Vice Chairman Saljian explained the public hearing and appeal process.

Planning Director Zuidervaart introduced the staff report into the record.

Zuidervaart explained that this is an annual review of the active Development Agreements to ensure developers are complying in good faith with the terms and conditions agreed upon. Some Development Agreements are built out, but the 10-year agreement is still active. Zuidervaart said the developers are complying with all requirements and that staff will be forwarding the Commission's recommendation to the City Council as a report on the motion.

Zuidervaart said there are currently 57 development agreements. He said of 57, seven are active and five of the seven are residential. Three of the five residential projects are fully built out and two of are actively seeking builders.

Zuidervaart said the two remaining agreements include Calvary Reformed Church and Ripon Gardens II.

Commissioner Van Essen said she thinks the Pereira subdivision could move forward if they sold the lots as custom lots as opposed to waiting for a builder. Zuidervaart said the cost of the infrastructure makes selling the lots too cost prohibitive for the developer.

REPORTS:

Planning Director Zuidervaart said there was a second item that was to be scheduled tonight but the applicant requested that the item be moved to the December 2023 meeting because they were unable to be at tonight's meeting
Zuidervaart said staff has received comments from the consultant regarding the Noosa Battery Storage Extension Request and is currently sorting through them. He said the item could be tentatively scheduled for the January 15, 2023 Planning Commission meeting at the soonest.

Zuidervaart said there were two hotels approved this year. He said one of the applicants hopes to break ground January 2024 but permits have not been issued for either project.

Michael Musca asked if the Ripon Gardens II development will include the removal of the roundabout and installation of a controlled intersection. Zuidervaart said the City is considering making it a capital improvement project.

Musca asked if Meadowood development will have a controlled intersection at Fulton and Arc.

Zuidervaart said it is not a condition of the agreement but it is a condition of the North Pointe Specific Plan.

Musca said there are very few bicycle lanes in the City and that the Wilma overpass and the Main Street overpass do not have bike lanes. He said the Wilma overpass is particularly dangerous. He asked the Commission to consider installing bike lanes on these overpasses.

ADJOURNMENT:

The appeal period for this agenda expires ten days from the date of the meeting at 5:00 p.m. The appeal fee is $591.00
There being no further business, the meeting was adjourned at 6:15 PM.
