STAFF REPORT
SUBJECT: Resolution Authorizing Submission Of The Fiscal Year 2024-2025 Transportation Development Act Article 4 Claim To The Kern Council Of Governments PRESENTED BY: Kelly Brewton, Finance Director
SUMMARY:
The Transportation Development Act (TDA) is a statewide program that added a quarter cent sales tax for the purpose of funding transit needs within local jurisdictions throughout the state. Those funds are distributed to regional transportation planning agencies (RTPA) who is responsible for the allocation and distribution of the said funds to the local transit systems.
Pursuant to California Government Code Section 29532, the Kern Council of Governments (Kern COG) is the designated regional transportation planning agency for purposes of administering the Act within the Kern County region. TDA allows that a certain portion of those funds be retained by the RTPA for administration purposes, and a certain amount may be retained for pedestrian and bicycle transportation improvements. The balance of the funds are available to the local transit systems, with the provision under Article 4 of that Act that if there is money left over after the needs of the local transit systems have been met and unmet transit needs have been addressed, the remaining funds shall be distributed to the City and County for road maintenance purposes under an established formula.
The approval of this item will allow the Finance Director to submit the attached claim to the Kern COG.
FISCAL IMPACT: $1,110,755 in revenue will be received by the City of Ridgecrest to fund transit operations.
ACTION REQUESTED:
Approve the attached resolution.

8. Statement of Justification - The City typically makes a general fund transfer to the transit division to cover fare box.
8.3 Statement of justification -
12. Statement of justification - The City has an adopted budget that has merit increases based on performance and years of service. The steps follow, depending on the point you are at within the salary schedule, either a 5% step or a 2.5% step. As many members of the Transit organization are not yet "topped out" you will see normal merit increases year over year for administrative and technical staff.
Furthermore, the transit division is currently in process of reorganization, thus more time for the Finance Director and the Public Works Director will be charged to the department. The proposed changes will reduce the overall cost to the division do to a reduction in force but will increase year over year as each position and pupil grow in their role. One could expect to see roughly 5%-10% of the Finance Director and Public Works Director salary be transferred to the Transit division as a mid-manager will no longer be within the division.

STAFF REPORT
SUBJECT: A Resolution to Approve the FY 25-26 Rate Adjustment Request for Solid Waste Services PRESENTED BY: Heather Spurlock, Community Development Manager Background
In 2011, the City issued a competitive request for proposals for solid waste collection services and entered into a new agreement with Waste Management (WM) effective January 1, 2012. A First Amendment to the Solid Waste Agreement (First Amendment) was adopted by resolution on February 21, 2018. On July 19, 2022 the City adopted a resolution to renew the Amended & Restated Solid Waste Agreement for solid waste collection services (including organics under SB 1383) with Waste Management (WM). On May 15, 2024, Council approved the FY 24-25 annual rate adjustment of 2.6% with a 3.1% carryover from FY 2023-2024 for a total rate adjustment of 5.7%.
Summary
On March 27, 2025, WM submitted a request for an annual contractual adjustment of service rates pursuant to section 10.2 and Exhibit B of the Solid Waste Franchise Agreement between the City and WM. City Staff reviewed the adjustment calculations to retrieve and validate data sets for accuracy including: Labor Factor - Employment Cost Index (U.S. Bureau of Labor Statistics); Fuel Factor – Fuel Index (U.S. Energy Information Administration); Other Factor – Consumer Price Index (Bureau of Labor Statistics); and the Disposal Component Factor – Kern County Bin/Gate Fees (Ordinance G-9319). City staff found that all factors used in the rate calculation are accurate according to the data published by the referenced sources.
Annual Contractual Adjustment of Service Rates:
WM is requesting the City approve an annual adjustment in residential, commercial and industrial service rates of
2.4%. Per the adjustment limitations set forth in Exhibit B, the annual Operating Component Factor adjustment may not increase more than 6.0% nor decrease less than 0.00% – in the case of an increase/decrease outside that threshold, the unused percentage increase or decrease otherwise permitted may be carried over until such time as it may be applied without violating the provisions of Exhibit B. For FY 2025-2026, WM is requesting an annual Operating Contributing Factors to the rate adjustment were increases in labor and inflation. Staff verified the rate adjustment was calculated in accordance to Exhibit B of the agreement. The calculations & supporting documentation for the requests are included for reference. Upon approval, the adjusted rates would be effective beginning July 1, 2025.
