After consultation with the City manager and the Finance Director, approximately $750,000 has been added back in to date. Some of these are unforeseen changes at the time of bidding and others are deleted items as mentioned above.

Staff is seeking council approval of $750,000 to be added back to the project to cover work completed through June 2nd.

Staff has more items to add, and is currently working through the process of adding the streets which were pulled out at award of contract.

Please note, this is not a final reconciliation of this project, additional work is still underway and with council blessing staff would like to add additional work to the scope.

STAFF REPORT
SUBJECT: A Resolution Of The City Of Ridgecrest Approving Contract Change Orders Number One And Two; And Quantity Adjustments Through June 20th, 2023 In The Amount Of $775,000.00 With The Contractor Everlevel Holdings. Said Adjustments Are For Time And Material Work, Contract Additions; And Work Added To Facilitate A Complete Project; And Authorize The City Manager, To Sign Said Change Orders
PRESENTED BY: Travis Reed, Public Works Director
SUMMARY: West Ward Ave Sewer work saw many unforeseen changes. This can be expected when it comes to repairs on lines that were installed in the late 50’s and early 60’s.

With the abundance of items we ran into staff felt it prudent to run this on force account as we did not have a bid item that would cover much of the work necessary. Many of these man holes had over poured bases, external drop inlets that were not shown on the plans, connections to old abandoned pump stations etc.

With these conditions staff and Willdan worked Diligently to get the time and materials cost to a reasonable cost for the work performed.

If anyone wishes to see the 100+ pages of documentation please feel free to visit my office.

Staff is requesting the approval of the force account (Change Order work) and quantity adjustments to date. Subsequent to this staff will complete the project and have a balancing change order for deducts and additions which will come at the acceptance of the project.

FISCAL IMPACT:

A Project Budget increase in the amount of $775,000.00 to be allocated from the Waste Water Enterprise Fund.

RE: 2023 Congestion Mitigation Air Quality (CMAQ) Program and/or Carbon Reduction Program (CRP), Call for Projects
Dear Raquel:

As per the CMAQ/CRP call for projects, the City of Ridgecrest is requesting that $456,726.26 in federal funds be programmed in the 2024/2025 fiscal year for Construction/Procurement. Said dollars shall be used for the procurement/replacement of two (2) Ford F550 Cutaway Buses with Ford Electric Vans for the City of Ridgecrest Transit Fleet. This project will bring the City in close alignment with the 2022 Transit Management Plan and will be a great benefit to the City of Ridgecrest residents.

This project is critical for the City of Ridgecrest so it can utilize the currently under construction Solar and Charging Infrastructure scheduled for completion in June of 2024. It is also critical that this infrastructure be utilized so the City can avoid costly fines as it relates to power usage per our SCE power upgrade agreement.

If you have any questions please do not hesitate to call me at (760) 499-5081.

Project Description
Replacement of two of 29’ cutaway bus’s with battery electric transit passenger vans (Ford 350 EL w/ Lightning Electric Drivetrain). Said van’s will have 8/1 ADA seating. New vehicles will be capable of accepting a level 2 or DC fast charger. The vans have a 120-mile range, and are a 148-inch wheelbase making them easier to maneuver and driver friendly. The vans are in-line with current ridership levels and passenger needs.

The new vehicles will be replacing two larger, gas guzzling, carbon-producing vehicles. Both cutaway buses have exceeded their useful life benchmark in years and mileage. The existing buses being replaced are 2012 Ford F550 cutaways. They were due for replacement over four years ago and a minimum of 20,000 miles prior.

Project History
The Innovative Clean Transit act passed in 2018. This requires that transit services begin transitioning to zero emission vehicles beginning in 2026 and being fully transitioned by 2040. With the recent California initiative known as Advanced Clean Cars II, the City expects transit fleets to have to be fully electric prior to the 2040 deadline. Vehicles purchased prior to the 2026 milestone will be counted towards required zero emission purchasing ratios.

