HOUSING AUTHORITY/FINANCING AUTHORITY AGENDA ITEM

STAFF REPORT
SUBJECT: A Resolution Of The Ridgecrest City Council For Acceptance Of The Engineering And Traffic Survey Report And Authorization To Post The Speed Zones Accordingly
PRESENTED BY: Terry Roberts, Public Works Director
SUMMARY:

California Vehicle Code Sections 22357 and 22358 permit local authorities to set speed limits on the basis of an engineering and traffic survey. These speed limits must be posted to clearly define the limits.

An engineering and traffic survey is defined in California Vehicle Code Section 627. The California Manual of Uniform Traffic Control Devices provides the methodology for conducting an engineering and traffic survey.

With review and input from the City, an engineering and traffic survey was completed by Willdan Engineering. The survey was supervised and certified by a registered traffic engineer. The results of the study are compiled in the attached 2026 Engineering and Traffic Survey Report of July 2026.

The report recommends changes to the speed limits on 16 street segments. This will require approximately 30 speed limit signs to be replaced. The City’s Streets personnel will make and replace the signs during normal working hours, approximately 100 labor hours.

FISCAL IMPACT: Purchase of the new sign materials, approximately $5,000.00, will be funded by 102.42.4212.5203.000, Streets Maintenance, Repair and Maintenance Supplies.

ACTION REQUESTED: Approve this resolution to accept the engineering and traffic study and to authorize Streets personnel to procure and install new speed limit signs.

CITY MANAGER RECOMMENDATION: Action as Requested

STAFF REPORT
SUBJECT: Introduction And First Reading Of An Ordinance Of The City Council Of The City Ridgecrest Amending The Ridgecrest Municipal Code As It Relates To The Conflicts Of Interest PRESENTED BY: Martin Koczanowicz, City Attorney
SUMMARY:

The Political Reform Act requires every local government agency to review its conflict-of-interest code biennially. A conflict-of-interest code tells public officials, governmental employees, and consultants what financial interests they must disclose on their Statement of Economic Interests (Form 700). The City Council is the code reviewing body for city agencies.

If amendments to an agency’s conflict of interest code are necessary, the amended code must be forwarded to the City Council approval within 90 days. A City’s amended code is not effective until it has been approved by the City Council. Note that the Local Agency Biennial Notice does not need to be forwarded to the Fair Political Practices Commission (“FPPC”).

The FPPC requires the code to be amended if there are any positions either added or deleted from the previous cycle. There have been three additions to the positions covered by the Conflict-of-Interest laws since the 2024 Code Amendments.

The job titles and categories added are the following:
* Public Works Director
* Accounting Supervisor

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY RIDGECREST

AMENDING THE RIDGECREST MUNICIPAL CODE AS IT RELATES TO

THE CONFLICTS OF INTEREST DISCLOSURE REQUIREMENTS
WHEREAS, the Political Reform Act of 1974 (the “Act”) requires every local agency to adopt a conflict-of-interest code applicable to specified public officials and employees or consultants holding designated positions; and
WHEREAS, the Act requires local agencies to review their conflict-of-interest code biennially to ensure it accurately identifies designated employees and disclosure categories; and
WHEREAS, the Act requires the code be amended if any positions are either added or deleted from the previous year; and
WHEREAS, the City has conducted its biennial review and desires to amend Part 1, Chapter 2, Article 1, Section 2.88 of the Ridgecrest Municipal Code to update the designated employees and disclosure categories.

NOW, THEREFORE, THE RIDGECREST CITY COUNCIL DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. Amendment
Section 2.88 of the Ridgecrest Municipal Code is deleted and reinstated to read as follows:
“Sec. 2-88. - Conflicts of interest.
(a) The Political Reform Act (Government Code § 81000 et seq.) requires state and local government agencies to adopt and promulgate conflict of interest codes. The fair political practices commission (FPPC) has adopted a regulation (2 California Code of Regulations § 18730), which contains the terms of a standard conflict of interest code. After public notice and hearing, it may be amended by the FPPC to conform to amendments in the Political Reform Act. Therefore, the terms of 2 California Code of Regulations § 18730, and any amendments to it duly adopted by the FPPC, are hereby incorporated into the conflict-of-interest code of the city by reference. This regulation designating officials and employees and establishing economic disclosure categories shall constitute the conflict-of-interest code of the city.
(1) All officials and employees required to submit a statement of economic interests shall file their statements with the city clerk, or designee. The city clerk shall make and retain a copy of all statements filed by the city council, city manager, mayor, director of finance, and city attorney, and forward the originals of such statements to the fair political practices commission. Persons in this category shall disclose all interests in real property within the city's jurisdiction. The definition of the term "interests in real property," as used herein, can be found in the Political Reform Act (see Government Code § 82033).
(3) Category 3. Persons in this category shall disclose all income (including gifts, travel payments, and loans) from investments in and business positions with business sources that provide leased facilities, manufacture, provide, or sell services (including consulting and training services) and/or supplies (including goods, equipment, vehicles, or machinery) of a type utilized by the city and associated with the job assignment of designated positions assigned this disclosure category.
