RECOMMENDED ACTION:
The City’s claim administrator has investigated the submitted claim and is recommending the City Council reject the claim.
BACKGROUND:
Abhijit & Amandeep Gill submitted a claim to the City of Ripon on February 17, 2022 for damage done by a garbage truck to their basketball hoop in front of their home. They are seeking a total of $691.91 ($591.91 for the replacement of the basketball hoop and $100.00 for the installation fee).
DISCUSSION/ANALYSIS:
The City’s claim administrator, Doug Redifer, reviewed the claim submitted, pictures and video of the incident. Ripon Municipal Code states that no obstructions shall be place in “the public ways…” This includes “any post, pillar, pole or structure which stands or rests upon, within or in any public way”. Mr. Redifer states that there is no liability for this loss as the basketball pole and hoop were in the public sidewalk/street in violation of RMC 12.08.020. Furthermore, the claimant was aware of trash pickup every Tuesday and put the can under the hoop creating the hazard.
Accordingly, it is Mr. Redifer’s recommendation that this matter be submitted to the City Council for the claim to be rejected.
