STAFF REPORT
SUBJECT: A Resolution Of The Ridgecrest City Council To Appropriate A Portion Of The American Rescue Plan Act Funds To Replace And Modernize The City Of Ridgecrest Server And Desktop Infrastructure
PRESENTED BY: Matt Freese, Information Systems Manager
SUMMARY:

On March 11, 2021, President Biden signed into law the American Rescue Plan Act (ARPA), which provides one-time fiscal relief funds to State and Local Governments and other program areas aimed at mitigating the continuing effects of the COVID-19 Pandemic. ARPA includes State and Local Fiscal Recovery Funds (SLFRF) to support urgent COVID response efforts to decrease the spread of the virus and to replace lost public sector revenue to strengthen support for vital public services. The City of Ridgecrest’s allocation of direct local stimulus is $6,930,958, with the first 50% paid to the City in July of 2021 and the remaining balance in July of 2022.

The United States Treasury has adopted the SLFRF final rule, along with a list of Frequently Asked Questions, as guidance regarding the use of ARPA funds. The allowed uses of ARPA funding focus on four key program areas: to respond to the public health emergency or its negative economic impacts, including assistance to households, small businesses, and nonprofits, or aid to impacted industries such as tourism, travel, and hospitality; to respond to workers performing essential work during COVID-19; for the provision of government service to the extent of the reduction in revenue due to COVID-19; and to make necessary investments in water, sewer or broadband infrastructure. The use of ARPA funds is retroactive to March 3, 2021. All funds must be obligated by December 31, 2024, and must be spent by December 31, 2026.

The City staff brought to council during a workshop on November 17, 2021 a list of recommended projects for the use of appropriations. These projects were discussed with council, community members as well as City staff.

Recommendations for Appropriations at this time:

Modernization and Replacement of City of Ridgecrest Server and Desktop Infrastructure – In Summer of 2016, the IT staff completed a network wide refresh of Server Systems and Virtual Desktop Infrastructure. With an expected lifespan of roughly 5 years, staff earmarked this replacement and modernization as a good infrastructure project for ARPA funding. The fortification of these systems is important to the security and productivity of the City.

The vendor selection process was conducted in several stages dating back to Summer of 2022 where a thorough evaluation of technologies and products were quoted and evaluated.

STAFF REPORT
Staff believes that Dell’s proposal in partnership with ReDesign brings a holistic approach, best fits the needs of the City, and works hand in hand with the current software and infrastructure currently in use.

Below is a list of the component along with the cost associated for consideration:
(3) VxRail AMD Production Cluster with VMware Licensing - $156,522.39 (4) VxRail AMD Virtual Desktop Infrastructure Cluster - $213,856.74 (2) Dell PowerSwitches - $18,175.14
(80) NVIDIA VDI Licenses - $11,498.93
(75) Dell Wyse 5070 Thin Clients – $41,250.00
(160) Dell 24” Monitors - $28,000.00
(5) Dell OptiPlex 7000 Micro Thin Clients – $4,000.00
Performance Physical Desktops and Point of Sale Systems Replacement - $25,000 Tax and Fees – $24,303.94
Contingency - $60,000
Total - $582,607.14
At the council workshop an estimate for this project was presented at $410,000. The increase in request for extra appropriations is due to recent nationwide inflation along the ongoing global crisis in which the demand for integrated circuits exceeds the supply.

