Subject: Meadowood Development Agreement Extension Request RECOMMENDED ACTION:
Approve a one-year extension of the Meadowood Development Agreement expiration date.
BACKGROUND:
At the December 2022 City Council meeting, the City Council approved a Development Agreement amendment for the Meadowood Residential development project. Essentially, the amendment allowed additional time for owners/developers to commence construction on their projects. The approved amendment allowed owners/developers an initial five (5) years to start construction of their project instead of three (3), with an option to apply for 1-year extensions for the remainder of their development agreement term, upon approval by the City Council.
The Meadowood Development Agreement was approved in February of 2018, putting the agreement now into its 6th year. Pursuant to the amended development agreement performance clause, after the initial five (5) years given to commence the project, the Developer is entitled to ask for one (1) year extensions for the remainder of the ten (10) year agreement. The City Council may grant or deny any such extension request in their sole discretion.
DISCUSSION/ANALYSIS:
Lennar recently purchased the Meadowood project and has begun work on the development, Subdivision Improvement Agreement and plan check process. The Tentative Map is scheduled to expire on December 31, 2024. Given the recent acquisition of the property by Lennar Homes, this letter serves as their formal request for a 1-year time extension to allow sufficient time to complete the process for approval of the Final Map, which is permitted under the amended Development Agreement.
Staff has reviewed their request, and believes the original and amended Development Agreement is still in the best interest of the City for development in that area. Therefore staff is recommending approval of their extension request.
FISCAL IMPACT:
There is no fiscal impact identified to the City in granting this requested extension.
