuss a possible daily shut down of SR178 from Argus St. to Ridgecrest Blvd., and the possibility of shutting down intersections along California Ave. Ultimately, the driver for cost has to do with the sewer bypass system. As indicated by Everlevel, if side streets could be shut down it would alleviate the need to install underground bypass piping.
This could save the City close to $250,000.00 as the bypass piping could be installed above ground.
This would also save cost on road repair. Another driver of cost has to do with the location of the sewer. In China Lake Blvd. the sewer main is located about 3’ from the edge of pavement, this will place a track of the excavator (the equipment that is used to dig the trench) on the sidewalk and will Ridgecrest City Council

warrant a full reconstruction of the sidewalk curb and gutter from Argus St. through the turn pocket in front of Rite Aid. All of our initial estimates failed to take this into account. With these, and the numerous changes we made to the design because there were so many point repairs (a full replacement of the pipe from Argus to California) staff can see why the Engineers Estimate is far below the bid price.
After Mr. Bustos’ review, it was recommended that the contract be awarded to the lowest responsible bidder, EverLevel Holdings.
Staff conducted extensive research on past Everlevel projects. Council recently awarded the Ward Ave. Phase I contract to Everlevel and we have no reason to think this project will go any different.
Throughout the bidding process Everlevel has been very forthcoming with potential impacts that could arise on the project and they wanted to have the answers prior to bidding so they could put together the best possible number. It really was a breath of fresh air, due to their questions we issued three addendums addressing concerns prior to bid opening which will save the city countless time and material extras. Below you will find some of the responses we received from past Everlevel Clients:
City of Porterville – Daniel Cervantez – “EverLevel performed the work with little problems. There is only a slight issue with one of their subs which is why the project has not been accepted. They performed the work for the expansion of our Transit Center Charging Stations. They are currently working on our Sewer Annexation Project and so far, they have been performing. They are about 40% done with the project. I would work with Everlevel again.”
City of Ventura – Mark Garcia – “There were no issues resulting from Everlevel’s efforts. Everlevel was very accommodating to field changes. Everlevel installed 7 concrete pads for support of emergency generators at various City water pump stations. The work involved over excavation and compaction, electrical conduit placement, steel bar and concrete placement. Quinn Caterpillar placed the generators. Everlevel’s electrical subcontractor connected each generator to their respective pump station switch gear/transfer switches. Yes, the City would work with Everlevel again.”
Caltrans – Adam Zumstein – “I had no issues working with Everlevel. From what I was told the inspectors in the field had no issues either. Graded winter pullouts on highway 6 and 395. Yes, I would work with them again.”
Staff recommends the contract be awarded for the base bid to the lowest responsible and responsive bidder. Said recommendation is to award the construction contract to Everlevel Holdings Inc., the low base bid in the amount of Six Million Two Hundred and Ninety-four Thousand Two Hundred & Thirty-five Dollars and no Cents ($6,294,235.00).