In 2018, the City of Ridgecrest began to program grant funds from the Low Carbon Transit Operations Program (LCTOP) and State of Good Repair Program (SGR) to building solar powered electric vehicle charging infrastructure located at the City of Ridgecrest Corporation yard (626 W. Ridgecrest Blvd.).

In 2019, the City of Ridgecrest began to program additional LCTOP funds to purchase its first battery electric bus and continued to program State of Good Repair funds for the charging infrastructure. (This purchase required future year grant funding as evident below). Additionally, the City of Ridgecrest applied for funds to complete the solar powered, electric charging infrastructure through the Congestion Mitigation Air Quality (CMAQ) program.

In 2020 the City of Ridgecrest was awarded the CMAQ project funds and continued to use LCTOP funds to facilitate purchase of the first battery electric bus. Additionally, the City of Ridgecrest began to program its SGR funds to help purchase the battery electric bus. The above mentioned CMAQ project has seen numerous supply issues, and is currently under construction. The estimated completion date for this project is June 30th 2024, as electrical components are back ordered through January of 2023.

In 2021 the City of Ridgecrest reprogrammed existing Public Transportation Modernization, Improvement and Service Enhancement Account (PTMISEA) funds towards the purchase of the battery electric van. The City of Ridgecrest also began to program new LCTOP and SGR funds towards the purchase of a second battery electric van.

In 2022 the City of Ridgecrest placed an order for the first battery electric van from A to Z Bus Sales. In addition, the City of Ridgecrest continued to program LCTOP funds and SGR funds towards purchase of the second battery electric van.

Thereafter, the City collaborated with HCD and received an Affordable Housing & Sustainable Communities (AHSC) grant. The grant application possessed two (2) electric vans for City Transit use.

Upon further review, staff noticed that during underwriting the grant was funded without these vans included. Despite numerous staff efforts, HCD reiterated there was nothing we could do to have these added back to the grant. This delayed the replacement of vehicles in accordance with the City of Ridgecrest Transit Management Plan (TAM).

With all the new charging infrastructure, (current CMAQ Project), and the Transit infrastructure improvements within the AHSC grant;
Including but not limited to:

1. Three Transit Bus shelter Hubs

2. ADA Improvements at numerous shelter locations

3. Ridership passes for the currently under construction (90% complete) 72 unit Affordable Housing Development
As you can see, it is imperative that we transition to electric vehicles now, and get on track with our TAM. Additionally, with the electrical upgrades SCE required to facilitate the CMAQ project the City of Ridgecrest has to meet or exceed a certain power usage requirement to help offset the cost of the SCE infrastructure improvements. The only way the City will be capable of meeting these power usage requirements is with the procurement of these two vehicles. Otherwise, the City could face significant monthly penalties.

RE: 2023 Regional Surface Transportation Program, (RSTP), and Highway Infrastructure Program, (HIP), Call for Projects
Dear Raquel:

As per of the RSTP and HIP call for projects, the City of Ridgecrest is requesting that $99,982.15 in federal funds be programmed in the 2024/2025 fiscal year for Preliminary Engineering, and $1,571,148.11 in federal funds be programmed in the 2024/2025 fiscal year for Construction. Said dollars shall be used for the resurfacing, drainage and intersection improvements of South Mahan Street from W. Bwman Rd. to S. Dolphin Ave. in the City of Ridgecrest. This project will bring the roadway surface, drainage and intersection efficiency and ride quality up to an acceptable and safe level of service and will be a great benefit to the City of Ridgecrest residents.

With this it will require partnering with Kern County to allow for an additional 10’ of Right of Way to be utilized on the west side of the project, as the City County line runs down the Center line of Mahan St. If this becomes a problem in any way we will proceed with the project on just the City Side or East side of the project.

With the additional 10’ this will allow for two full lane widths of traffic and a 12’ foot bike/parking lane and will increase the safety of the roadway. Under current conditions, only one lane of traffic can be accommodated and we routinely see traffic driving in unimproved areas to avoid a collision. This area has seen numerous accidents including a fatality and is in drastic need of improvement.

