Phase 7 – Equipment Pre-selection
BC to prepare request for proposals (RFPs) to pre-select the screw press, tertiary treatment system, and ultraviolet disinfection system. A formal request for proposals (RFP) will be prepared for each equipment package and reviewed by the City to confirm selection criteria and scoring and to develop the terms and conditions for prepurchasing equipment and assigning the terms and conditions to the selected Contractor. The RFP will contain an equipment specification, a formal equipment purchase agreement with terms and conditions and a form that the manufacturer will complete as part of their proposal. The RFP will be publicly advertised and sent directly to the known equipment manufacturers. BC will review the proposals and provide manufacturer recommendations to the City based on the evaluation criteria.

The evaluation criteria will include the following: Equipment Cost, Warranty Period, annual energy cost, annual recommended maintenance and associated labor costs.

Criteria will be scored based on weighing factors developed by BC in conjunction with the City of Riverbank. BC will then notify the manufacturers and will work with the City on a formal agreement for pre-purchasing equipment.

Phase 7 - Deliverables:
• Three (3) Draft and three (3) Final RFPs for the equipment packages Phase 7 - Assumptions:
• City of Riverbank/KSN will be responsible for the formal advertisement in the local media
• 10-day
• 30-day advertisement period for each RFP
Phase 8 – Final Design Services
BC to prepare plans and specifications to provide the 60% design phase of the project. Plans shall include General, Civil, Mechanical, Architectural, Structural, Demolition, Electrical and Instrumentation drawings. Specifications shall include only Technical Specifications for this submittal. Attachment A identifies the drawings and specifications that will be provided in this submittal. Drawings are to be prepared in Auto CAD 2016 format or newer. The project design work for this scope shall include a 60% design submittal package and an updated construction cost estimate and schedule. Additional surveying will be completed by Mark Thomas for the area between the adjacent park and the headworks where the new potable water line will be upsized. The additional survey work activities and deliverables will be as described in the original agreement. Crawford and associates will append the Geotechnical Report to provide specific structural recommendations to support the structural design.

The previously completed 30% design drawings will be used as the starting point for the 60% design submittal. The existing mechanical plan drawings will be modified with additional design detail and new drawings showing more sections and details. The 60% design submittal will add structural and electrical drawings to the submittal. The Civil drawings will be revised to include final surface profiles and piping profiles.

Item 11.2 – CC/LRA 09/24/2024

RIVERBANK CITY COUNCIL / LOCAL REDEVELOPMENT AUTHORITY
AGENDA ITEM NO. 11.2
SECTION 11: NEW BUSINESS
Meeting Date: September 24, 2024
Subject: A Resolution to Award a Contract Change Order for the 60% Design Phase Program Management and Project Permitting
Support for the Regional Recycled Water Project – Phase I to Kjeldsen, Sinnock & Neudeck, Inc., and Authorize a Budget Appropriation in the amount of $395,700.00 from the Sewer Fund 106 for FY 2024/2025
From: Marisela H. Garcia, City Manager
Submitted by: Cody Bridgewater, Public Works Director

RECOMMENDATION
It is recommended that the City Council award the contract for ongoing program management for the 60% design phase and permitting support for the Riverbank Regional Recycled Water Project – Phase I to Kjeldsen, Sinnock & Neudeck, Inc. (KSN), authorize the City Manager to execute a contract change order with said firm in the amount of $395,700.00 and authorize a budget appropriation from the Wastewater Enterprise Fund (Fund 106) for FY 2024/2025.

SUMMARY
Upon completion of the City of Riverbank Recycled Water Production Study and Recycled Water Use Study reports and completion of the 15% preliminary design, as directed by the City Council, applications for financial assistance for proceeding with the Phase I Regional Recycled Water Project (RRRWP) have been prepared and submitted to the State Water Resources Control Board under the Clean Water State Revolving Fund (CWSRF). An additional application has been submitted to the Federal Emergency Management Agency (FEMA) for funding under the Building Resilient Infrastructure and Communities (BRIC) Hazard Mitigation Assistance program. Based on submittal of these documents, completion of the California Environmental Quality Act (CEQA) documents, and establishing sewer rates to support the Project, advancing the design and permitting through the 60% level of detail is consistent with the overall project schedule, with projected design completion by the end of 2026.