The following is an excerpt from the SLFRF final rule regarding the acceptable use of ARPA funding;
“Governments with high capacity to use data and evidence to administer programs are more likely to be responsive to the needs of their community, more transparent about their community impact, and more resilient to emergencies such as the pandemic and its economic impacts. Treasury recognizes that collecting high-quality data and developing community-driven, evidence-based programs requires resources to hire and build the capacity of staff, adopt new processes and systems, and use new technology and tools in order to effectively develop, execute, and evaluate programs. As such, Treasury is clarifying that recipients may use SLFRF funds toward the following non-exhaustive list of uses to address the data, evidence, and program administration needs of recipients. Additional information may be provided in the Compliance and Reporting Guidance. • Technology infrastructure resources to improve access to and the user-experience of government information technology systems, including upgrades to hardware and software as well as improvements to public-facing websites or to data management systems, to increase public access and improve public delivery of government programs and services (including in the judicial, legislative, or executive branches).” Ridgecrest City Council

STAFF REPORT
SUBJECT: A Resolution To Amend A Professional Services Agreement With Quad Knopf Inc. (QK) In The Amount Of $14,700.00 For The City-Wide Street Crack fill Project To Include Additional Professional Engineering Design Services
PRESENTED BY: Travis Reed, Deputy City Manager
SUMMARY:

The City of Ridgecrest required the services of an engineering consulting firm to provide professional engineering services for a City-Wide Street Crack Fill project as a result of the damage caused by the July 2019 earthquakes. This work will include, but is not limited to, preparation of environmental compliance documents, plans, specifications, bid documents, bidding assistance and construction management. Previously staff had QK look into numerous options for how to handle the vast array of cracks the city streets endured from the earthquakes. After numerous hours of work, staff was not pleased with the outcome and initiated a contract with Infrastructure Management Services, LLC (IMS) for detailed crack mapping of the streets in question. This amendment is to cover the extended design services necessary to utilize this data and prepare adequate construction plans. These plans will enable bidders to bid the project in a way that does not leave everything to interpretation. Without the use of the IMS data, staff felt it would be impossible to receive adequate competitive bids. This data, and the QK staff, have successful prepared a 32-page plan set that is ready to be bid.

Staff is requesting an amendment for $14,700.00 for the work rendered by QK. This will be in addition to the funds currently allocated, $142,878.00, for Preliminary Engineering and Construction Engineering. Funds will be made available through the Measure V initially. This work is related to the earthquake and has been approved by Cal OES and the Federal Highway Administration. A portion of this work will be refunded by the Federal Highway Administration at a 75% rate with Cal OES refunding an additional 18.75% for a total of 93.75%. The remaining work will be refunded by Cal OES at a rate of 75%.

Staff recommends that the City Council approves the Amendment; Authorize the Finance Director to amend the budget and update the purchase order to QK and authorize the City Manager, Ronald Strand, to execute the agreement.

FISCAL IMPACT: $14,700.00 in addition to the $142,878.00 which will, and has been allocated from Measure V, initially. Again, staff expects up to a 93% +/- reimbursement rate.

ACTION REQUESTED:

1. Approve an Amendment With The Engineering Firm Of QK, Inc. In The Amount Of $14,700.00 for the preparation of Plans, Specifications, Bid Documents For A City-Wide Street Crack Fill Project and:

2. Authorize the Finance Director to amend the budget to reflect all appropriate capital, revenue and transfer accounts and update a purchase order for QK, Inc. in the amount of $14,700.00; and

3. Authorize the City Manager, Ronald Strand, to Execute The Agreement.

This Amendment No. 2 to the Consultant Agreement ("Amendment No. 2") is entered into as of___________, 2023 ("Effective Date"), by and between the City of Ridgecrest, a municipal corporation ("City"), and Quad Knopf Inc., a California corporation (“Quad Knopf Inc.”). City and Quad Knopf Inc. are sometimes hereinafter referred to individually as a "Party" and collectively as the "Parties."

