City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Kevin Werner, City Administrator
Date: 04/08/2025
Subject: Padilla & Associates, Inc. - DBE
RECOMMENDED ACTION:

Approve and authorize the Mayor to sign the agreement with Padilla & Associates, Inc. for Disadvantage Business Enterprise (DBE) annual reporting requirements as mandated for federally funded projects in the not to exceed amount of $4,515.00 (funding source: Street and Road Operating Fund).

BACKGROUND:

The City of Ripon must comply with the Code of Federal Regulations and Caltrans procedures regarding Disadvantaged Business Enterprises (DBEs) as a condition of receiving federal funds.

As part of these requirements, the City must submit a completed Local Agency DBE Annual Submittal Form (Exhibit 9-B) to Caltrans by June 30 each year, following the end of the federal fiscal year. Additionally, for each federally funded construction project, the City is required to establish contract-specific DBE goals.

The DBE program is designed to ensure that federally assisted contracts for highway, transit and aviation projects provide opportunities for small businesses owned and controlled by socially and economically disadvantaged individuals.

DISCUSSION/ANALYSIS:

Staff requested a proposal from Padilla & Associates, Inc. to perform DBE-required services for FY 2025-2026 and FY 2026-2027. The firm has previously assisted the City with DBE requirements successfully. A proposal outlining the necessary tasks for the City’s DBE program has been submitted and is attached as Exhibit A.

FISCAL IMPACT:

The cost of consulting services for DBE-required tasks in FY 2025-2026 and FY 2026-2027 will be paid for through the Street and Road Operating Fund. The attached services agreement with Padilla & Associates, Inc. is for a not to exceed amount of $4,515.00.