STAFF REPORT
Together with the award of the Contract staff is also requesting a Ten (10%) percent contingency for unknowns which we may encounter on the project. Anytime you are digging 18’ deep you are bound to run into something. We hope to only need a small portion of this, but being this is an older part of town where as-builts are not the greatest we would like to cover all of our bases. Said 10% amount is $629,423.50.
Additionally, Staff requests $314,908.00 for Construction Engineering which will provide materials testing and continuous inspection on the project. This will insure the work being performed meets all of our specifications and will also provide valuable experience to our Engineer 1 who has never been involved with a construction project of this magnitude.
If Council approves, a purchase order will be issued to Everlevel Holdingsfor the total contract amount of $6,923,658.50 ($6,294,235.00 + $629,423.50) inclusive of: the base bid price and contingency. SUBJECT: A Public Hearing And Resolution Approving The Fiscal Year 2023-2024 Annual Application Regarding The Kern County Community Development Block Grant (CDBG) Program PRESENTED BY: Nerissa Wegener, Parks and Recreation Director SUMMARY:
A noticed public hearing for December 7, 2022 was established to discuss and prioritize proposed Community Development Block Grant (CDBG) Projects for the Fiscal Year 2023-2024 Annual Application for Community Development Programs within the County of Kern. The anticipated fair share amount for FY 2023-2024 is $101,959.
Public comments are solicited and will be heard and accepted before approval of the selected project. The Resolution is presented to confirm the allocation of funds at the conclusion of the public hearing and must be filed, along with the project application, with the County of Kern.
It would be appropriate to open the public hearing, receive public comments, review and discuss projects as may be desired and determined.
It is staff’s recommendation that the CDBG funding allocation should be considered for improvements to the Leroy Jackson Sport Complex Upper Softball Field. Staff recommends that the CDBG funding in the amount of $101,959 is used to include shade structures over the spectator seating and dugouts on the upper softball field. At of this time, staff are working on many improvements for this area including shade on the two lower softball field dugouts and spectator seating.
The estimated cost of the project is $165,462 with the full cost of the project being augmented with Park Impact Fees or another funding source.
The softball fields that are located at the Leroy Jackson Sports complex are used by a lot of different people in our community of all ages and demographics. This area is also used for softball tournaments and people from other communities travel here to play. The Leroy Jackson Sports Complex is in the middle of several upgrades, from adding shade, completing the walking path, drinking fountains, and lighting. This is just one more thing that needs to be completed.
Staff considered other possible projects using the CBDG funding such as adding play equipment next to the Splash Pad in Freedom Park.
Both project ideas went before the Quality of Life Committee on November 1, 2022 and the committee approved the project to be considered at the public hearing for the CBDG grant.

Project Name: City of Ridgecrest – Leroy Jackson Sports Complex Softball Shade Project
PROJECT PURPOSE AND BENEFIT
A. What is the purpose of the project? Provide a brief statement of the problem to be addressed and describe what the project will accomplish. (See attached list of Eligible Activities and National Objectives, Appendix A.)
The CDBG money will be helping to provide shade over the dugouts and bleachers at Leroy Jackson Sports Complex softball field. This will allow the city to address the publics request to provide these items as well as produce a safer environment at the soft ball field by providing a shaded area for parents to sit and watch their children and allow an area for players and coaches to cool off and get out of the direct sunlight. Providing this shade will also allow extended use of the field in the summer months when the temperatures reach the triple digits.
B. Provide a map showing the specific geographic service area boundaries of your project. (See attached description of Determining Service Areas, Appendix B.) Ridgecrest City Limits C. Describe who or what group(s) will benefit from the project. Include characteristics such as race, gender, income, age, etc. (See attached form pursuant to HUD requirements of Outcome Performance Measurement, Appendix C.) The public, tourists, and community members all of which have users who vary in race, gender, age and income.

Currently this facility is maintained by the City of Ridgecrest and no third-party agreement is needed.
C. For larger scale projects, will this project be phased? This project will be completed simultaneously and no phasing will be needed.
D. Who will implement this project (complete design, conduct bid advertising, contracting, etc.)? The Parks Director will oversee the project. The design is not currently complete and will be contracted out.
E. Please describe all alternative sites and alternative project designs that were considered:
The Freedom Park Splash Pad which included adding a small playground within the park boundary. This project was not chosen as the Splash Pad, built in 2019, is not an area utilized year-round.
FUNDING SOURCES/PROJECT COST ESTIMATE
A. Please explain why CDBG assistance is needed for this project? Due to the COVID19 pandemic and the 2019 July 3rd & 4th earthquakes, the City of Ridgecrest has suffered a loss of revenue due to having to cancel many of our programs. This has limited our recreation department’s ability to provide necessary upgrades to our facilities. CBDG assistance is needed for this project as we feel it is important to be able to provide our community with adequate facilities that fit our extreme climate and current circumstances.
B. Itemize all sources of funding expected to be available and used for this project.
