City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Ken Zuidervaart, Planning Director
Date: 11/08/2022
Subject: Eavenson Lease Agreement
RECOMMENDED ACTION:

Approve and authorize the Mayor to sign the Agricultural Lease Agreement with Daniel S.

Eavenson for the property located at 752 S. Mohler Road (APN: 257-270-79).

BACKGROUND:

The property in question resides just south of the City’s Lan Park storm basin. The property was originally owned by Les Eastburg, who owned the entire 19.71 acres. In December of 2009, the City of Ripon acquired 6 acres from Les Eastburg, in conjunction with an Irongate East Development Agreement requirement, for future expansion of the Lan Park storm basin for future residential growth in the S. Mohler Road area.

When the City took ownership of the property, the entire 19.71 acres was being farmed by Weststeyn Farms, who farmed the property for Les Eastburg and continued farming the property until the property was sold in 2020 to Daniel S. Eavenson (Eavenson Construction). Daniel S.

Eavenson is now desiring to remove the entire orchard and plant row crops for the next few years, including the 6 acres owned by the City of Ripon, which he has been maintaining since he purchased the property in 2020.

DISCUSSION/ANALYSIS:

Staff has put together a very basic year-to-year lease agreement, whereas Daniel S. Eavenson will lease the property for $1.00 per year on a year-to-year basis. Either party may terminate the lease at any time with 90 days written notice. Daniel S. Eavenson will be required to maintain the property and any improvements in good order and repair and in safe and clean condition pursuant to the lease requirements.

FISCAL IMPACT:

Moving forward, the City’s general fund revenue would remain as is since the lease of the property is $1.00 per year, however the City would not be incurring any expense to maintain the parcel.
