Subject: Grant Deed / Grant of Public Utility Easement_Khatri & Sons, L.P.
RECOMMENDED ACTION:
In 2004, the City of Ripon completed the Hughes Lane Street Widening Project. As part of this project, a dedication of property and a public utility easement was drafted; however, it was never recorded. Requesting Council adopt the resolution accepting a Grant Deed / Grant of Public Utility Easement of certain real property located at 467 N. Wilma Avenue to the City of Ripon in connection with the 2004 Hughes Lane Street Widening Project, and authorize the Mayor to sign and execute any and all documents necessary to complete the aforementioned transaction.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RIPON ACCEPTING A GRANT DEED / GRANT OF PUBLIC
UTILITY EASEMENT OF CERTAIN REAL PROPERTY TO
THE CITY OF RIPON
WHEREAS, Khatri & Sons, L.P., herein referred to as “GRANTOR” are the owners of real property located in Ripon, San Joaquin County, California 95366 described in Exhibit “A” and Exhibit “B”of the Grant Deed / Grant of Public Utility Easement attached hereto; and WHEREAS, the ownership of the Property by the City of Ripon, herein referred to as “GRANTEE”, will further the public interest; and
WHEREAS, by execution of the Grant Deed / Grant of Public Utility Easement in connection with the 2004 Hughes Lane Street Widening Project, Grantor conveyed the Property to the City of Ripon; and
WHEREAS, by execution of the Grant Deed / Grant of Public Utility Easement, Grantor has agreed to grant to Grantee a public utility easement and right-of-way to lay, construct, repair, maintain, operate, renew and replace pipelines and appurtenances incidental thereto (herein referred to as “facilities’) for the conveyance of water, wastewater, electrical, stormwater and telecommunication with right of ingress and egress to and from same, in, over, under and across the easement on certain property more particularly described in Exhibit “C” and depicted on Exhibit “D” of the Grant Deed / Grant of Public Utility Easement attached hereto; and WHEREAS, Government Code section 27281 mandates that deeds or grants conveying any interest or easement upon real property to a governmental agency for public purposes shall not be accepted by the County for recordation without consent of the grantee evidenced by its certificate or resolution of acceptance attached to or printed on the Grant Deed / Grant of Public Utility Easement.
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Ripon, does hereby accept the aforementioned Grant Deed / Public Utility Easement Deed from Khatri & Sons, L.P. The Mayor is authorized to sign and execute any and all documents necessary to complete the aforementioned transaction.
