City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Ken Zuidervaart, Planning Director
Date: 01/11/2022
Subject: Sidewalk Dining Permit Application Fee
RECOMMENDED ACTION:

Should the City Council agree with Staff’s recommendation, the following motion would be appropriate: “The City Council adopts the resolution establishing a revised Planning Agency Fee schedule, which adds “Sidewalk Dining Permits” to the schedule.” BACKGROUND:

At the December City Council meeting, the City Council rescinded Chapter 5.48 regarding outdoor dining within a public right-of-way and approved amendments to Chapter 5.44 regarding sidewalk dining on public walkways.

The newly revised sidewalk dining ordinance alludes to an application fee as set by resolution of the City Council. For the past several months, the City Council has been working through several drafts of an ordinance to regulate “Sidewalk Dining” within the City of Ripon. At the December 14, 2021 City Council meeting a “Sidewalk Dining” ordinance was adopted to regulate such activities, which will go into effect on January 13, 2022.

With the adoption of amendments to the City’s “Sidewalk Dining on Public Walkways” ordinance there is a need to add “Sidewalk Dining Permits” to the Planning Fee Schedule. It is a requirement that all sidewalk dining within the City of Ripon obtain a sidewalk dining permit in order to operate within City limits. The cost for staff to process these applications has been estimated at $270.00 (approximately 1 hour Planning Secretary and 1 ½ hours Planning Director). All sidewalk dining permits are valid for 1 calendar year, meaning they expire on December 31st of the year in which they were issued. The sidewalk dining permit will include a yearly permit renewal fee of $75 so long as the business operating the sidewalk dining area has complied in good faith with the rules and regulations set forth in the City’s ordinance.

The City of Ripon is authorized by law, including Government Code Section 66014 and R.M.C. Chapters 16.06 and 16.08.100(E), to impose fees for staff time in the processing of various applications submitted to the Planning Department. The Planning Department maintains a Fee Schedule, which provides a list of fees for processing a variety of applications.
