Subject: Part Time Employee Sick Leave Policy - Update
RECOMMENDED ACTION:
This resolution amends the City of Ripon’s Part Time Employee Paid Sick Leave Policy to comply with State laws effective January 1, 2024.
BACKGROUND:
On September 10, 2014, Governor Brown signed into law the Healthy Workplaces, Healthy Families Act of 2014 that provides three days of paid sick leave for eligible employees beginning July 1, 2015. AB 1522 set forth the conditions and purposes for which paid sick leave is to be paid. AB 1522 allows the employer to choose between two accrual methods, set a minimum usage increment for paid sick leave that does not exceed two hours, and set a cap to the maximum amount that can be accrued.
City part time, temporary, and seasonal employees are not covered by any collective bargaining agreement, benefits resolution or any other benefits policy. As such, these employees are subject to the provisions of AB 1522. All other employees of the City are covered under the City of Ripon Merit System that meet or exceed the minimum requirements for AB 1522 paid sick leave and are, therefore, not subject to AB 1522.
In June 2015, the City Council adopted Resolution 15-40 that adopted the City’s current Part Time Employee Paid Sick Leave Policy.
DISCUSSION/ANALYSIS:
SB 616 amends California’s Paid Sick Leave Law effective January 2024. The most significant change that impacts the City of Ripon is the increase to the minimum allowance of sick days from 3 days or 24 hours to 5 days or 40 hours of paid sick leave to employees. The City’s Part Time Employee Paid Sick Leave Policy has been updated to include this change along with the following:
A cap has been added that limits a Part Time employees maximum allowable accrued sick leave to 10 days or 80 hours, which is in compliance with SB 616. The policy no longer includes a requirement to take sick leave in a minimum of 2-hour increments as State law allows Part Time employees to take sick leave in any increment.
This policy is only for Part Time Employees as all other employees of the City continue to be covered under the City of Ripon Merit System that meet or exceed the minimum requirements of the law.
Attached is a final version and a redline version of the Policy, which shows the changes from the originally adopted Policy to the proposed amended Policy.
