City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Ken Zuidervaart, Planning Director
Date: 12/13/2022
Subject: Meadowood Development Agreement - Amendment No. 1 RECOMMENDED ACTION:

Should the City Council agree with Staff’s recommendation, the following motion would be appropriate:
“The City Council approves the First Amendment to the Meadowood Development Agreement, and directs staff to process and record the appropriate documents to facilitate the amendment.” BACKGROUND:

Section 4 of all City of Ripon development agreements (“Timing of Development”) acts as a performance clause for all approved development agreements. This section provides an owner/developer three (3) years to commence construction on their project or else the development agreement will be in default and automatically terminate. This section also provides an owner/developer an option to request a one time 1-year extension regarding this performance clause as approved by City Council.

In October of 2021, the owner/developer requested and received a 1-year time extension regarding this performance clause, essentially extending their performance deadline until December 31, 2022.

Staff received another request from the current owner/developer of the Meadowood residential subdivision project asking for an additional 1-year extension on the performance expiration date as outlined in Exhibit C section 4 (Conditions of Approval) in the final executed development agreement. Pursuant to the executed development agreement, only one 1-year extension may be requested and granted which was approved last year.

DISCUSSION/ANALYSIS:

After discussing the matter internally, staff is recommending amending the language in Exhibit C, section 4 (Timing of Development) to allow owners/developers additional time to commence construction on their projects. Staff has observed with many projects that it has become increasing more difficult for projects to work through all the requirements to get their projects moving, therefore believe the suggested amendment provides both the owners/developers and City Council the most flexibility and discretion.
