City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: Kevin Werner, City Administrator
Date: 10/14/2025
Subject: Pereira Plan Check Fee Agreement
RECOMMENDED ACTION:

Approve and authorize the Mayor to sign the Plan Check Fee Agreement between JKB Living, Inc. and the City of Ripon that will allow the City’s Engineering Department to begin reviewing the Pereira Residential Development Project’s civil improvement plans.

BACKGROUND:

The Pereira Residential Development Project (“Project”) is a single-family residential development planned on the property located on the north-east intersection of North Ripon Road and Boesch Drive. The Project includes the construction of 47 homes along with the various infrastructure improvements to support the development.

The Project was initially approved on March 10, 2020. On February 13, 2024, the City Council approved the Assignment and Assumption Agreement allowing JKB Living, Inc to purchase the Project and land.

The Planning Commission included the following Condition of Approval:

Proponent shall enter into a Subdivision Improvement Agreement with the City of Ripon.

This will incorporate all right-of-way and public utility easements, improvement security, plan check and oversight fees and general items required by the City. The agreement will need to be in place prior to the improvement plan review.

DISCUSSION:

JKB Living, Inc is not able to enter into the Subdivision Improvement Agreement until they obtain a loan for the project. As part of the loan approval process, the bank is requesting the budget for civil improvements, which relies on the civil improvement plans that are normally approved by the City Engineer after the Subdivision Improvement Agreement is approved by the City Council.

In order to complete the review and approval process for the civil improvement plans prior to the Subdivision Improvement Agreement, JKB Living, Inc is requesting the City enter into a Plan Check Fee Agreement that would allow the Engineering Department to begin the review and approval process for the civil improvement plans associated with the Project.

Attached is a Plan Check Fee Agreement that allows JKB Living, Inc to pay the nonrefundable plan check fee of $136,733 for the City Engineering Department staff to move forward with the civil improvement plan approval process, in accordance with the Conditions of Approval of the Development Agreement dated April 14, 2020 and the conditions of the approved Tentative Subdivision Map #S19-01.

Once the loan is approved, JKB Living, Inc would move forward with the Subdivision Improvement Agreement that will collect the remaining fees associated with the Project, provide the security for the improvements within the public right-of-way, and specify any other requirements of the Project.

Staff is recommending the City Council approve and authorize the Mayor to sign the attached Plan Check Fee Agreement and authorize staff to proceed with reviewing the civil improvement plans.
