MEMO
To: Honorable City Council
From: Lisa Roos, City Clerk & Finance Director
Date: 12/13/2022
Subject: Resolution to accept Election Results
RECOMMENDED ACTION:
This resolution accepts the certification of the November 8, 2022 municipal election.
BACKGROUND:
Section 10263 of the California Election Code states:
“Upon the completion of the canvass and before installing the new officers, the governing body shall adopt a resolution reciting the fact of the election and the other matters that are enumerated in Section 10264. The governing body shall declare elected the persons for whom the highest number of votes were cast for each office.”
The information to be included in this resolution is listed in Section 10264 of the Election Code including the whole number of votes cast in the City, the names of the persons voted for, and the number of votes to each person.
DISCUSSION/ANALYSIS:
The City of Ripon consolidates our election with San Joaquin County. The Registrar of Voters has 30 days to certify the results of the election. After the City receives that certification, we are required to declare the results and install the newly elected officers at the next regularly scheduled meeting. This is done at the first meeting in December following an election.
The Registrar of Voters certified the results of the election on December 2, 2022 and those numbers are included in the attached resolution.
This November 8, 2022 election was for 2 positions. The candidates receiving the two highest number of votes and that will be installed as our new Council Members for a four-year term are Michael Restuccia and Dean Uecker.
In addition, for information purposes only, Gary Barton has been appointed to the 2-year unexpired term per the attached resolution approved by the San Joaquin County Board of Supervisors on November 29, 2022. Due to him being an uncontested candidate, no action is needed by the City of Ripon City Council.
FISCAL IMPACT:
Estimated costs for the consolidated election is $40,000 paid by the General Operating Fund.
