City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Lisa Roos, City Clerk & Finance Director
Date: 02/13/2024
Subject: Supplemental Lease Amendment No. 3 - Army Corps of Engineers RECOMMENDED ACTION:
Approve and authorize the Mayor to sign the Supplemental Lease Amendment No. 3 with the Department of the Army for the Lower Stanislaus River Park (area around the bike bridge).
BACKGROUND:
Since 2000, the City of Ripon has been leasing the Lower Stanislaus River Park from the Department of the Army Corp of Engineers located at the end of Parallel Avenue (see figure below).
The lease is contingent on the use of the property for public recreation purposes. The City is required to provide the following:
1. Collection of refuse,
2. Cleaning and pumping, if necessary, of public sanitation facilities,
3. Public safety patrols,
4. Maintenance of the trails, vegetation, stream bank erosion, fire hazard reduction, and maintenance of the pedestrian bridge,
5. Hazardous materials response and containment,
6. Endangered species habitat recognition and monitoring, while working with the Department of the Army,
7. Emergency medical response, in cooperation with the Ripon Consolidated Fire District, and
8. Graffiti removal.
The current lease expired on January 31, 2024.
DISCUSSION/ANALYSIS:
Staff is recommending the City Council approve and authorize the Mayor to sign the Supplemental Lease Amendment No. 3 with the Department of the Army for the Lower Stanislaus River Park extending the lease an additional 20 years through January 31, 2044.
FISCAL IMPACT:
The annual expense to perform the City’s lease requirements is $25,000 during a typical year, which is paid by the General Fund. This amount can increase, largely a result of additional police patrols that are needed as a result of complaints of illegal activity in this area. There is no lease payment made to the Army Corps of Engineers for the lease agreement.