RECITALS
A. Pursuant to Resolution 20-31, on May 6, 2020, and Purchase Order 2021- 077, City and Quad Knopf Inc. entered into a Consultant Agreement for Professional and Engineering Services to provide environmental, plans, specifications and bidding assistance for the City-wide Street Crackfill Project. This included an option for the Construction Engineering Portion of the Project. (“Master Agreement”). Mr. Strand was authorized per the above mentioned resolution to sign the agreement The Master Agreement” which is attached hereto as Attachment “A”. City-wide Street Crackfill encompasses conduct research with three pavement repair companies for recommendations, prepare multiple preliminary design memos as design repair parameters were revised after contract was executed, and prepare and revise the design plans as parameters were revised to include the street crack mapping from IMS. Per Amendment No. 1 Quad Knopf Inc. was authorized to begin work on the CE portion as it relates to this Project. Quad Knopf Inc. had previously prepared a cost as apparent in Attachment “A”. This proposal is for additional design services as it related to the implementation of the IMS data and preparation of the design plans. Previous staff had QK research a multitude of different design options to which current staff did not feel could accurately be bid by contractors. The IMS data and full comprehensive plans alleviated this.

B. Section 20 (Integration) of the Master Agreement, states that the agreement “may not be modified or altered except in writing, signed by both parties”.

C. As commenced, the City has requested Quad Knopf Inc. to submit a Change Order proposal to detail the additional requested work. The Change Order, which is part of the original agreement, is attached hereto as Attachment “B”.

D. The Parties now desire to amend the Master Agreement to provide for certain professional and engineering consulting services related to and already completed items necessary to keep the City-wide Street Crackfill Project progressing. Capitalized terms not otherwise defined herein shall have the meanings assigned to them in the Master Agreement.

A G R E E M E N T

1. Additional Design Services. Subject to the terms and conditions of this Amendment No. 2, Quad Knopf Inc. will provide, or has provided, through its professionals, the necessary professional and engineering services, as indicated by the tasks enumerated in Attachment “B” to this Amendment No. 2 consistent with applicable laws and good industry practices. For purposes of this Amendment No. 2, the aforementioned scope of additional services, and tasks for PE services as indicated in Attachment B shall hereinafter be referred to generally by the capitalized term “Work”.

Work shall only be authorized and commenced for specific tasks and projects as provided for in Section 2(c) of the Master Agreement which were provided with the original proposal.

2. Consideration for Additional Services. The Section 3 of the Master Agreement shall be amended to enact the additional compensation per Attachment B.

The not to exceed sum of $14,700.00 to the original $142,878.00 for a new total not to exceed sum, unless future written authorization is given of $157,578.00. The Scope of Services, additional tasks, and their respective funding allocations shall be amended as indicated in Attachment A, the original proposal. The original Purchase Order 2021-077 shall be amended to reflect the change.

3. Miscellaneous.
(a) Effect of Amendment. The term "Agreement" when used in this Amendment No. 2 or the Master Agreement shall mean the Master Agreement as amended, modified, and supplemented by this Amendment No. 2 unless the context would require otherwise. Except to the extent the Master Agreement is modified by this Amendment No. 2, the remaining terms and conditions of the Master Agreement shall remain unmodified and in full force and effect. In the event of conflict, between the terms and conditions of the Master Agreement and the terms and conditions of this Amendment No. 2, the terms and conditions of this Amendment No. 2 shall prevail and control. (b) Entire Agreement. The Master Agreement, together with this Amendment No.2, embodies the entire understanding between City and QK with respect to its subject matter and can be changed only by an instrument in writing signed by City and QK.

STAFF REPORT
SUBJECT: A Resolution Of The Ridgecrest City Council To Appropriate An Additional Portion Of The American Rescue Plan Act (ARPA) Funds For Addition Design Services For The Leroy Jackson Park Bathroom
PRESENTED BY: Travis Reed, Public Works Director
SUMMARY:

On March 11, 2021, President Biden signed into law the American Rescue Plan Act (ARPA), which provides one-time fiscal relief funds to State and Local Governments and other program areas aimed at mitigating the continuing effects of the COVID-19 Pandemic. ARPA includes State and Local Fiscal Recovery Funds to support urgent COVID response efforts to decrease the spread of the virus and to replace lost public sector revenue to strengthen support for vital public services. The City of Ridgecrest’s allocation of direct local stimulus is $6,930,958, with the first 50% paid to the City in July of 2021 and the remaining balance in July of 2022.

