STAFF REPORT
SUBJECT: Proposed Approval Of Increased Appropriations To The Fiscal Year 2022-2023 Budget For Building Professional Services
PRESENTED BY: Travis Reed
SUMMARY:

The City of Ridgecrest uses outside consultants for building plan check and inspections services, Kern County Building Inspections and Willdan Engineering. STAFF REPORT
SUBJECT: Resolution Authorizing Submission Of The Fiscal Year 2022-2023 Transportation Development Act Article 4 Claim To The Kern Council Of Governments PRESENTED BY: Cheri Freese, Finance Director
SUMMARY:

The Transportation Development Act (TDA) is a statewide program that added a quarter cent sales tax for the purpose of funding transit needs within local jurisdictions throughout the state. Those funds are distributed to Regional Transportation Planning Agencies (RTPA) who is responsible for the allocation and distribution of the said funds to the local transit systems.

Pursuant to California Government Code Section 29532, the Kern Council of Governments (KernCOG) is the designated regional transportation planning agency for purposes of administering the Act within the Kern County region.

The TDA allows that a certain portion of those funds be retained by the RTPA for administration purposes, and a certain amount may be retained for pedestrian and bicycle transportation improvements. The balance of the funds are available to the local transit systems, with the provision under Article 4 of that Act that if there is money left over after the needs of the local transit systems have been met and unmet transit needs have been addressed, the remaining funds shall be distributed to the City and County for road maintenance purposes under an established formula.

The approval of this item will allow the Finance Director to submit the attached claim to the KernCOG.

FISCAL IMPACT:
$2,003,724 in revenue will be received by the City of Ridgecrest to fund transit operations.

ACTION REQUESTED: Approve the attached resolution.

STAFF REPORT
SUBJECT: A Resolution Of The Ridgecrest City Council To Appropriate A Portion Of The American Rescue Plan Act Funds To Add A Bathroom/Concession Building At The Leroy Jackson Sports Complex Softball Fields
PRESENTED BY: Nerissa Wegener, Parks and Recreation Director SUMMARY:

On March 11, 2021, President Biden signed into law the American Rescue Plan Act (ARPA), which provides one-time fiscal relief funds to State and Local Governments and other program areas aimed at mitigating the continuing effects of the COVID-19 Pandemic. ARPA includes State and Local Fiscal Recovery Funds to support urgent COVID response efforts to decrease the spread of the virus and to replace lost public sector revenue to strengthen support for vital public services. The City of Ridgecrest’s allocation of direct local stimulus is $6,930,958, with the first 50% paid to the City in July of 2021 and the remaining balance in July of 2022.

The United States Treasury has adopted the SLFRF final rule, along with a list of Frequently Asked Questions, as guidance regarding the use of ARPA funds. The allowed uses of ARPA funding focus on four key program areas: to respond to the public health emergency or its negative economic impacts, including assistance to households, small businesses, and nonprofits, or aid to impacted industries such as tourism, travel, and hospitality; to respond to workers performing essential work during COVID-19; for the provision of government service to the extent of the reduction in revenue due to COVID-19; and to make necessary investments in water, sewer or broadband infrastructure. The use of ARPA funds is retroactive to March 3, 2021. All funds must be obligated by December 31, 2024, and must be spent by December 31, 2026.

The City staff brought to council during a workshop on November 17, 2021 a list of recommended projects for the use of appropriations. These projects were discussed with council, community members as well as City staff.

Recommendations for Appropriations at the time:

The Leroy Jackson Sports Complex softball fields are rented 9 months out of the year by various softball organizations such as IWV Youth Softball, Kaos Travel Softball, Immanuel Christian School, Burroughs High School, RACVB, DART and the Adult Softball League.

These organizations use the fields for practices, games and tournaments and serve well over 400 families during these rentals. Adding a bathroom to this area has been a consistent request by all organizations prior to and during the most recent ARPA project discussions.

The groups state that there is a major safety concern with not having a restroom easily accessible when they are playing. This concern stems from the varying ages of the children playing, how far they have to travel to use a restroom, and the fact the travel path is unlighted.

STAFF REPORT
The Parks and Recreation Department is requesting $971,750 in American Rescue Plan Act funds to install a bathroom/concession building at the Leroy Jackson Youth Sports Complex softball fields, this includes a 15% contingency for any unforeseen during the project.

1. Authorize the allocation of $971,750 in the American Rescue Plan Act funds for installation of bathroom/concession building at the Leroy Jackson Youth Sports Complex softball fields

2. Authorize the City Manager to sign project agreements.

This project will be completed using the cities purchasing policy and will be put out to BID.

This Project was brought back to the Quality of Life Committee during several meetings for discussion, the committee recommended moving this project forward for council approval.

Willdan has been hired to provide design services for this project but staff wanted to wait to bring the project to council for an approved funding amount to be able to bring forward a more accurate budgeting number.

Staff is requesting that City Council approve this ARPA project and authorizes Finance Director to allocate the funds from the ARPA allocation and allow City Manager Ron Strand to sign the contract.

