SUBJECT: Authorization For The City Manager To Execute The Notice Of Completion For Measure V FY22 Street Rehabilitation Project, City Project No. ST2202; For The City Clerk To File The Notice Of Completion And City Staff To Release Retention In The Amount Of Three Hundred And Seventy Thousand Two Hundred And Nine Dollars And Thirty-Two Cents ($370,209.32) To Griffith Construction Thirty (30) Days After Recordation
PRESENTED BY: Travis Reed, Public Work Director
SUMMARY: The Contractor, Griffith Construction has finished the project that consisted of street and intersection re-construction and maintenance for the Measure V FY 22 Street Rehabilitation Project, City Project No. ST2202 (Various Streets Project). The project accounting is as follows:

The original contract amount $4,611,445.15
Change Orders and Quantity Adjustments $2,792,741.26
Revised Total Contract Amount: $7,404,186.41
Project Percent Overage: 60.56%
As council will recall, this contract was utilized for emergency repairs for Downs St and Bowman Rd.

Last winter we had an irrigation line which ruptured causing a big portion of Downs St. to fail. The project overage can be attributed to the addition of work. Council also authorized the addition of the streets which we removed at the time of award. This contributed to the 61% increase in contract values.

With the work being completed and, with the exception of retention in the amount of $370,209.32; the Contractor, Griffith Construction has been paid in full.

City Staff will authorize release of retention thirty (30) days from the filing of the Notice of Completion as long as no claims have been filed against the retained funds and the City of Ridgecrest has accepted all work.

FISCAL IMPACT: The retention amount $370,209.32 is within the revised contract no additional funding is necessary.

STAFF REPORT
SUBJECT: Resolution Authorizing Submission Of The Fiscal Year 2024-2025 Transportation Development Act Article 4 Claim To The Kern Council Of Governments PRESENTED BY: Kelly Brewton, Finance Director
SUMMARY:

The Transportation Development Act is a statewide program that added a quarter cent sales tax for the purpose of funding transit needs within local jurisdictions throughout the state.

Those funds are distributed to regional transportation planning agencies (RTPA) who is responsible for the allocation and distribution of the said funds to the local transit systems.

Pursuant to California Government Code Section 29532, the Kern Council of Governments (Kern COG) is the designated regional transportation planning agency for purposes of administering the Act within the Kern County region. TDA allows that a certain portion of those funds be retained by the RTPA for administration purposes, and a certain amount may be retained for pedestrian and bicycle transportation improvements. The balance of the funds are available to the local transit systems, with the provision under Article 4 of that Act that if there is money left over after the needs of the local transit systems have been met and unmet transit needs have been addressed, the remaining funds shall be distributed to the City and County for road maintenance purposes under an established formula.

The approval of this item will allow the Finance Director to submit the attached claim to the Kern COG.

FISCAL IMPACT: $951,735 in revenue will be received by the City of Ridgecrest to fund transit operations.

ACTION REQUESTED: Approve the attached resolution.

8. Statement of Justification - The City typically makes a general fund transfer to the transit division to cover fare

12. Statement of justification - The City has an adopted budget that has merit increases based on performance and years of service. The steps follow, depending on the point you are at within the salary schedule, either a 5% step or a 2.5% step. As many memebers of the Transit organization are not yet "topped out" you will see normal merit increses year over year for administrative and technical staff. Furthermore, the transit division is currently in process of reorganization, thus more time for the Finance Director and the Public Works Director will be charged to the department. The proposed changes will reduce the overall cost to the division do to a reduction in force but will increase year over year as each position and pupil grow in their role. One could expect to see roughly 5%-10% of the Finacne Director and Public Works DIrectors salary be transfered to the Transit division as Kern Council of Governments

STAFF REPORT
SUBJECT: A Resolution Of The Ridgecrest City Council Authorizing The Execution Of The Certifications, Assurances, And Authorized Agent Forms For The Low Carbon Transit Operations Program (LCTOP) Project; Rollover Of Funds For A Future Date Zero-Emission Battery-Electric Van Replacement Purchase, For Fiscal Year 2024-2025, In An Amount Not To Exceed $75,124.00 PRESENTED BY: Sergio Covarrubias, Transit Division
SUMMARY: The Low Carbon Transit Operations Program (LCTOP) is one of several programs that are part of the Transit, Affordable Housing and Sustainable Communities Program established by the California Legislature in 2014 by Senate Bill 862.