If you have any questions please do not hesitate to call me at (760) 499-5081.

PROJECT APPLICATION
Project Justification: West Ward Avenue is one of the principal North/South major collectors/secondary arterial corridors in the City of Ridgecrest. It directly serves access to the China Lake Naval Air Weapons Research facility, Ridgecrest Regional Hospital, numerous residential neighborhoods and other businesses for local residents. It directly connects to the two central business corridors of China Lake Blvd. ( U.S. 395 Business aka. SR 178), West Bowman Rd. and West Dolphin Ave. and numerous collector streets. The proposed segment of this project would reconstruct the paving surface, improve drainage, improve ride quality and add much needed street parking and bike right of way.

The project length of this segment is approximately ½ mile. The street surface is currently in a declining condition, as it is an old oil sand and cold mix application street. The surface is weathered, and not of suitable width to facilitate, two way traffic. It possesses an average Pavement Condition Index of 28 per the 2022 Ridgecrest Crack Mapping project, which updated our 2020 PMS. The Pavement Condition Index of 28 ranks the condition as Poor, there are multiple potholes, failing patches, crack repairs and utility patches within the reach. There are numerous unimproved portions, which pose a severe risk to pedestrians, bicycles and residents. There are also drainage and ride quality issues along the entire reach.

Reconstructing the roadway, drainage and intersection ride quality will bring it up to an acceptable level of service with a long project life, drainage capacity and safe driving quality. The project will complement the recently improved Franklin Ave. project with new thermoplastic striping, street markings, street legends, drainage improvements and ride quality. Additionally, safety and timely clearing of traffic will be improved by providing a smooth and even roadway surface through the intersections for bicycles, motorcycles, cars and trucks with improved drainage, ride quality and new roadway striping for increased visibility.

This street is in dire need of reconstruction and we have even had a fatality within this segment of roadway. As you will see from the pictures attached, this street is a prime candidate for the RSTP program.

STAFF REPORT
SUBJECT: A Resolution To Amend A Professional Services Agreement With Willdan Engineering Inc. In The Amount Of $17,262.00 To Include The Repair Of Existing Concrete, Traffic Loop And Asphalt Improvements In The Capital Improvement Plan (CIP) Phase II Project And The Engineers Report
PRESENTED BY: Travis Reed, Public Works Director
SUMMARY:

The City of Ridgecrest previously entered into an agreement with Willdan Engineering Inc. to provide Design Engineering Services for the Phase II Sewer Project, and a detailed engineering report. The previous scope of work was as follows: Design a multi-year Capital Improvement Plan (CIP) update for replacing/repairing all remaining Grade 4 and 5 class defects in the sewer collections mains and trunks, corresponding rehabilitation of the connecting manholes to accomplish repairs to the sewer trunks in China Lake Boulevard between Argus and California Avenue, and in California Avenue between China Lake Boulevard and Richmond Avenue. The specific project included inspection/evaluation of about 8,500 feet of existing sewer pipe and the corresponding 29 manholes, asset assessment, defining the best repair approach for the condition identified, estimating of probable construction costs, scheduling of construction projects, and preparing an updated engineering report.

Thereafter the City and Willdan amended the agreement to include the analysis of class 3 defects for the Phase II project, as well as the CIP update and the engineers report. Willdan prepared revised preliminary estimate for the City of Ridgecrest’s review and approval, prior to the changes, revise plans and estimates as necessary; and revise the engineers report and update the multi-year CIP program.

With the acceptance of this proposal, this will include the additional work required to facilitate concrete, asphalt and traffic loop repair within the Caltrans Right of Way. After lots of consulting with Caltrans the location of the sewer line and Caltrans, standards facilitated a significant change in scoop. Additional asphalt paving was required together with replacement of all loops, which will most certainly be damaged during construction. With a deeper look staff noticed that the machinery required to make these repairs would most certainly require the replacement of existing curb gutter and sidewalk along state route 178.

With this knowledge, and time of the essence staff directed Willdan to proceed with these changes.