The United States Treasury has adopted the final rule, along with a list of Frequently Asked Questions, as guidance regarding the use of ARPA funds.

Recommendations for Appropriation in addition to the previous Awarded amount Previous Commitment: Resolution 22-27 Clean Ca. and 22-28 Tennis Courts Previously Council authorized staff to enter into an agreement to receive the Clean California Grant (Reso. 22-27) and to execute a project to rehab the tennis courts at Leroy Jackson Park. In conjunction with this Council requested, we add the bathroom to the park as per previously discussed ARPA projects. In response to this, staff has put together a single project for all the improvements at Leroy Jackson Park, which will be executed under the Clean California Grant Project Contract. All project funds will be tracked separately, and funding sources will not be mixed.

On September 7th, 2022, Council authorized staff to enter into an agreement with Willdan Engineering for professional design services (Reso. 22-61; PO 2022-141) as it related to the Park Upgrades and the ARPA tennis court project. Said contract was for $217,073.00. This contract included updates to the walking path, trash receptacles, ADA improvements, signs, trees, plants and the tennis courts.

Appropriations can be seen below:

Staff requested Willdan to prepare a cost estimate for the additional design services necessary to add a pre-engineered restroom facility similar to the one installed near the splash pad. The location of this will be between the upper field and the lower fields in the norther portion of the existing City Park.

The additional appropriations requested are $18,710.00. Said fee is not to exceed without written authorization from Council.

With the approval of this appropriation City Council will successfully deliver all the proposed Leroy Jackson Park improvements previously discussed, and staff will have a comprehensive plan set which is necessary to bid and construct the multitude of improvements at this site.

In Conclusion City Staff asks for an additional appropriation of $18,710.00 to be utilized for the design of the above-mentioned improvements. This additional appropriation will bring the total APRA funding allocated for this project to $594,710.00. However, an additional portion of the original $217,073.00 Willdan Contract will be tracked (As it relates to the tennis courts on a T&M basis) and added to the above total. The ARPA work is not covered by the Clean CA grant. Staff will be sure to keep a close eye on the funding and keep Council updated on the amount of funds that will come from ARPA.

There currently is not enough information available to estimate how much time is necessary to design the tennis courts.

FISCAL IMPACT:

Not to exceed $18,710.00 of the $6,930,958 allocated American Rescue Plan Act Funds; for the design and preparation of Construction Plans, Specifications etc. for the Leroy Jackson Park bathroom.

ACTION REQUESTED:

1. Approval of the resolution

2. Allocate an additional $18,710.00 from ARPA Funds to the previously authorized $576,000.00 for the Leroy Jackson Park Improvements.

3. Authorize the Finance Director to amend the budget/ARPA contribution to reflect all appropriate capital, revenue and transfer accounts, and amend a purchase order in the amount of $18,710.00

4. Authorizes the City Manager, Ron Strand, to execute the agreement.

(Change Order - Additional Scope of Work)
Willdan Proposal dated December 15, 2022
December 15, 2022
Mr. Travis Reed, PE
Public Works Director/Deputy City Manager
City of Ridgecrest
100 West California Avenue
Ridgecrest, CA 93555
Subject: Contract Amendment Request No. 1 for Professional Engineering Services for the Leroy Jackson Park Improvements Project, PO #2023-141
Dear Mr. Reed:

Per previous discussions, this letter is to request authorization to modify the budget for our original professional engineering services contract for the City’s Leroy Jackson Park Improvement Project. The City has engaged the services of Willdan Engineering to provide design engineering and construction engineering services for the improvement of Leroy Jackson Park.

Willdan’s original budget of $217,073.00 (PO #2023-141) included the access, amenities, tennis courts, and landscape improvements within the park, funded by Clean California and ARPA Grants. The City desires to add a new public restroom and access from the parking lot on the south end of the park, between the two baseball fields to the scope of this contract. Contract Amendment Request No. 1 would provide additional compensation for the additional design scope of work in the amount of $18,710, resulting in an amended contract amount of $235,783.

