City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Kevin Werner, City Administrator
Date: 08/12/2025
Subject: Lennar Subdivision Improvement Agreement - Amendment No. 1 RECOMMENDED ACTION:

Approve and authorize the Mayor to sign Amendment No. 1 of the Subdivision Improvement Agreement between the City of Ripon and Lennar Homes of California that assigns the obligations of the South San Joaquin Irrigation District (SSJID) Master Encroachment Agreement to Lennar Homes of California.

BACKGROUND:

Lennar is currently developing the Meadowood residential project west of Fulton Avenue. As part of this project, Lennar is responsible to construct improvements as conditioned in the Development Agreement and Subdivision Improvement Agreement, which includes the expansion of Fulton Avenue from a 2-lane roadway to a 4-lane roadway, landscape improvements, utility connections, and the joint utility trench.

These improvements are located within an SSJID easement (see attached Exhibit D). Lennar is requesting that the City of Ripon assign to Lennar the rights granted under the existing Master Encroachment Agreement between the City and SSJID.

DISCUSSION:

The City and SSJID entered into a Master Encroachment Agreement on May 14, 2019. This agreement does allow the City to assign or transfer the rights created by the Master Encroachment Agreement to other entities with the consent of SSJID.

Staff has drafted an amendment to the Subdivision Improvement Agreement between the City and Lennar, which formally transfers the obligations of the Master Encroachment Agreement from the City to Lennar (see attached).

Staff recommends the City Council approve Amendment No. 1 between the City and Lennar, authorizing staff to take the necessary steps to assign the City’s Master Encroachment Agreement to Lennar.

FISCAL IMPACT:

None.
