Subject: J D E Engineering, Inc. Amendment No. 1
RECOMMENDATION:

Approve and authorize the Mayor to sign Amendment No. 1 to the Professional Services Agreement with J D E Engineering, Inc. to provide construction management and inspection services for various projects in a not to exceed amount of $20,000 (funding source: varies by construction project).

BACKGROUND:

At the September 9, 2025 City Council meeting, the City Council approved a Professional Services Agreement with J D E Engineering, Inc. to provide construction management and inspection services for various projects in a not-to-exceed amount of $30,000.

Since execution of the agreement, $27,675 has been billed, leaving a remaining balance of $2,325.

DISCUSSION:

Due to the continued construction workload associated with Capital Improvement and Private Development projects, there remains an ongoing need for professional assistance with construction management and inspection services. Because City staff resources are limited, supplementing staff with qualified consultants helps ensure projects proceed efficiently, safely, and in compliance with approved plans and specifications.

The consultant shall:
 Provide on‐call inspection services for public and private site and roadway work  Review contractor schedules and related construction activities

1.4.B
Packet Pg. 197
 Assist with the review of Requests for Information, material submittals, and payment applications
 Review change orders
 Perform other construction management and inspection tasks as requested by Engineering staff
The proposed amendment would continue retaining J D E Engineering, Inc. on an as-needed basis to provide qualified on-call construction management and inspection services in support of City staff.

FISCAL IMPACT
The attached Amendment No. 1 to the Professional Services Agreement with J D E Engineering, Inc. includes a detailed scope of services in Exhibit A, for a total not-to exceed amount of $20,000, increasing the total contract amount to $50,000. Expenses incurred under this agreement will be charged to the appropriate funding source for the project these services are provided.

Subject: 2026 Local Agency Biennial Notice
RECOMMENDED ACTION:

Approve the 2026 Local Agency Biennial Notice confirming the City’s Conflict of Interest Code and authorize the Mayor to execute the document in accordance with the Political Reform Act.

BACKGROUND:

The Political Reform Act requires local government agencies to review their conflict of interest codes every two years. A conflict of interest code identifies the public officials, employees, and consultants who must disclose certain financial interests by filing a Statement of Economic Interests (Form 700).

DISCUSSION/ANALYSIS:

In August 2014, staff conducted a comprehensive review of the City of Ripon’s Conflict of Interest Code. In June 2026, the City Council approved an amendment removing the Deputy City Attorney position from the code.

Other than that amendment, there have been no substantial organizational changes, including the addition, elimination, or re-classifying of positions, nor have there been substantial changes to the duties or responsibilities of designated positions.

Therefore, staff is recommending the City Council approve the 2026 Local Agency Biennial Notice without additional changes.

FISCAL IMPACT:

There is no fiscal impact associated with filing the Biennial Notice.

Subject: Meadowood Subdivision Improvements
RECOMMENDED ACTION:

Accept the Meadowood Subdivision Improvements completed within the public right-of-way by Lennar Homes of California LLC.

BACKGROUND:

The Meadowood Subdivision is an 88-lot single-family residential development located along Fulton Avenue within the North Point Specific Plan area of the City of Ripon. The project was approved on February 13, 2018 under Development Agreement DA17-02 and Tentative Subdivision Map S17-02.

As a condition of project approval, the City of Ripon and Lennar Homes of California LLC entered into a Subdivision Improvement Agreement (SIA) governing the construction of required public improvements. The purpose of the SIA is to ensure that all improvements within the public right-of-way are constructed to City standards prior to acceptance by the City Council.

The following improvements are covered under the SIA:
 Fulton Avenue widening and full-width street improvements to City 102-foot right-ofway standard, including frontage improvement.  Paver streets, curbs, gutters, and sidewalks within the subdivision  Sanitary sewer, water, and storm drain infrastructure  Joint trench utilities (electric, gas, and telecommunications)  LED street lighting
 Landscaped medians along Fulton and Goodwin Drive
 Safe Routes to School improvements, including lighted crosswalks at roundabouts  Paseos and landscaping per the North Point Specific Plan

1.4.F
Packet Pg. 210
DISCUSSION:

The Meadowood Subdivision Improvements are now substantially complete and have been constructed in conformance with the approved Plans and Specifications.

Although all punch list items have been completed, a few follow-up items remain. Concrete flatwork and paver installations are excluded from this acceptance, as these improvements will be completed and inspected on a per-lot basis concurrent with the final inspection of each individual home. This has been excluded because during construction of the homes, additional damage is likely to occur to the concrete and pavers. By including these items as part of the final inspection of the home, it will avoid the developer making these repairs twice.

All conditions required by the SIA have been satisfied and the required improvements have been constructed in conformance with the approved plans and specifications. The required one-year maintenance bond and record drawings have been received. Therefore, the project is ready for City Council acceptance.

Subject: Ionna Development Agreement - 1504 Colony Road - Ordinance RECOMMENDED ACTION:

Waive the second reading, and adopt the ordinance approving the Development Agreement with Ionna LLC (DA26-08).