The design effort will include coordination with the city to procure the prefabricated restroom and design the necessary grading and pads, with a continuous accessible path from the parking lots to the restroom and accessible walkways to the two existing ball parks. We assume the prefabricated restrooms include the foundation within the footprint of the restroom and Willdan will be responsible for the additional concrete slabs needed, utility connection for stub outs, and all necessary coordination. There will not be any geotechnical investigations performed as part of this additional work. The restroom building improvements will be included in the same plan set and specification book as the rest of the Leroy Jackson Park Improvements (i.e. one construction contract). The bid items related to the restroom building improvements will be included in the same bid schedule as the Tennis Courts resurfacing (ARPA funds).

Based on the aforementioned items, Willdan’s proposed Contract Amendment Request No. 1 provides compensation for the required extended contract engineering services outside of the original scope of work.

Subject: Professional Engineering Services for Leroy Jackson Park in the City of Ridgecrest
Dear Mr. Reed:

Willdan Engineering (Willdan) has been pleased to currently provide engineering services for the above referenced project. For your consideration, Willdan Engineering has prepared the following proposal for the City’s planned improvements to Leroy Jackson Park. Willdan provides a complete range of building and safety staffing, building plan check, code compliance, land development, engineering, planning consulting, construction engineering, and labor compliance services to local agencies – often on an as-needed basis. Willdan has pioneered the extension of staff services in California since our inception.

Project Understanding
Willdan understands that the City would like to improve Leroy Jackson Park with a number of renovations and replacements, including:
 Clean California Grant Funded Improvements
o Repairing and completing an ADA accessible walking path o Installing solar lighting along the walking path
o Xeriscape with native plants and shade trees
o Installing (2) drinking fountains with bottle fillers o Replacing/adding benches with shade structures along the path o Adding waste receptacles with proper labeling
o Installing lighting for tennis courts with timer switch o Adding educational signage (litter abatement and native plants) o Adding a Dial-A-Ride transit stop with shaded seating  ARPA Grant Funded Improvements
o Tennis court resurfacing
The existing Leroy Jackson Park Sports Complex is bounded on the north by Drummond Avenue and on the east by French Avenue. The limits of proposed improvements on the south side will be the existing Skate Park and on the west side will be just beyond the westerly edges of the existing field areas. There will be no improvements made to the existing parking lot, except for changes to the striping, including moving ADA stalls. The existing stalls need to be checked for ADA compliance and if they are not compliant, they need to be restriped at an alternate location that is compliant. The existing park has tennis courts, parking lot, concession/restroom building, pavilion lighting, sidewalks, sports fields, and sports park lighting. There is also existing curbing installed around the proposed walking path. There are some areas of the existing curbing that are damaged and will need repair. There are also some areas where there are gaps in the existing curbing that need to be filled in with new curb. Three of the existing six tennis courts will be resurfaced and the three southerly courts will require a new post-tension slab to be designed. The City of Ridgecrest
August 1, 2022 (Revised August 8, 2022)

three northerly tennis courts are to be striped for pickle ball and tennis courts after the resurfacing is complete.

Topographic survey is only anticipated to be needed for any non-compliant ADA ramps and for the ADA walking path, and all survey data will be provided by the City. The City will be furnishing an aerial survey of the entire site, along with supplemental ground survey for conforms.

The City has State funding (ARPA and Clean California) to construct the proposed project. The State funding is allocated through Caltrans and the grant administration is only anticipated to require project cost accounting and reimbursement invoicing to Caltrans. Separate consultant invoices will be provided for the two grant funding sources. The construction documents will also include separate bid schedules for each funding source.

We appreciate the opportunity to submit our proposal and look forward to discussing the tasks shown below with you.
