Subject: Claim - Robyn Gordon
RECOMMENDED ACTION:
After consideration and investigation, it is the City’s claim administrator’s recommendation that the claim be rejected.
BACKGROUND:
Robyn Gordon submitted a claim to the City of Ripon on January 31, 2022 for damage done to her tires when she encountered a pothole on Santos Avenue between Jack Tone Road and a service road. She is seeking $534.64 to replace her two damaged front tires from the incident.
DISCUSSION/ANALYSIS:
The City’s claim administrator, Doug Redifer, reviewed the claim submitted. Government Code Section 835 gives immunity to public entities for incidents such as this when they had no knowledge of the condition prior to the occurrence. Upon investigation, it was also found that the pothole was created by trenching done by a construction company when installing a line for a project in the area. Mr. Redifer has tendered this claim to the responsible party and finds the City to have no liability for this loss.
Accordingly, it is Mr. Redifer’s recommendation that this matter be submitted to the City Council for the claim to be rejected.
