City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Ken Zuidervaart, Planning Director
Date: 04/08/2025
Subject: Meadowood Development Agreement - Amendment No. 2 RECOMMENDED ACTION:

Should the City Council agree with Staff’s recommendation, the following motion would be appropriate:
“The City Council approves the Second Amendment to the Meadowood Development Agreement, and directs staff to process and record the appropriate documents to facilitate the amendment.”
BACKGROUND:

Section 5 of the Meadowood Development Agreement along with certain attachments spelled out maintenance and ownership responsibilities regarding the Home Owners Association (HOA) and Landscape Maintenance District (LMD) for the project. After reviewing the improvement and landscaping plans for the project and discussing maintenance responsibilities with Lennar Homes (Developer) it became evident that certain adjustments were needed to the Development Agreement regarding those responsibilities.

DISCUSSION/ANALYSIS:

Staff did meet internally and with the Developer regarding these matters. At the conclusion of the meetings it was decided to adjust certain language and exhibits in the Development Agreement defining these responsibilities. Essentially, the City will be maintaining all landscape areas outside of the project boundaries and all of the masonry walls outside and inside the project. All of these responsibilities will be funded through a LMD which will be established prior to project final. The HOA will maintain all landscaping and amenities within the project boundaries, including the paseo landscaping, subdivision entry feature, tot lot, all front and street side yard landscaping for the residential lots and all interior vinyl fencing for the residential lots.

The proposed changes to the Development Agreement and associated attachments will facilitate these changes in responsibilities.

FISCAL IMPACT:

There is no fiscal impact since the expense of the City maintaining the additional area will be funded through the LMD.
