RIVERBANK CITY COUNCIL / LOCAL REDEVELOPMENT AUTHORITY
AGENDA ITEM NO. 11.2
SECTION 11: NEW BUSINESS
Meeting Date: August 27, 2024
Subject: Resolution Amending the Permanent Local Housing Allocation (PLHA) Formula Allocation Plan
From: Marisela H. Garcia, City Manager

RECOMMENDATION
It is recommended that the City Council consider adopting a Resolution to amend the Permanent Local Housing Allocation (PLHA) Formula Allocation Plan originally approved in July 2020.

SUMMARY
At the Special July 16, 2020 City Council meeting, the Council adopted a Resolution approving the Five-Year Permanent Local Housing Formula Allocation Plan as part of our submittal of an application to the State Department of Housing and Community Development for the Permanent Local Housing Allocation (PLHA) Grant Program. The Plan was subsequently amended to allocate funding for the River Terrace (Ward Villas) Project. The City was awarded the grant and is seeking to amend the adopted plan in order to incorporate funding for Stanislaus Equity Partners for the Bridge Covenant Village Development.

BACKGROUND
The City applied for Permanent Local Housing Allocation funds in July 2020 and was successfully awarded funds to be expended over a five-year period. The City’s Original Allocation Plan detailed which eligible activities the program funding may be used for.

Initially, the City desired that the funds be used for any combination of the following:

1. Ward Villas Affordable Housing Project. Funds to assist with the costs of the offsite improvements to maintain housing affordability for future buyers.

2. Assisting persons who are experiencing or at risk of homelessness, including, but not limited to, providing rapid rehousing, rental assistance, supportive/case

management services that allow people to obtain and retain housing, operating and capital costs for navigation centers and emergency shelters, and the new construction, rehabilitation, and preservation of permanent and transitional housing.

3. Accessibility modifications in Lower-income Owner-occupied housing.

4. Efforts to acquire and rehabilitate foreclosed or vacant homes and apartments.

5. Homeownership opportunities, including, but not limited to, down payment assistance.

The following five-year plan was approved in July 2020, and amended in 2021:

FUNDING YEAR ACTIVITY 2020 2021
2019 Affordable Rental or Housing Ownership 100% 100%
2020 Transitional Housing 20%
Housing Rehab Program 20%
Affordable Rental or Housing Project 100%
Housing Acquisition & Rehab 20%
First-Time Homebuyers 40%
2021 Transitional Housing 20%
Housing Rehab Program 20%
Housing Acquisition & Rehab 20%
First-Time Homebuyers 40%
Affordable Rental or Housing Project 100%
2022 Transitional Housing 20% 20%

2023 Transitional Housing 20% 20%
Housing Rehab Program 20% 20%
Housing Acquisition & Rehab 20% 60%
First-Time Homebuyers 40%
In October 2020 the City approved the Memorandum of Understanding between the City and the Ward Villas development for three-years of PLHA funding towards the project. Due to rising costs of construction and the increasing market value of homes,

Page 3 of 4 ends

Item 11.2 – CC/LRA 08/27/2024
the development was not able to fulfill the affordability requirements for lower income residents and subsequently agreed to refund $541,422.02 back to the City which was now available to use on other developments throughout the City.

In March 2024, Stanislaus Equity Partners reached out to the City requesting financial assistance to complete the project. As evidenced in the Funding Request provided, the project developers requested $250,000 from the City’s PLHA funds. After evaluating the project and based on the City Council’s adopted PLHA plan that would provide for the first three years of funding to be used towards Affordable Rental or Housing Ownership projects, we believed that this project was a good fit for the immediate use of the funds. As such, at the June 25th meeting, the City Council approved the allocation of two years of funding towards the project.

