City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Ken Zuidervaart, Planning Director
Date: 05/14/2024
Subject: Abandonment - Maple Avenue Bulb Out
RECOMMENDED ACTION:

This resolution declares the intention of the City to abandon a portion of public right-of-way adjacent to the property at 435 Maple Avenue (old cul-de-sac bulb out) and forwards the matter to the Planning Commission to determine if it conforms to the City’s General Plan goals and policies.

BACKGROUND:

At the May 15, 2023 Planning Commission meeting, the Commission approved the construction of a greenhouse and campus maintenance facility on the Ripon Christian High School Campus, located at 435 Maple Avenue. During review of that project, it was discovered that the City of Ripon still owned right-of-way for the old cul-de-sac turn around which existed prior to Maple Avenue extension. As such, the applicant did submit an abandonment application on October 18, 2023 for a right-of-way abandonment for the extra right-of-way that used to be for the old Maple Avenue turn around.

DISCUSSION/ANALYSIS:

Abandonment procedure:

1. This action first requires that City Council adopt a resolution of intention to abandon a portion of public right-of-way. The resolution of intention to abandon said right-of-way, then sends the abandonment request to the Planning Commission.

2. The Planning Commission shall review the proposed abandonment for consistency with the City’s General Plan and will forward its recommendation to the City Council for approval of the abandonment at a public hearing. The Planning Commission meeting to consider this matter is scheduled for the May 20, 2024 Planning Commission meeting.

3. The City Council will hold a public hearing on this matter, which is scheduled for the June 11, 2024 City Council meeting. Prior to the meeting staff will advertise notices of the public hearing in The Manteca Bulletin and at the site in accordance with the requirements of the Streets and Highways Code. An affidavit of posting will also be filed with the City Clerk. Should all utility agencies, affected parties, Planning Commission and City Council consider the abandonment favorably, a resolution ordering the vacation and abandonment of the public right-of-way adjacent to the property at 435 Maple Avenue will be recorded.

ENVIRONMENTAL REVIEW:

The proposed street abandonment is Categorically Exempt under Class 5, minor alterations in land use, of the current State of California Environmental Quality Act Guidelines.

PUBLIC NOTICE:

Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 hours prior to the meeting.