Willdan prepared the required plans and documented their time. The additional cost necessary is a fixed fee as all work for design is complete. The design effort was significant, since the original repair was a typical trench patch and no concrete was to be disturbed.

AMENDMENT NO. 2 TO CONSULTANT AGREEMENT
WILLDAN – PHASE II SEWER
This Amendment No. 2 to the Consultant Agreement ("Amendment No. 2") is entered into as of July 10, 2023 ("Effective Date"), by and between the City of Ridgecrest, a municipal corporation ("City"), and Willdan Engineering, a California corporation (“Willdan”). City and Willdan are sometimes hereinafter referred to individually as a "Party" and collectively as the "Parties."

RECITALS
A. Pursuant to Resolution 20-48, on January 7, 2021, City and Willdan entered into a Consultant Agreement for Professional and Engineering Services to provide design for the multi-year Capital Improvement Plan (CIP) update for replacing/repairing all remaining Grade 4 and 5 class defects in the sewer collection mains and trunks, and corresponding rehabilitation of the connecting manholes for the trunk sewer. (“Master Agreement”). The Master Agreement” and Amendment No. 1 which is attached hereto as Attachment “B”. Phase II Sewer Line Rehabilitation encompasses China Lake Boulevard between Argus and California Avenue, and in California Avenue between China Lake Boulevard and Richmond Avenue, and various point repairs in the City of Ridgecrest. After the first draft of plans were submitted, the City found it necessary to change direction and alter the scope of work to include Grade 3 defects and change rehabilitation methods to a complete replacement if we had more than four (4) point repairs between existing manholes, said work was encompassed in Amendment 1.

Thereafter with the location of the sewer line adjacent to the existing Curb and Gutter on China Lake Blvd, approx. 4’ west, staff requested the addition of additional concrete repairs along China Lake Boulevard to cover potential damages to them through the construction phase. In addition, traffic loops were added to the project due to the Caltrans required paving and crossings were added that were not included in the original as-builts.

Contract Amendment Request No. 2 would provide additional compensation for the extended scope in the amount of $17,262.00. With this Willdan has prepared a cost differential for the additional work as apparent in Attachment “A” B. Section 20 (Integration) of the Master Agreement, states that the agreement “may not be modified or altered except in writing, signed by both parties”.

C. As commenced, the City has requested Willdan to submit a Change Order proposal to detail the additional requested work. The Change Order is attached hereto as Attachment “A”.

D. The Parties now desire to amend the Master Agreement to provide for certain professional and engineering consulting services related to design services including additional concrete, traffic loop, and asphalt repairs in the CIP project and the engineers report. Capitalized terms not otherwise defined herein shall have the meanings assigned to them in the Master Agreement.

A G R E E M E N T
NOW, THEREFORE, in consideration of the foregoing Recitals and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, City and Willdan hereby agree to amend the Master Agreement by this Amendment No. 2 as follows:

1. Additional Design Services. Subject to the terms and conditions of this Amendment No. 2, Willdan will or has provided through its professionals, the necessary professional and engineering services, as indicated by the tasks enumerated in Attachment “A” to this Amendment No. 2 consistent with applicable laws and good industry practices. For purposes of this Amendment No. 2, the aforementioned scope of additional services and tasks for design services as indicated in Attachment A shall hereinafter be referred to generally by the capitalized term “Work”. Work shall only be authorized and commenced for specific tasks and projects as provided for in Section 2(c) of the Master Agreement.

2. Consideration for Additional Services. The Section 3 of the Master Agreement shall be amended to increase the original not to exceed amended sum of $169,065.00 by $17,262.00 for a new total not to exceed sum, unless future written authorization is given of $186,327.00. The Scope of Services, additional tasks, and their respective funding allocations shall be amended as indicated in Attachment A.

