MEMO
To: Honorable City Council
From: Kevin Werner, City Administrator
Date: 01/14/2025
Subject: South of Main Resurfacing Project Change Order #3 RECOMMENDED ACTION:

Approve Change Order No. 3 for regrading of Third Street, installation of reflective markers on Canal Boulevard and Highland Avenue, and additional materials used in slurry seal and 3-layer treatment of roads, in the not to exceed amount of $57,176.76 (funding source: Street & Road Operating Fund and Water Enterprise Capital Fund).

BACKGROUND:

The South of Main Resurfacing Project was awarded to American Pavement Systems, Inc. at the April 9, 2024 City Council meeting for an amount of $1,576,800.00. The South of Main Resurfacing Project includes the resurfacing of various streets in the area of Vera Avenue, Fourth Street, Seventh Street and Robert Avenue.

At the August 13, 2024 City Council meeting, Council approved Change Order No. 1 in the not to exceed amount of $337,976.83 for various changes to the South of Main Resurfacing Project contract documents along with the reconstruction of Third Street.

At the November 12, 2024 City Council meeting, Council approved Change Order No. 2 in the not to exceed amount of $85,431.50 for removal and replacement of striping on South Highland Avenue and Canal Boulevard.

DISCUSSION:

The South of Main Resurfacing Project has the following recommended contract changes:
 Regrading of Third Street after water main replacement. o The grading of Third Street was completed prior to the decision to replace the water main that was in need of replacement. Once the contractor completed the water line and service connections to the properties along Third Street, the roadway needed to be re-graded.
o The cost of this change order is $12,228.18 and paid for through the Water Enterprise Capital Fund.
 Placement of reflectors along South Highland Avenue and Canal Boulevard. o City standards require the placement of blue reflectors along the centerline of roadways to show locations of fire hydrants. The original work to replace the striping did not include this requirement.
o The cost of this change order is $6,930 and paid for through the Street & Road Operating Fund.
 Additional material used above estimated amounts for slurry seal and 3-layer system treatments.
o The City bid forms require contractors to bid a unit price for an estimated quantity of materials to complete the contract improvements. During the construction of the project, contractors are required to track the actual quantity of materials used to complete the contract improvements. Once the quantity of material is verified by City staff, the contract cost is re-calculated using the actual quantity and the unit price included in the bid.
o The cost of this change order is $38,018.58 and paid for through the Street & Road Operating Fund.

FISCAL IMPACT:

The attached Change Order No. 3 is in the amount of $57,176.76 and will be funded through the Water Enterprise Capital Fund ($12,228.18) and the Street & Road Fund Operating Fund ($44,948.58). The current balance of the Water Enterprise Capital Fund and the Street & Road Operating Fund are $7,906,601 and $5,348,393 as of June 30, 2024, respectively. The amended construction contract price is shown in Table 1.
