City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Ken Zuidervaart, Planning Director
Date: 01/14/2025
Subject: Abandonment - 923 S. Acacia Avenue
RECOMMENDED ACTION:
This resolution declares the intention of the City of Ripon to abandon a portion of public rightof-way adjacent to the property located at 923 South Acacia Avenue and forwards the matter to the Planning Commission to determine if it conforms to the City’s General Plan goals and policies.
BACKGROUND:
At the July 15, 2024 Planning Commission meeting, the Commission approved a Major Site Plan Permit (SR24-42) to construct a contractors yard consisting of two (2) 2,800 square foot buildings, which consists of twelve (12) office spaces and a storage warehouse located at 923 South Acacia Avenue. During review of the project, staff discovered that the City of Ripon owns a small portion of right-of-way across the property frontage (extra right-of-way), which is not needed for the ultimate improvements planned for South Acacia Avenue. As such, one of the conditions of approval required the applicant to submit a right-of way abandonment application in order to facilitate the ultimate improvements for both the project and the ultimate alignment of Acacia Avenue. On December 18, 2024, the applicant did submit an abandonment application pursuant to their project conditions of approval.
DISCUSSION/ANALYSIS:
Abandonment procedure:
1. This action first requires that City Council adopt a resolution of intention to abandon a portion of public right-of-way. The resolution of intention to abandon said right-of-way, then sends the abandonment request to the Planning Commission.
2. The Planning Commission shall review the proposed abandonment for consistency with the City’s General Plan and will forward its recommendation to the City Council for approval of the abandonment at a public hearing. The Planning Commission meeting to consider this matter is scheduled for the February 18, 2025 Planning Commission meeting.
3. The City Council will hold a public hearing on this matter, which is scheduled for the March 11, 2025 City Council meeting. Prior to the meeting staff will advertise notices of the public hearing in The Manteca Bulletin and at the site in accordance with the requirements of the Streets and Highways Code. An affidavit of posting will also be filed with the City Clerk. Should all utility agencies, affected parties, Planning Commission and City Council consider the abandonment favorably, a resolution ordering the vacation and abandonment of the public right-of-way adjacent to the property at 923 South Acacia Avenue will be recorded.
ENVIRONMENTAL REVIEW:
The proposed street abandonment is Categorically Exempt under Class 5, minor alterations in land use, of the current State of California Environmental Quality Act Guidelines.
PUBLIC NOTICE:
Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 hours prior to the meeting.
