Subject: Pereira Property Development Agreement Extension Request RECOMMENDED ACTION:
The City Council approves a one-year extension of the Pereira Property Development Agreement as allowed for in the original Development Agreement.
BACKGROUND:
For many projects within the City of Ripon, the City enters into Development Agreements with the project proponent. Development agreements are contracts negotiated between project proponents and public agencies that govern the land uses that may be allowed in a particular project and establish conditions of approval for said project. The City of Ripon entered into a Development Agreement with the developer (HPG Ripon Development LLC) and property owners (Pereira Properties and Gregory and Donna Miller) for the Pereira Residential Development Project in April of 2020. Development Agreements made with the City of Ripon are typically valid for a ten (10) year period, however they do contain performance requirements expecting that construction of the project will commence within approximately three (3) years or else the owner/developer will be in default of the agreement. Within the agreement there are provisions for the owner/developer to request a one-year extension of said performance requirements upon approval by the City Council.
DISCUSSION/ANALYSIS:
To date construction of the project has not yet commenced. Staff did receive a letter, dated April 15, 2023, from the developer requesting a one-year extension pursuant to Exhibit “C” section 4 of the approved Pereira Development Agreement. The terms of the Development Agreement require construction to commence before the end of 2023. Approval of the extension will grant a one-year extension on that term, requiring construction to commence before the end of calendar year 2024.
FISCAL IMPACT:
There is no fiscal impact identified to the City in granting this requested extension.