Item 11.2 – CC/LRA 09/24/2024
As an ongoing project and program management support to the City, including providing peer review technical support and preparing and coordinating certain project permit applications and technical documents, Program Management services have been solicited from KSN. These services are consistent with the City’s selection of KSN following the Request for Qualifications (RFQ) process for on-call civil engineering services and KSN’s 2021 selection as the firm most qualified to provide the City’s on-call water, stormwater, and wastewater engineering, as well as KSN’s successful completion of the Recycled Water Study reports and preliminary design. Based on the proposed 30% design, staff has negotiated a fair and reasonable scope of services and budget with KSN for ongoing program management, permitting, and peer review assistance through the 30% design phase. Tonight’s request is to proceed with awarding the contract to KSN for providing ongoing program management for this phase according to the enclosed scope of services.

BACKGROUND
The City has completed 30% design for expanding the Wastewater Treatment Plant (WWTP) to produce recycled water as well as provide for capacity to meet expected wastewater treatment needs of the City for the next 30 years. The Phase I program would produce recycled water for use in south-eastern San Joaquin County, adjacent to the City’s WWTP. Wastewater generated within the City is the proposed source of recycled water in this proposed project and has the potential to capture and reuse wastewater to supplement fresh water sources, including in-lieu recharge of groundwater. The proposed project includes improvements to the City of Riverbank WWTP, and recycled water distribution facilities within the vicinity of the WWTP. It is envisioned that this water will be used to offset water used for agricultural needs.

The proposed 60% design effort will advance the details of design, including evaluating potential addition of grit removal and cost-efficient management of wastewater solids, and will support advancing the projects towards implementation. This 60% design is expected to take approximately 10 months to complete and therefore would advance the project design through approximately June 2025. During this advancement of design, the project permitting with the Regional Water Quality Control Board would be initiated and encroachment permitting with the BNSF railroad and San Joaquin County Public Works Department initiated.

Based on City staff’s review of KSN’s continued performance as Program Manager and selection as on-call civil engineering related to the City’s water, wastewater, and stormwater utilities, and the firm’s project manager experience and qualifications, contracting with KSN for this phase of Program Management is recommended according to the attached draft Consultant Agreement.

STRATEGIC PLAN
The RRRWP and this action addresses the following August 10, 2021 Strategic Plan Goals:

&
Riverbank Redevelopment Agency
Statement of Investment Policy
I. Introduction
The purpose of this document is to provide guidelines for the prudent investment of the City’s temporarily idle cash and outline policies for maximizing the efficiency of the City’s cash management system. The ultimate goal is to enhance the economic well-being of the City while protecting its pooled cash.

II. Scope
It is intended that this policy cover all short-term operating funds and investment activities of the City and the Redevelopment Agency. These funds are accounted for in the annual audit report, and include:
• General Fund
• Special Revenue Funds
• Debt Service Funds
• Capital Projects Funds
• Enterprise Funds
• Internal Service Funds
• Fiduciary Funds
This investment policy applies to all City and Redevelopment Agency transactions involving the financial assets and related activity of the above mentioned funds.

Any additional funds that may be created from time to time shall also be administered with the provisions of this policy and comply with current State Government Code.

Subject to the prior written consent and approval of the City Manager, City Treasurer or Director of Finance, financial assets held and invested by Trustees or Fiscal Agents are excluded from this policy. However, such assets are nevertheless subject to the regulations established by the State of California pertaining to investments by local agencies as well as the related bond indentures.

III. Prudence (Standard of Care)
The City of Riverbank operates its pooled idle cash investments under the prudent man rule (Civil Code Section 2261, et. seq.) which states, in essence, “In investing…property for the benefit of another, a trustee shall exercise the judgment and care, under the circumstances then prevailing, which men of prudence, discretion, and intelligence exercise in the management of their own affairs, not for speculation but for investment, considering the probable safety of their capital as well as the probable income to be derived.”
In addition, Government Code Section 53600.3 provides that those persons to whom investment decisions have been delegated are trustees with a fiduciary responsibility to act as a prudent investor.