The LCTOP was created to provide operating and capital assistance for transit agencies to reduce greenhouse gas emission and improve mobility, with a priority on serving disadvantaged communities.

Approved projects in the LCTOP will support new or expanded bus or rail services, expand intermodal transit facilities, and may include equipment acquisition, fueling, maintenance and other costs to operate those services or facilities with each project reducing greenhouse gas emissions. For agencies whose service area includes disadvantaged communities, at least 50 percent of the total moneys received shall be expended on projects that will benefit disadvantaged communities. Senate Bill 862 continuously appropriates five percent of the annual auction proceeds in the Greenhouse Gas Reduction Fund (Fund) for LCTOP, beginning in 2015-2016.

LCTOP is administered by the California Department of Transportation (Caltrans) in coordination with the Air Resources Board (ARB) and the State Controller’s Office (SCO). It is the responsibility of Kern Council of Governments to apportion these funds to the transit agencies under its purview. For Fiscal Year 24-25, the City of Ridgecrest Transit division has been allocated $75,124. These funds are eligible to be rolled over to be used in conjunction with future funds for a period of up to 4 years. There is no local match required for this program.

It is the recommendation of staff that these funds be used to for a future purchase of a battery powered electric van capable of fulfilling department needs for 2024-2025 fiscal year. Staff plans to roll these funds for three (3) more years. The estimated total funds that will be available is $300,000.00. This will significantly reduce the hit to the Transit budget in FY28 when we plan to purchase said vehicle. The Transit fund contribution in FY 28 for this project is expected to be no more than $175,000.00 FISCAL IMPACT: $0.00 - Grant funding to cover passenger fares.

ACTION REQUESTED:

1. Agrees to comply with all conditions and requirements set forth in the Certification and Assurances and the Authorized Agent documents and applicable statutes, regulations and guidelines for all LCTOP funded transit projects.

2. Authorizes Ron Strand, City Manager, to execute all required documents of the LCTOP program and any Amendments thereto with the California Department of Transportation.

STAFF REPORT
SUBJECT: A Resolution To Amend A Professional Services Agreement With Willdan Engineering Inc. In The Amount Of $32,450.00 For The Mahan St. Improvement Project The Addition Of A Grant Required Archeological Study
PRESENTED BY: Travis Reed, Public Works Director
SUMMARY: The City of Ridgecrest previously entered into an agreement with Willdan Engineering Inc. to provide Professional Services for the Mahan St. Improvement Project. Said project is a Measure V match funded Regional Surface Transportation Program Project (RSTP) having state project number STPL 5385(077). The previous scope of work included all the typical Items in a Preliminary Engineering package including project oversite, preparation of right-of-way package, utility notices, plans preparation, specification preparation, cost estimates and bidding services.

The original project estimates do not account for an unanticipated archeological study. With the amount of staff changeover in Caltrans District 9, the previous relationships staff had fostered need to be rebuilt. With new staff comes new challenges. Current Caltrans staff is not as familiar with our area, and with the presence of potential Native American Artifacts in our area and a lack of previous archeological/historic studies Caltrans staff felt it necessary to conduct a study.

To limit future costs born by the city, staff felt it prudent to have the study cover all of the Mahan Corridor from Bowman Rd. to Springer Ave. With this task now complete, staff is still on track to Bid the Mahan project this summer. Staff has completed the design of both segments of Mahan (Bowman Rd. to Springer Ave.) and are currently working on the second RSTP application for phase two of the project, Dolphin to Springer.

Staff would like to bid the entire stretch at the same time, but currently has the bidding documents set up with phase two as an additive alternate. If the funding is obligated as staff feels it will be. we will be ready to construct the full project this summer. Staff expects to receive roughly 1.8 million dollars of grant funding per phase. We expect the local match, Measure V Contribution to be roughly $750,000.

Staff recommends that the City Council approves the amended agreement and authorizes the City Manager, Ron Strand, to execute the amended agreement with Willdan Engineering Inc. Which will bring the total portion of Work Funded by Measure V for Preliminary Engineering (PE) Services to $157,690.00.

This project is an RSTP Grant project, with multiple phases, to which the City elected to fund the design so it could be constructed a year early.

For this additional work, Willdan has prepared a cost differential as apparent in Attachment “A”.

