City Council
259 N. Wilma Avenue
Ripon, CA 95366
MEMO
To: Honorable City Council
From: James Pease, Public Works Director
Date: 04/14/2026
Subject: Nestle USA, Inc. Access Agreement
RECOMMENDED ACTION:

Approve and authorize the Mayor to sign the Access Agreement with Nestle USA, Inc. to install a groundwater monitoring well on City property (City Hall) under direction and oversight from the Central Valley Regional Water Quality Control Board (“Water Board”).

BACKGROUND:

For more than 30 years, Nestle USA, Inc. has been working under the direction of the Water Board to monitor Ripon’s groundwater and remediate the compounds associated with the decaffeinated coffee production - Trichloroethylene (TCE) and its breakdown product known as cis-1,2-Dichlorethylene (cis 1,2 DCE) - at the now closed Nestle facility that was located on Industrial Avenue.

DISCUSSION/ANALYSIS:

The Water Board is requiring Nestle USA, Inc to install a monitoring well on City Hall property that will provide data regarding the movement of TCE and cis1,2 DCE in the groundwater near Municipal Well 10. This data will be used by Nestle USA, Inc and the Water Board to evaluate the effectiveness of current remediation facilities that are operating to protect Ripon’s drinking water.

Working with Nestle USA, Inc. staff has identified the location for the monitoring well in the landscaping strip located near Wilma Avenue. There will be no above ground facilities associated with this monitoring well.

The attached Access Agreement with Nestle USA, Inc. defines terms for the installation of the monitoring well, including:
 Term: Access Agreement shall be in place while the Water Board is requiring Nestle USA, Inc to have the monitoring well installed to collect data.  Decommissioning: Nestle USA, Inc. to decommission the monitoring well pursuant to State of California well standards. Additionally, Nestle USA, Inc. will restore surface conditions consistent with the surrounding landscape and/or hardscape after the well is decommissioned.
 Nestle USA, Inc to provide the appropriate insurance as recommended by the City’s risk management pool
FISCAL IMPACT:

None.