The standard of prudence to be used by investment officials shall be the “prudent person” standard and shall be applied in the context of managing an overall portfolio. All persons investing, reinvesting, purchasing, acquiring, exchanging, selling and managing public funds shall act with care, skill, prudence and diligence under the circumstances then prevailing that a prudent person acting in a like capacity and familiarity with those matters would use in the conduct of funds of a like character and with like aims, to safeguard the principal and maintain the liquidity needs of the City.

It is the City’s intent, at the time of purchase, to hold all investments until maturity to ensure the return of all invested principal dollars but sales prior to maturity are permitted.

IV. Objectives
A. Investment Criteria
Government Code Section 53600.5 states:
“When investing, reinvesting, purchasing, acquiring, exchanging, selling and managing public funds, the primary objective of the trustee shall be to safeguard the principal of funds under its control.

The secondary objective shall be to meet the liquidity needs of the depositor. The third objective shall be to achieve a return on the funds under its control”.

The primary objectives, in priority order, of the City’s investment activities shall be safety, liquidity, and yield.

1. Safety
Safety of principal is the foremost objective of the investment program.

The City’s investments shall be undertaken in a manner that seeks to ensure preservation of capital in the overall portfolio. The City shall seek to preserve principal by mitigating two types of risk, credit risk and market risk. Investment decisions should not incur unreasonable credit or market risks in order to obtain current investment income. a. Credit Risk: the risk of loss due to failure by the issuer of a security.

The City will minimize credit risk by:
• Limiting investments to the safest types of securities • Pre-qualifying the financial institution's broker/dealers, intermediaries, and advisors with which the City will do business.
• Diversifying the investment portfolio so that potential losses on individual securities will be minimized.
b. Market Risk: the risk of market value fluctuations due to overall changes in the general level of interest rates.

The City will minimize market risk by:
• Structuring the investment portfolio so that securities mature to meet cash requirements for ongoing
operations, thereby avoiding the need to sell securities on the open market prior to maturity
• Investing operating funds primarily in shorter-term
securities, money market mutual funds, or similar
investment pools.

2. Liquidity
The investment portfolio shall remain sufficiently liquid to meet all operating requirements that may be reasonably anticipated. This is accomplished by structuring the portfolio so that securities mature concurrent with cash needs to meet anticipated demands (static liquidity). Furthermore, since all possible cash demands cannot be anticipated, the portfolio should consist largely of securities with active secondary or resale markets (dynamic liquidity). A portion of the portfolio will also be placed in money market mutual funds or local government investment pools which offer same-day liquidity for short term funds.

ATTACHMENT 2

3. Yield (Return on Investment)
The City’s investment portfolio shall be designed with the objective of attaining a market rate of return throughout budgetary and economic cycles, taking into account the investment risk constraints and liquidity needs. Return on investment is of secondary importance compared to the safety and liquidity objectives described above. The core of investments are limited to relatively low risk securities in anticipation of earning a fair return relative to the risk being assumed. Securities shall not be sold prior to maturity with the following exceptions:
• A security with declining credit may be sold early to minimize loss of principal.
• A security swap would improve the quality, yield or target duration in the portfolio.
• Liquidity needs of the portfolio require that the security be sold.

B. Performance Standards
The investment portfolio shall be managed with the objective of producing a yield meeting or exceeding the average return on the ICE BofA 0-5 year Treasury Index. This index is considered a benchmark for low to moderaterisk investment transactions. Therefore, they comprise a minimum standard for the portfolio’s rate of return. The investment program shall seek to augment returns above this threshold, consistent with risk limitations identified herein and prudent investment principles. This benchmark will be reviewed thoroughly and may be adjusted as required by market conditions to prevent incurring unreasonable risks to attain yield.

C. Diversification
The Investment Portfolio shall be diversified to prevent incurring unreasonable and avoidable risks regarding specific security types, individual financial institutions or maturity segments.