B. Section 20 (Integration) of the Master Agreement, states that the agreement “may not be modified or altered except in writing, signed by both parties”.

C. As commenced, the City has requested Willdan to submit a Change Order proposal to detail the additional requested work. The Change Order is attached hereto as Attachment “A”.

ATTACHMENT “A”
(Change Order - Additional Scope of Work)
Willdan Proposal dated November 15, 2024
November 15, 2024
Mr. Travis Reed, PE
Public Works Director
City of Ridgecrest
100 West California Avenue
Ridgecrest, CA 93555
Subject: Budget Amendment Request No. 1 for Additional Professional Engineering Services for the Mahan Street Improvements
Dear Mr. Reed:

Willdan Engineering & Rincon Consultants, Inc. (The Willdan team) is pleased to currently provide engineering services for the above-referenced project. For your consideration, The Willdan team has prepared the following budget amendment request for the extra tasks requested by the City in conjunction with the above referenced project. We appreciate the opportunity to submit our proposal and look forward to discussing the tasks shown below with you.

Willdan’s current budget of $125,240 includes the improvements listed in the Project Understanding. Budget Amendment No. 1 is to complete the Historical Sight Preservation Report and the Archaeological Survey Report. We propose to provide these services mentioned above for an additional compensation of $32,450.00 making our current amended contract amount $157,690.00.

SCOPE OF WORK
In support of the project, the Willdan Team will prepare an APE map, HPSR and ASR meeting the requirements of Standard Environmental Reference (SER) Volume 2:

Cultural Resources. This proposed scope of work includes a cultural resources records search through the California Historical Resources Information System (CHRIS), Sacred Lands File (SLF) search conducted by the Native American Heritage Commission (NAHC), Native American and Other Interested Parties outreach, desktop geoarchaeological review, field survey, and reporting. The cultural resources tasks will be managed or overseen by The Willdan Team cultural resources specialists that meet or exceed the Secretary of the Interior’s Professional Qualification Standards for archaeology.

Task 1 Area of Potential Effects Map
The Willdan Team will develop an APE map to Caltrans’ SER Volume 2 specifications, including all areas that will be impacted by the project, including staging and construction access areas. The APE map will be plotted on an aerial photograph, and will also include City of Ridgecrest
November 15, 2024

Page 2 ends

a bar scale, north arrow, the location of any cultural resources identified in APE, clearly labeled roads, and a signature block for “Caltrans Professional Qualified Staff” and “Caltrans Local Assistance Engineer.” The draft APE map will be included as an attachment to the HPSR. The Willdan Team will respond to one round of Caltrans comments and prepare a final APE map. Willdan will review the existing plans, the City’s Master Plan of Drainage, and the FEMA study to determine the ultimate drainage conditions for the site. The City is to provide all survey data and CADD files for the development. Topographic Survey is not included in this proposal. One single day site investigation is assumed for this project.

Task 2 Historic Property Survey Report
The Willdan Team will prepare a short-format Caltrans HPSR in accordance with Caltrans’ current guidance as specified in the SER. The HPSR is the overarching document that summarizes the results of the cultural resources investigation; it will include a project description, a description of the APE, details of consultation with Native American groups/individuals and other interested parties, a summary of identification efforts, information regarding any historic properties identified within the APE, a list of attached documentation, and the findings of the study. The Willdan Team will respond to one round of Caltrans comments and prepare a final HPSR.

Task 3 Archaeological Survey Report
Task 3.1 California Historical Resources Information System Records Search The Willdan Team will request an expedited CHRIS records search from the Southern San Joaquin Valley Information Center located at California State University, Bakersfield to identify previously recorded cultural resources and previous studies within the APE plus a 0.5-mile buffer. To identify other cultural resources that may be present in or immediately adjacent to the APE, The Willdan Team will review the National Register of Historic Places, the California Register of Historical Resources, California Historical Landmarks list, California Points of Historical Interest list, Built Environment Resource Directory, and Archaeological Determinations of Eligibility. The Willdan Team assumes that no cultural resources will be identified in or immediately adjacent to the APE and that SSJVIC fees will not exceed $1,500 (this includes a 50% surcharge for an expedited search).