The PLHA program has revised their Plan Activities to distinguish between Rental & Ownership housing thus requiring an amendment to the plan to reflect that the funding will now be allocated towards an Affordable Rental Project (Activity 1 per the PLHA Guidelines) and not an Affordable Housing Ownership Project (Activity 2). As such, City staff proposes the following amended plan for approval and submittal to the State of California Department of Housing and Community Development:

Funding Year Activity % Allocation
2019 Activity 1 - Affordable Rental 100%
2020 Activity 1 - Affordable Rental 100%
2021 Activity 6 - Assisting Persons at Risk of
Homelessness – Transitional Housing

Activity 7 - Housing Rehab Program 20%
Activity 8 - Housing Acquisition & Rehab 60%

Item 11.2 – CC/LRA 08/27/2024
The 2021 Allocation will revert to the original allocation as it is no longer dedicated towards a specific project. Staff is recommending that we revisit this and the 2022 & 2023 allocation to see if it continues to meet the City’s goals.

FINANCIAL IMPACT
If awarded, the City is eligible to receive approximately $732,382 over the five-year period with the following allocations already having been calculated:

Year Allocation
2019 $122,063
2020 $193,021
2021 $206,039
Total $521,123

§302(c)(4)(C) Provide a description of how the Plan is consistent with the programs set forth in the Local Government’s Housing Element.

The plan has been designed to achieve the following goals established in the 2014-2023 City of Riverbank Housing Element: 1) GOAL 2: Encourage and assist in the development of adequate housing to meet the needs of extremely low-, low-, and very low-income households particularly as it relates to Program 2.1b: Continue to assist developers of extremely low-, low-, and very low-income housing in the grant preparation process to help fund their developments. The City assists developers by expediting review and approval of development applications to meet funding deadlines and providing information needed to support funding requests; 2) GOAL 4: Conserve and Improve the Condition of Existing Affordable Housing Stock as it relates to Program 4.1a which states that the City will continue to actively seek State and federal funding for the rehabilitation of homes; and 3) GOAL 5: Promote Housing Opportunities for All Persons Regardless of Race, Religion, Sex, Marital Status, Ancestry, National Origin, Color, Familial Status, or Disability as it relates to Program 5.1a which is to promote equal housing opportunities for all persons by having additional funding for the development of affordable housing and our housing programs.

Activities Detail (Activities Detail (Must make a selection on Formula Allocation Application worksheet under Eligible Activities, §301)) §301(a)(1) The predevelopment, development, acquisition, rehabilitation, and preservation of multifamily, residential live-work, rental housing that is affordable to extremely low-,very low-, low-, or moderate-income households, including necessary Operating subsidies. §302(c)(4)(E)(i) Provide a detailed and complete description of how allocated funds will be used for each proposed Affordable Rental Housing Activity.

Riverbank has committed $250,000 in PLHA funding towards the development of The Village, and 8-unit, Permanent Supportive, affordable housing project which will provide desperately needed housing within a safe community for low-income residents on the Bridge Covenant Church site on the corner of Morrill Ave. and Oakdale Rd. The homes are a combination of 2- and 4- bedroom units with full kitchens and laundry. The Village will also provide outdoor space and a playground for residents. Residents will be selected through the Center for Human Services (CHS) client placement process. All residents will meet the target population criteria of Youth who are Homeless or At Risk of Homelessness. At initial occupancy, all residents will meet the required criteria of household income being 30% or less of the area median income (AMI) and considered extremely low income. This project directly aligns with HCD's PLHA funding outcomes to: (1) increase the supply of housing for households at or below 60% AMI, (2) facilitate housing affordability, particularly for lower- and moderate-income households, and (3) projects and programs to meet the local government's unmet regional housing needs allocation.

Complete the table below for each proposed Affordable Rental Housing Activity to be funded with 2020-2023 PLHA allocations. If a single Activity will be assisting households at more than one level of Area Median Income, please list the Activity as many times as needed to capture all of the AMI levels that will be assisted, but only show the percentage of annual funding allocated to the Activity one time (to avoid double counting).

In order to eliminate blight within low-income sections of town, the City would like to acquire and rehabilitate foreclosed homes. This will allow for the home to be either 1) sold to a low-income resident who can participate in the City's First Time Homebuyer Program or 2) establish a location to provide transitional housing and case management services to the city's unhoused (homeless) population.
