MEMO
To: Honorable City Council
From: Ken Zuidervaart, Planning Director

Subject: Partial Right-of-Way Abandonment - 923 South Acacia Avenue RECOMMENDED ACTION:
Staff recommends that the City Council adopt the Resolution declaring the vacation and abandonment of a portion of public right-of-way adjacent to the property located at 923 South Acacia Avenue.
BACKGROUND:
At the July 15, 2024 Planning Commission meeting, the Commission approved a project to develop the property located at 923 South Acacia Avenue. During the project’s review, it was discovered that the City of Ripon owned a small section of right-of-way in front of this parcel that ultimately is not needed for the proposed alignment/improvements of South Acacia Avenue.
Consequently, the applicant submitted an abandonment application on December 8, 2024, for the abandonment proposal.
DISCUSSION:
The City Council is required to go through a three-step process to abandon public right-of-way, as described below:
Step 1: City Council to approve abandonment. On January 14, 2025, the Ripon City Council approved the abandonment of the City right-of-way as described in the attached exhibits and located adjacent to 923 South Acacia Avenue.
Step 2: Planning Commission to approve abandonment. On February 18, 2025, the Ripon Planning Commission approved the abandonment of the City right-of-way as described in the attached exhibits and located adjacent to 923 South Acacia Avenue.
Step 3: Public Hearing. Tonight’s public hearing is the final step in the abandonment procedure.
After considering any public comments, City Council to consider approving the attached resolution ordering the vacation and abandonment of the public right-of-way for recordation.
Staff reached out to all the utility companies to inquire if any had utilities within the right-ofway. The City received no objections regarding this abandonment proposal.
ENVIRONMENTAL REVIEW:
The proposed public right-of-way abandonment is Categorically Exempt under Class 5, minor alterations in land use, of the current State of California Environmental Quality Act (CEQA) Guidelines.