Task 3.2 Native American and Other Interested Parties Outreach Task 3.2.1 Native American Outreach
The Willdan Team will request an SLF search from the NAHC. The SLF search will indicate if known cultural resources important to Native Americans on file at the NAHC are present within the project site or vicinity. The NAHC will also provide a list of Native City of Ridgecrest
November 15, 2024

Page 3 ends

American contacts for the project. The Willdan Team will draft Native American consultation letters to be placed on Caltrans letterhead and signed by Caltrans personnel.

The letters will describe the undertaking, summarize the CHRIS and SLF search results, solicit information or concerns about the project and/or Native American resources, invite the tribe to consult with Caltrans on the proposed project, and request a response within 30 days of receipt of the letter. Maps depicting the project site will be included with the letters. On behalf Caltrans, the Willdan Team will send the letters via certified mail with return receipt requested and via email to each tribe identified on the NAHC contact list plus any other tribes identified by Caltrans. After 10 business days have elapsed, The Willdan Team will follow up with each contact by telephone to ensure the letter was received and to solicit any information or concerns the tribe would like to share. As many as two telephone calls will be made to each of the contacts to document “good-faith” outreach efforts. The Willdan Team will maintain a contact log documenting all outreach efforts. Documentation pertaining to outreach efforts (i.e., letters, emails, phone logs, responses, contact log). Results of outreach efforts will be summarized in the HPSR and ASR and supporting documentation will be appended to the ASR.

The Willdan Team assumes that no more than five tribal entities will be contacted and that no more than two tribal entities will respond and provide comments. The Willdan Team assumes that outreach will not result in the identification of Native American cultural resources in or immediately adjacent to the APE. The Willdan Team assumes that Caltrans will conduct any required government-to-government consultation meetings and The Willdan Team will not participate in virtual or in-person meetings or site visits with tribal members.

Task 3.2.2 Other Interested Parties Outreach
The Willdan Team will identify and compile a list of local historical groups that may have knowledge of the history of the area and historic-period cultural resources in the APE or immediate vicinity. The Willdan Team will contact each group via email. One telephone call will be made to each of the groups to document “good-faith” outreach efforts. The Willdan Team will maintain a contact log documenting all outreach efforts. Documentation pertaining to outreach efforts (i.e., emails, phone logs, responses, contact log) will be included in the report as an appendix. The Willdan Team assumes that no more than two (2) groups will be contacted and that neither group will respond and provide comments.

The Willdan Team assumes that outreach will not result in the identification of historicperiod cultural resources in or immediately adjacent to the APE.

Task 3.3 Desktop Geoarchaeological Review
The Willdan Team will conduct a desktop geoarchaeological review to assess the archaeological sensitivity of the APE. This will include a review of historic, geologic, and soil maps, aerial photographs, SSJVIC data, ethnographic data, and environmental assessments and/or geotechnical reports (if available). The review will identify areas of City of Ridgecrest
November 15, 2024

Page 4 ends

low, moderate, or high potential for surface and subsurface archaeological resources within the APE, and the potential to encounter such resources based on the sensitivity level and project excavation parameters. If the desktop geoarchaeological review indicates a moderate to high potential to encounter subsurface archaeological resources, additional work beyond this scope and cost estimate may be necessary to complete identification efforts.

Task 3.4 Field Survey
After receipt of the CHRIS search results, the Willdan Team archaeologist will conduct a pedestrian field survey of the approximate 0.5-mile-long APE. The objectives of the survey will be to characterize current conditions and examine any visible ground surfaces to identify any surface cultural resources. Survey transects will be spaced at maximum intervals of 15 meters (approximately 50 feet). Transect spacing will be maintained and documented through use of hand-held global positioning system units. The Willdan Team will collect data sufficient to generate a survey coverage map. The Willdan Team assumes the survey can be
completed by one archaeologist in one 4-hour day, inclusive of travel time, and that the survey results will be negative.

Task 3.5 Archaeological Survey Report
Following completion of the field survey, the Willdan Team will prepare an ASR. The ASR will include environmental and cultural contexts, and document the results of CHRIS and SLF searches, Native American and other interested parties outreach, desktop geoarchaeological review, and field survey. The ASR will include study vicinity and location maps and a survey coverage map. The Willdan Team will respond to one round of Caltrans comments and prepare a final ASR.

FEE
Willdan proposes the work mentioned above for a not-to-exceed fee of $32,450. Any additional task not listed here will be under a separate task order. Please see attached fee matrix for a breakdown of costs associated with the scope of work outlined above.

In conclusion, Willdan’s current budget of $125,240 is proposed to be increased by $32,450.00 for a revised total of $157,690.00.

