Various Locations
Ripon, California
Dear Ms. Rodriguez:

Terracon Consultants, Inc. (Terracon) appreciates the opportunity to present this proposal for providing Construction Materials Testing & Special Inspection Services for the City of Ripon on an Annual Services Agreement. We appreciate the opportunity and look forward to working with you on future projects.

SCOPE OF SERVICES AND COMPENSATION
Per the request of Carla Rodriguez, provide 2nd Amendment to Services Agreement. We are providing rates based on prevailing wage laws for projects performed for the City of Ripon. We understand that the City has a few roadway construction projects for the year and has the desire to set up an annual services agreement based on the following inspections:
■ Compaction testing;
■ Concrete testing;
■ Proctor on Soil and Aggregate base rock;
■ Report production;
■ Trip charges;
■ Compression test concrete cylinders.

The fee for our services, including all field work, engineering analyses and report preparation will be based upon the unit costs prepared for this agreement as shown in the following table, with a Not to Exceed amount of $20,000.00. The time required for construction materials testing on these projects will be directly related to the schedule and performance of the various contractors chosen and how many trips are made to the site. As a result, total fees for the construction materials services will be based upon the applicable unit rates. The following table presents a detailed breakdown of our proposed unit rates for this agreement:

Terracon can only provide the services discussed herein when properly scheduled. Our services will be provided only at the specific starting times scheduled by the contractor. Failure on the contractor’s part to notify Terracon of the construction activities which require our involvement could jeopardize our ability to provide the necessary materials testing certification upon completion of the City’s projects.

Our proposal does not include ladders, man lifts, scaffolds and other means necessary to access the areas to perform our inspections and tests. For us to safely and efficiently perform our scopes, others will need to provide all necessary means to access the areas for our work scopes. Our scope does not include shoring, temporary bracing, construction aids or monitoring of safety practices of the Contractor.

The following assumptions were used in preparing this proposal:
■ Our fees for trips to the site will be charged portal to portal; ■ The City of Ripon is located approximately 30 miles each way from our office and laboratory. Average drive time is 25 minutes each way.
■ Time will be charged in 2, 4 and 8-hour increments for earthwork/asphalt observations, and 4 and 8-hour increments for special inspection ACI/ICC/CWI observations, with a two-hour minimum charge to all on-site hourly unit rates;
■ An out-of-scope charge of $108/hour will be applied for all stand-by time and/or time spent on activities which were not cancelled with prior timely notice (within 8 working hours of requested field inspection); Proposal for Construction Materials Testing and Inspection Services City of Ripon 3rd Amendment to Service Agreement ■ Ripon, California June 28,2023 ■ Terracon Proposal No. PNA191172 3rd Amendment Responsive ■ Resourceful ■ Reliable 3
■ Staff time, laboratory testing and extra trips required for re-testing and/or re-inspection will be marked on the monthly invoices and be considered out-of-scope items;
■ All work performed during weekends and holidays or in excess of 8 hours per day will be billed at 1.5 times the applicable hourly billing rates;
■ Testing and inspection services must be scheduled by the client / contractor with 24 hours’ notice to our office (209-263-0593). Our services are provided on an on-call, as requested basis either by the client’s representative or client’s contractor. Terracon will not be responsible for scheduling our services and will not be responsible for tests that are not performed due to failure to schedule our services; ■ Terracon’s services specifically exclude job site safety responsibility; ■ Our services do not relieve any contractor/subcontractor from complying with project plans and specifications; and,
■ Invoices for the project will be submitted on a monthly basis.

Contingency
Any services not included in our proposed scope can be provided on an as requested by the client or client’s representative at an addition to our estimated budget allowance.

AUTHORIZATION
We assume that our services will be performed under the terms and conditions in the Master Services Agreement. Our fees are due within the terms of the agreed Annual Services Agreement. This proposal is valid only if authorized within sixty days from the listed proposal date.

We appreciate your consideration of Terracon for this work, and look forward to working as your materials engineering consultant on this and future projects.

Prevailing Wage Requirement: Public works contract provisions require the Contractor and its subcontractors to pay all workers employed on the project no less than the specified general prevailing wage rates for the work classification in which they are performing. We understand these projects will be subject to prevailing wage.
