City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Ken Zuidervaart, Planning Director
Date: 04/11/2023
Subject: Reimbursement Agreement - Noosa Energy Storage RECOMMENDED ACTION:
Approve and authorize the Mayor to sign the Noosa Battery Storage Reimbursement Agreement that provides reimbursement for staff time to respond to an extension request for a previously approved application for a battery energy storage project located at 1302 Frontage Road (near the City of Ripon Park and Ride lot).
BACKGROUND:
In May of 2021, Noosa Energy Storage, LLC applied for and received approval for a “Use Permit” to construct a lithium ion battery energy storage project at 1302 Frontage Road (near Flying J and the PG&E substation). Construction of the project has not commenced and the developer is now in jeopardy of losing their entitlements for the project due to permit expiration limits set within the Ripon Municipal Code. The Code does allow for a one (1) year time extension upon approval by the Planning Commission and/or City Council. The reimbursement agreement will provide an opportunity for the City to get reimbursed for staff time and potential consultant management regarding the extension request for the project.