3. Miscellaneous.
(a) Effect of Amendment. The term "Agreement" when used in this Amendment No. 2 or the Master Agreement shall mean the Master Agreement as amended, modified, and supplemented by this Amendment No. 2 unless the context would require otherwise. Except to the extent the Master Agreement is modified by this Amendment No. 2, the remaining terms and conditions of the Master Agreement shall remain unmodified and in full force and effect. In the event of conflict, between the terms and conditions of the Master Agreement and the terms and conditions of this Amendment No. 2, the terms and conditions of this Amendment No. 2 shall prevail and control. (b) Entire Agreement. The Master Agreement, together with this Amendment No.2, embodies the entire understanding between City and Willdan with respect to its subject matter and can be changed only by an instrument in writing signed by City and Willdan.
(c) Headings. Headings in this Amendment No. 2 are for convenience of reference only.
(d) Counterparts. This Amendment No. 2 may be executed in one or more counterparts, including facsimile counterparts or electronic-mail counterparts, each of which shall be deemed an original but all of which, taken together, shall constitute one in the same Amendment No. 2.

IN WITNESS WHEREOF, this Amendment No. 2 has been executed as of the day and year first set forth above.

Per previous discussions, this letter is to request authorization to modify the budget for our original design engineering services contract for the City’s Multi-Year Sewer Repair and Replacement Program and Phase Two Sewer Line Rehabilitation, Repair or Replacement Project. The City has engaged the services of Willdan Engineering to provide design engineering services, for the multi-year Capital Improvement Plan (CIP) update for replacing/repairing all remaining Grade 4 and 5 class defects in the sewer collection mains and trunks, and corresponding rehabilitation of the connecting manholes for the trunk sewer.

Willdan’s original budget of $154,487.00 (PO #21-302) included the design for grade 4 and grade 5 class defects.

The Contract Amendment Request No. 1 included analyzing and including Class 3 Defects in the CIP project and the engineer’s Report. The revised amended contract amount is $166,065. The city requested we add additional concrete repairs along China Lake Boulevard to cover potential damages to them through the construction phase.

In addition, traffic loops were added to the project due to the Caltrans required paving and crossings were added that were not included in the original as-builts. Contract Amendment Request No. 2 would provide additional compensation for the extended scope in the amount of $17,262, making our current amended contract amount $183,327
The design effort was significant as the full plans, specifications and estimates had to be revised with the addition of concrete repairs, traffic loops, and utility crossings. A new sheet and detail sheet had to be generated to add traffic loops to the documents to get approval for the work to be completed within Caltrans Right-of-way.

Based on the aforementioned items, Willdan’s Contract Amendment Request No. 2 provides compensation for the required extended contract engineering services outside of the original scope of work.

STAFF REPORT
SUBJECT: A Resolution To Amend A Professional Services Agreement With Willdan Engineering Inc. In The Amount Of $105,000.00 For The West Ward Phase I Improvement Project To Include Addition Force Account Inspection Services And Project Subconsultant Services
PRESENTED BY: Travis Reed, Public Works Director
SUMMARY:

The City of Ridgecrest previously entered into an agreement with Willdan Engineering Inc. to provide Professional Services for the Phase I West Ward Ave. Improvement Project.

Said project is a federally funded Regional Surface Transportation Project (RSTP). The previous scope of work included all the typical Items in a PS&E package including Bidding assistance.

With the acceptance of this Amendment No 2 the City will be effectively utilizing all the available funds that were allocated for our CE phase of the project. As the project progressed and the scope was amended, staff found it necessary to alter the contract to facilitate the completion of all the sewer work prior to paving.

During this project we ran into numerous issues with man holes and main line that were constructed in the late 50’s and early 60’s. Items included in this were over poured bases, cave in’s and exterior drop inlets not indicated on construction as-builts. With the addition of work, and no bid item to complete the work staff felt it necessary to complete said work on force account (time and material) so it was fair to all parties involved.

By doing this this increased the contract working time 40+ days. With any increase in time to a project there is an increase in time for inspection and sub consultants such as twinning for materials testing. Said work equated to an estimated $105,000 worth of extra work.