In good faith, the Willdan team has started work on these reports and submitted the drafts to the City for review.

Please indicate the City’s approval and authorization to proceed by either printing out and signing two originals and returning one hard copy original to our office, or by scanning one signed original and returning it by email.

STAFF REPORT
SUBJECT: A Resolution Of The City Council Of The City Of Ridgecrest Denying All Bids Received For The Affordable Housing Sustainable Communities (AHSC) Program Community Improvement Project; And Authorizing Staff To Re-Advertise And Solicit New Bids With A Reduced Budget PRESENTED BY: Travis Reed, Public Work Director
SUMMARY:

On March 13, 2025 city staff opened bids for the Affordable Housing Sustainable Community Program Improvement Project. We received three (3) bids. After careful review of the bids, budget, and applicable funding sources, staff feels it prudent to modify and remove portions of the project and rebid to stay within budget.

As we all know the base rebuild is coming to the end. In reviewing revenues for Measure V a large contributor to this project, we are expecting a shortage of around one million dollars. During the time the project was out to bid we received the disbursements for December, coupled with the previous disbursements and noticing the trend, staff believes it is in the best interest of the city to remove portions of work and rebid the project.

Staff is proposing to cut the “nice to haves” or more decorative items, but nothing that would substantially change the infrastructure portion of the project. Staff is looking to cut roughly 1.5 million dollars out of the project and place it out to bid within 3 weeks.

In review of the AHSC grant timeline staff feels this will in no way impact the ability to meet the requirement of grant deadlines.

FISCAL IMPACT: $0.00
ACTION REQUESTED:

1. That the City Council, pursuant to the authority of California Public Contracts Code Section 20166, herby rejects all bids received and opened on March 13, 2025, for the AHSC Program Community Improvement Project.

2. Directs staff to notify all bidders in writing of the rejection.

3. Authorizes staff to make necessary adjustments to the project to fit the budget.

4. Authorizes staff to re-advertise the adjusted project and solicit new bids.

5. Authorizes staff to set a new date for the award of the project contract.

STAFF REPORT
SUBJECT: A Resolution Of Ridgecrest City Council Establishing A Finding For Unmet Transit Needs That Are Reasonable To Meet With The Public Transportation System For Fiscal Year 2025-2026 PRESENTED BY: Sergio Covarrubias & Justin Schuchman, Transit Division SUMMARY: The Transportation Development Act of 1971 (TDA), as amended, provides for the disbursement of funds from the Local Transportation Fund for various eligible transportation uses.

These funds are distributed by the Kern Council of Governments (Kern COG), in its capacity as the Regional Transportation Planning Agency. An eligible claimant, such as the City wishing to receive TDA funding through Kern COG must conduct an annual review of the transit needs of the individuals and groups in the community which utilize the service.

Kern COG Resolution 90-04 defines “unmet transit needs” as follows:
“An unmet transit need exists if an individual of any age or physical condition is unable to transport himself or herself due to deficiencies in the existing transportation system.

Exclusions are as follows:

1. Those requests for minor operational improvements.

2. Improvements funded and scheduled for implementation in the following year.

The term “reasonable to meet” is defined as:

1. Operational Feasibility: The requested improvement must be safe to operate, and there must be adequate roadways for transit vehicles

2. Duplication of Service: The proposed service shall not duplicate other transit services

3. Timing: The proposed service shall be in response to an existing rather than a future need

4. Service must meet the legally required farebox ratio (PUC Sections 99268.2, 99268.5 and CAC Sections 6633.2, 6633.5) with fares close to fares of similar service.” The hearing was duly noticed at least 30 days (February 19, 2025) prior to this evening.

It is appropriate for council to open the Public Hearing, receive written and oral comments regarding any “unmet transit needs” and determine whether these “needs are reasonable to meet.” The documentation of the Public Hearing will be forwarded to Kern COG so the city remains eligible for TDA funds.

FISCAL IMPACT: None at this time, yet this is a positive to the City Budget ACTION REQUESTED:

1. Open the Public Hearing, consider all public comments per the criteria previously described.

2. Provide direction to staff if necessary.

3. Approve a Resolution and Establish a finding for “Unmet Needs” that are “reasonable to meet” with the Public Transportation System for fiscal year 2025-2026 CITY MANAGER’S RECOMMENDATION:
