City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Kye Stevens, Recreation Director
Date: 07/11/2023
Subject: Tennis Courts MOU
RECOMMENDED ACTION:

Approve and authorize the Mayor to sign the Memorandum of Understanding between the City of Ripon and the Love-Love Ripon Tennis Foundation that defines the responsibilities between the City and the Foundation to complete a Tennis Complex at the Mistlin Sports Park.

BACKGROUND:

The Love-Love Ripon Tennis Foundation (“Foundation”) has offered financial assistance in the form of a donation to help move forward the design and construction of a Tennis Complex at the Mistlin Sports Park.

DISCUSSION/ANALYSIS:

The purpose of this Memorandum of Understanding is to define the responsibilities between the City of Ripon and the Foundation to implement the Tennis Complex, which includes tennis courts, lighting, fencing, utilities, parking, restrooms, and ADA required access. Staff has drafted the attached Memorandum of Understanding for City Council’s consideration, which is summarized below:
 Engineering services to prepare the Tennis Complex design drawings, cost estimates, and technical specifications that will be used to bid and construct the complex to be donated by the Foundation.
 Funding for 50 percent of the construction cost of the Tennis Complex tennis courts and associated elements (e.g., fencing, lighting, grading, utilities, and ADA access) to be donated by the Foundation.
 Funding for the remaining 50 percent of the Tennis Complex and associated elements and 100 percent of the parking lot, restrooms, access roads, and landscaping/irrigation to be funded by the City of Ripon.
 Management of the bid process and construction will be done by City of Ripon.  Any permits required and payment of fees associated with the Tennis Complex will be paid for by the City of Ripon.
 Operations of the Tennis Complex will be managed by the City of Ripon, which will include designated rentals by the Foundation at no charge.  Maintenance of the Tennis Complex will be done by the City of Ripon.

A tennis complex at the Mistlin Sports Park is included as one of the projects in the Parks & Recreation Public Facilities Financing Plan (PFFP). The City is currently collecting fees from new development to fund Parks & Recreation PFFP projects. The City’s share of the expenses for the Tennis Complex will be paid by the Parks & Recreation PFFP Fund; at the present time, the balance in this fund is $56,156. Once a preliminary design is complete along with the estimated cost of construction, the City and Foundation will identify the phasing of the Tennis Complex. The timing as to when the City will have the Parks & Recreation PFFP funds available will be dependent on the timing of future development projects.

FISCAL IMPACT:

There is no fiscal impact for the approval of the Memorandum of Understanding. Staff will bring back the phasing plan, estimated cost of construction, and a funding plan, once that information is available.