D. Public Trust
All participants in the investment process shall act responsibly as custodians of the public trust. Investment officials shall recognize that the investment portfolio is subject to public review and evaluation. The overall program shall be designed and managed with a degree of professionalism that is worthy of the public trust.

V. Delegation of Authority
The management and oversight responsibility for the investment program is hereby delegated to the City Treasurer and the Director of Finance who shall monitor and review all investments for consistency with this investment policy. The City Manager, Assistant City Manager, City Treasurer and Director of Finance shall jointly establish procedures to implement and monitor this investment policy. Such procedures shall include explicit delegation of persons responsible for investment transactions. No person may engage in an investment transaction except as provided under the limits of this policy.

VI. Selection of Eligible Financial Institutions and
Broker/Dealers
To provide for optimum yield on the City’s portfolio, the City’s procedures shall be designed to encourage multiple bids and offers on investment transactions from an approved list of brokers/dealers and financial institutions. The City Treasurer and Director of Finance shall maintain a list of authorized broker/dealers and financial institutions which are approved for investment purposes, in the State of California, and it shall be the policy of the City to purchase securities only from authorized institutions or firms. Such list will include the firm name, contact person, telephone number, and current audited financial statements. The investment guidelines and procedures shall identify the criteria under which brokers and dealers may qualify to conduct business with the City. If the City uses an adviser to purchase securities, the adviser must be SEC-registered, reputable, and qualified to provide the advisory services.

VII. Permitted Investment Instruments
Investment of City funds is governed by the California Government Code Sections 16429.1 and 53600 et. seq., as amended. Investments may not have a term or maturity at the time of investment of longer than that authorized by Section 53601 or five (5) years unless the City Council or the Redevelopment Agency has granted prior express authority.

It should be noted that while the Government Code specifies the maximum percentage of the portfolio which may be held in each type of investment at any one time, fluctuations in the portfolio balance will prevent strict adherence to such restrictions. Therefore, percentage limitations shall apply to investments at the time of purchase.

The following investments will be permitted by this policy and are those defined by state and local law where applicable:

IX. Maximum Maturity
Investment maturities shall be based on a review of cash flow forecasts. Maturities will be scheduled so as to permit the City to meet all projected obligations.

Investments that mature more than five years from the date of purchase cannot occur without prior approval of the City Council of Agency Board. As defined in Government Code Section 53601, “no investment shall be made in any security… that at the time of investment has a term remaining to mature in excess of five years, unless the legislative body has granted express authority to make that investment either specifically or as a part of an investment approved by the legislative body no less than three months prior to the investment.” Because of inherent difficulties in accurately forecasting cash flow requirements, a portion of the portfolio should be continuously invested in readily available funds.

Purchasing these types of instruments does not coincide with this policy’s objectives and would require a thorough review and monitoring of the underlying security.

By virtue of the allowable investment in the State Treasurer’s LAIF Pool, the City is investing idle cash with a large amount of government agencies. The Pool is managed by outside administrators and is subject of the Government Codes as well as policies put in place by their governing boards. Investment in the State pool is permitted, assuming a diminutive portion of their portfolio’s (10% or less) are tied to the high-risk products noted above. The Treasurer and Director of Finance are responsible for monitoring and reviewing the Pool funds portfolio on an ongoing basis. The City shall take any necessary action should the Pool exceed the allowable 10% limit. The necessary actions may include, but are not limited to, closing the account & transferring the funds to another bank, etc.

The internal control structure shall be designed to provide reasonable assurance that these objectives are met. The concept of reasonable assurance recognizes that (1) the cost of a control should not exceed the benefits likely to be derived and (2) the valuation of costs and benefits requires estimates and judgments by management.

XIII. Risk Tolerance
The City recognizes that investment risk can result from issuer defaults, market price changes or various technical complications leading to temporary illiquidity.

Portfolio diversification is employed as a way to minimize and control these risks.

• Limiting investments in securities that have higher credit risks, • Investing in securities with varying maturities, and
• Continuously investing a portion of the portfolio in readily available funds such as LAIF, JPA Funds, or money market funds to ensure that appropriate liquidity is maintained in order to meet ongoing obligations.