The fee for the project amendment is $105,000.00. City Council previously authorized a Professional Services agreement in the amount of $132,535.00 via. Resolution 2020-11 and 22-40. The new amended total, if approved shall be $237,535.00. The fee will be funded with Wastewater Enterprise funds, and staff feels it is a very fair price for the work which was necessary.

Staff recommends that the City Council approves the amended agreement and authorizes the City Manager, Ron Strand, to execute the amended agreement with Willdan Engineering Inc. Which will bring the total portion of Work Funded for CE services to $237,535.00, of this $66,206 shall be covered by RSTP funds. These funds were only for the street improvement work, as the sewer infrastructure work was added as non-participatory work.

Willdan Engineering
Ward Phase 1 – Additional CE Services for Sewer Force Account Work AMENDMENT NO. 2 TO CONSULTANT AGREEMENT
WILLDAN – WEST WARD AVE. PHASE I, CE

RECITALS
A. Pursuant to Resolution 20-40, on June 1, 2022, and PO 20-317, City and Willdan entered into a Consultant Agreement for Professional and Engineering Services to provide Construction Engineering Services for the RSTP funded Ward Ave. Phase I improvement project. (“Master Agreement”). The Master Agreement” which is attached hereto as Attachment “B”. Phase I of West Ward Ave Improvements encompasses West Ward Ave. from China Lake Boulevard to Norma St. in the City of Ridgecrest.

With the increase to the work on the project due to unforeseen changes in regards to the sewer work additional inspection time was necessary. Work of this nature requires continuous inspection and with the increase of contract days (40 days +/-) comes an increase in inspection services and subcontractors such as Twinning for compaction. The additional effort required to facilitate inspection services and quality control is approximately 40 working days. This cost is based on the total contract time that was added for the force account work which was complete by Everlevel Holdings and inspected by Willdan staff on behalf of the City. For this additional work, Willdan has provided a preliminary cost estimate (verbal) to cover overages as it relates to the sewer infrastructure work. Attachment “A” outlines said work. The cost differential for all subs and inspection is estimated to be $105,000.00, or $2,625.00 per day, with the majority of this for subcontractors required to meet grant guidelines. None of this work is covered under our grant, as all sewer related work is non-participatory per the grant guidelines.

B. Section 20 (Integration) of the Master Agreement, states that the agreement “may not be modified or altered except in writing, signed by both parties”.

C. As commenced, the City has requested Willdan to submit a Change Order proposal, which was verbally responded to the Public Works Director, this conversation detailed the additional requested work.

D. The Parties now desire to amend the Master Agreement to provide for certain professional and engineering consulting services related to and already completed items necessary to keep the West Ward Ave. Improvement Project progressing.

Capitalized terms not otherwise defined herein shall have the meanings assigned to them in the Master Agreement.

Ridgecrest, CA 93555
Subject: Contract Amendment Request No. 1 for Professional Engineering Services for the West Ward Phase 2 (Norma to Downs), PO #2022-0115
Dear Mr. Reed:

Per previous discussions, this letter is to request authorization to modify the budget for our original design engineering services contract for the City’s West Ward Ave Phase 2 (Norma to Downs St) project. The City has engaged the services of Willdan Engineering to provide design engineering services, for the design of street improvements on West Ward Ave including PCC repairs, pavement rehabilitation, regrading of Norma Ave at West Ward Ave intersection, etc.

Willdan’s original budget of $53,947.26 (PO #2022-0115) included the design of the streets. The city requested we get additional survey of the street to complete regrading of the intersection of Sierra View and West Ward Ave.

In addition, the city has requested we reconstruct the bubblers and inlets through the limits of the streets. Each of the bubblers will have their own plan and profile for their reconstruction, per request.

The design effort is significant as the full plans, specifications and estimates have to be revised to add the additional work. A new sheet and detail sheet will have to be generated to properly convey the design of the bubblers and inlets.

Based on the aforementioned items, Willdan’s Contract Amendment Request No. 1 provides compensation for the required extended contract engineering services outside of the original scope of work.