BACKGROUND:

On October 20, 2025, the Ripon Planning Commission approved the necessary entitlements for an Electric Vehicle Charging Station project located at 1504 West Colony Road, subject to conditions of approval. As part of that action, the applicant was required to enter into a Development Agreement with the City of Ripon prior to the issuance of building permits.

On April 20, 2026, the Planning Commission reviewed the proposed Development Agreement and adopted a recommendation that the City Council approve the agreement.

Development Agreements are utilized by the City to formalize project-specific requirements and ensure ongoing compliance with the conditions of approval associated with a project. The proposed Development Agreement does not introduce new requirements; rather, it memorializes the obligations and conditions previously established as part of the project’s entitlement.

DISCUSSION/ANALYSIS:

Since approval of the project entitlements, the applicant has been coordinating with City staff and advancing the project toward building permit issuance. Approval of the Development Agreement is a required procedural step prior to issuance of building permits.

The agreement is consistent with the previously approved project and incorporates all applicable conditions imposed by the Planning Commission. No substantive changes to the project are proposed through this agreement.

2.A
Packet Pg. 212
Approval of the Development Agreement will satisfy the remaining entitlement requirement and allow the project to proceed to the construction phase.

FISCAL IMPACT:

There is no fiscal impact associated with this action. Approval of the Development Agreement does not create any new financial obligations and is consistent with the original project approval.

MEMO
To: Honorable City Council
From: Ken Zuidervaart, Planning Director

Subject: Zoning Code Text Amendment for ADUs - Ordinance RECOMMENDED ACTION:

Adopt an ordinance amending Title 16, Chapter 16.86 (“Accessory Dwelling Units”) of the Ripon Municipal Code to ensure consistency with recent changes in State law.

The proposed amendments update Chapter 16.86 to reflect current State ADU requirements.

There are no changes from first reading to second reading. Following is the proposed Ordinance recommended for second reading and adoption.

BACKGROUND:

The City of Ripon last comprehensively updated its Accessory Dwelling Unit (ADU) regulations in April 2021. Since that time, the State of California has adopted numerous legislative changes related to ADUs, resulting in substantive updates to Government Code provisions governing ADU development.

As a result of these legislative changes, portions of the City’s current ADU ordinance are no longer consistent with State law and require amendment to ensure compliance. Failure to maintain a compliant ADU ordinance may result in the City being subject to State enforcement actions and limitations on local land use authority.

The proposed amendments to Chapter 16.86 have been prepared to align the Ripon Municipal Code with current State requirements while maintaining, to the extent allowed, local development standards and objective criteria.

DISCUSSION/ANALYSIS:

The proposed ordinance amendments update Chapter 16.86 of the Ripon Municipal Code to reflect changes in State law governing ADUs, including provisions related to ministerial review, development standards, and exemptions from certain local requirements.

2.B
Packet Pg. 235
The amendments are not intended to expand local discretion beyond what is permitted under State law, but rather to bring the City’s regulations into alignment with existing statutory requirements.

The Planning Commission conducted a duly noticed public hearing on April 20, 2026 to consider the proposed amendments to Chapter 16.86. During its review, the Commission expressed several policy concerns related to the limitations imposed by State law, including:
 Infrastructure Impacts:

State law restricts the City’s ability to collect development impact fees for certain ADUs, raising concerns regarding long-term impacts to water, sewer, roadway, and public service infrastructure.
 Neighborhood Parking and Street Congestion:

Limitations on requiring off-street parking may increase on-street parking demand and contribute to congestion within established residential neighborhoods.  Design Compatibility Limitations:

State law constrains local discretion, limiting the City’s ability to impose design standards that ensure new ADUs are fully compatible with existing neighborhood character.
 Increased Unit Density on Single-Family Parcels:

State law mandates the allowance of multiple ADUs on single-family properties, which may result in increased density and potential impacts to infrastructure capacity, neighborhood character, and overall quality of life.

While acknowledging these concerns, the Planning Commission recognized that the proposed amendments are required to comply with State law. Following discussion, the Planning Commission voted 5-0 to recommend approval of the ordinance to the City Council.

FINDINGS:

1. That the proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any applicable Master Plan, Specific Plan, any Specific Purpose Plan, and any other applicable plan adopted by the City of Ripon.

2. The proposed amendments are necessary to ensure consistency with State law governing accessory dwelling units.

3. The proposed amendments will not be detrimental to the public health, safety, or welfare.

ENVIRONMENTAL ANALYSIS:

The proposed ordinance amendments are exempt from the California Environmental Quality Act pursuant to Public Resources Code Section 21080.17, which provides a statutory exemption for

2.B
Packet Pg. 236
the adoption of an ordinance by a city or county to implement the provisions of Government Code Section 65852.2 related to accessory dwelling units.

The proposed amendments are intended solely to bring the City’s regulations into compliance with State law governing accessory dwelling units and do not involve the approval of any specific development project. Accordingly, the action is statutorily exempt from CEQA.
