Subject: Azevedo Lease Agreement
RECOMMENDED ACTION:
Approve and authorize the Mayor to sign the Agricultural Lease Agreement with Clara Azevedo Farms, LLC for a portion of the property located at 15151 E. River Road (APN: 245-180-27).
BACKGROUND:
The City of Ripon recently purchased a portion of the property located at 15151 E. River Road (north/east corner of River Road and North Ripon Road) from Clara Azevedo Farms, LLC for the right-of-way needs of the future North Ripon Road/River Road traffic signalization project.
In the purchase agreement, the City agreed to lease back the property, which is currently a part of an almond orchard, until the right-of-way was needed for actual construction of the signalization project.
DISCUSSION/ANALYSIS:
Staff has drafted a lease agreement, whereas Clara Azevedo Farms, LLC will lease the property for $1.00 per year on a year-to-year basis. Either party may terminate the lease at any time with 90 days written notice. Clara Azevedo Farms, LLC will be required to maintain the property in good order and in a safe and clean condition pursuant to the lease requirements.
FISCAL IMPACT:
There is no fiscal impact to the City with the approval of the lease as the lessee will continue to maintain the property until the signalization project is constructed.