ARPA Justification: FAQ 4.2: “Under (603)(c)(1)(C), recipients may use funds for maintenance of infrastructure or pay-go spending for building of new infrastructure as part of the general provision of government services, to the extent of the estimated reduction in revenue due to the public health emergency.”
FISCAL IMPACT:
$971,750 of the $6,930,958 allocated American Rescue Plan Act Funds that includes a project contingency.

STAFF REPORT
SUBJECT: A Resolution Of The City Of Ridgecrest, California, Adopting The 2023 Sewer System Management Plan Update; The Fats, Oils & Grease Best Management Practices Manual; & The Overflow Emergency Response Plan
PRESENTED BY: Travis Reed, Public Works Director/Deputy City Manager SUMMARY: The State Water Resources Control Board (SWRCB) adopted statewide General Waste Discharge Requirements (GWDR) for publicly owned sanitary sewer systems in 2006. The GWDR required the development and implementation of a system-specific local “Sewer System Management Plan” (SSMP) that articulates a comprehensive program for sewer system operation, maintenance, repair and reporting of all Sanitary Sewer Overflows (SSOs) in the statewide spill-reporting database. The City is required to comply with these requirements. The SSMP is an effective tool for the on-going management of the City’s wastewater collection system and preventing SSOs.

The City Council adopted the City’s original SSMP on October 21, 2009 (Resolution No. 09-64) and the State Required a five-year update on October 21, 2014.

The SSMP shall undergo an internal audit at a minimum of every two years and requires approval by Council every five years, or when an audit identifies a major change is needed.

The 2023 SSMP, FOG BMP, & OERP attached here to, were completed by City Staff MKN & Associates and now requires Council approval.

The following revisions are proposed as part of the 2023 SSMP:
• Updated City staff contact information and responsibility matrix • Updated the list of outside agency contact names and telephone numbers • Updated the sewage spill notification procedures
• Updated the assessment and performance metrics
• Updated the historical summary of sanitary sewer system overflows • Updated the FOG dischargers summary, addition of the BMP Manual • Updated and added the Overflow Emergency Response Plan • Updated Code Section References
• Updated the vehicle equipment inventory
• Updated the quarterly wastewater collections hot spot cleaning schedule • Made edits to make the document easier to read
The SSMP, FOG BMP, OERP update has been drafted to comply with the State Water Resources Control Board Order updating and filing the SSMP is self-enforced; therefore, the City maintains all records related to updating the SSMP and its adoption by the City Council.

STAFF REPORT
A copy must be immediately available to regulatory agencies upon request and must be publicly available. City staff must self-audit the SSMP annually for the first two years following adoption and biennially thereafter. These three (3) documents are quite lengthy and therefore not printed with the agenda packet. If you would like a copy please contact either the City Clerk or the Public Works Analyst.

FISCAL IMPACT: $0, following state guidelines and adopting said management plans.

CITY COUNCIL AGENDA ITEM
SUBJECT: Introduction And First Reading Of An Ordinance Of The Ridgecrest City Council Amending The Ridgecrest Municipal Code Concerning An Extension Of Tentative Parcel Maps & Tentative Tract Maps
PRESENTED BY: Heather Spurlock, City Planner
BACKGROUND:

The Ridgecrest Municipal Code currently allows for the approval of a tentative parcel map for 24 months and an extension for 12 months. If a final map is not submitted within that time frame, the map is considered abandoned.

The Ridgecrest Municipal Code currently permits the approval of tentative tract maps for 36 months. Extensions of tentative tract maps are allowable in 12 month increments not to exceed a total of 36 months.

The Subdivision Map Act (§66452.6 & 66463.5) authorizes the Planning Commission to approve, or conditionally approve, extensions of tentative parcel maps and tentative tract maps for a period not to exceed six years.

Staff is requesting that City Council amend the municipal code to reflect current regulations in the Subdivision Map Act. The tentative map process is time-consuming and costly for applicants. A subdivision could take from 12 to 18 months for design and approval. During the tentative map design and approval process the market can fluctuate and make projects unprofitable. The natural fluctuation of real estate markets makes tentative map extensions critical to the development of a healthy housing market.

Many of the tentative maps that have been approved for housing development will expire this year.

If this amendment is not approved the city will currently have three tentative tract maps with a total 149 single family residential units that expire in September of 2024, and three additional tentative tract maps that expire in January of 2024.

The following is the Ridgecrest Municipal Code sections in part including the amendments and removal. The added language is underlined and the removed is strikethrough.

Tentative Tract Maps
Sec. 105-60. - Planning commission action.
(a) The planning commission shall hold a public hearing to consider the tentative map within 50 working days following the date of its filing, and shall determine whether the tentative map is in conformity with the provisions of law and this chapter and upon that basis shall approve, conditionally approve, or disapprove the tentative map. (b) Notice shall be published in a newspaper of general circulation in the community not less than nor more than 15 days before the date set for the commission hearing. The notice shall contain all data pertinent to the hearing.