The Treasurer and Director of Finance shall annually render to the Council and Agency Board a statement of investment policy, which the Council/Agency shall consider at a meeting.

The policy shall be reviewed annually by the City Manager, City Treasurer, and Director of Finance to ensure its consistency with the global objective of preservation of investment principal, sufficient liquidity, rate of return and relevance to current laws and financial trends. Any modifications to the policy must be approved by the City Council/Agency Board.

Any State of California legislative action that further restricts allowable maturities, investment types or percentage allocations will be incorporated into the City’s Statement of Investment Policy and supersedes any and all previous applicable language. If the City is holding an investment that is subsequently prohibited by a legislative change, the City may hold that investment, if it is deemed prudent by the Treasurer, until the maturity date to avoid an unnecessary loss.

• Interest only strips that are derived from a pool of mortgages or any security that could result in zero interest accrual if held to maturity.

The pool’s investment policy may allow for investment in some of the prohibitions noted above for the City of Riverbank/Riverbank Redevelopment Agency.

XI. Reporting Requirements
Pursuant to Government Code Section 53646, the Treasurer shall render to the City Council/Agency Board a separate monthly investment report, which shall include, at a minimum, the following information for each individual investment:
• Type of Investment Instrument (i.e. Treasury bill, medium term note)
• Issuer Names (i.e., General Electric)
• Purchase Date (trade and settlement date)
• Maturity Date
• Par Value
• Current Rate of Interest
• Purchase Price
• Current market value and the source of the valuation
• Overall portfolio yield based on cost
• Weighted average days to maturity
The monthly report also shall (i) state compliance with of the portfolio to the statement of investment policy, or manner in which the portfolio is not in compliance, (ii) include a description of any of the City’s funds, investments or programs that are under the management of contracted parties, including lending programs, and (iii) include a statement denoting the ability of the City to meet its expenditure requirements for the next three months, or provide an explanation as to why sufficient money shall, or may, not be available.

This monthly report shall be submitted to the City Council and Agency Board within 30 days following the end of the month.

XII. Internal Controls
The Treasurer and Director of Finance are responsible for establishing and maintaining an internal control structure designed to ensure that the assets of the City are protected from loss, theft or misuse.

The investments shall be diversified by:
• Limiting investments to avoid an over concentration in securities from a specific issuer or business sector (excluding the Local Agency Investment Fund (LAIF) and U.S. Treasury securities,
• Limiting investments in securities that have higher credit risks, • Investing in securities with varying maturities, and
• Continuously investing a portion of the portfolio in readily available funds such as LAIF, JPA Funds, or money market funds to ensure that appropriate liquidity is maintained in order to meet ongoing obligations.

XIV. Policy Adopting Changes and Updates

Any State of California legislative action that further restricts allowable maturities, investment types or percentage allocations will be incorporated into the City’s Statement of Investment Policy

Item 11.4 – CC/LRA 09/24/2024

RIVERBANK CITY COUNCIL / LOCAL REDEVELOPMENT AUTHORITY
AGENDA ITEM NO. 11.4
SECTION 11: NEW BUSINESS
Meeting Date: September 24, 2024
Subject: Direction on the Proposed Tiny Home Development and Park on City-Owned Property Near the Intersection of Jackson Ave. and Stanislaus Street
From: Marisela H. Garcia, City Manager

RECOMMENDATION
It is recommended that the City Council receive an update on the proposed development to be located on city-owned property and provide feedback to staff regarding the use of the site for a tiny home village permanent supportive housing development or a park.

SUMMARY
Prior conversations with both the City Council and Planning Commission regarding the best use of the city-owned property located at Jackson Ave. and Stanislaus Street have provided varied feedback as to the best use of the site. Tonight, we are asking for feedback regarding the site in order to allow the City to move forward based on Council’s direction.

BACKGROUND
At the April 12, 2022 meeting, City Council authorized the purchase of APN 075-005-025 and 075-005-013 which are the properties located off of Jackson Ave. and Stanislaus St.

As reflected in the staff report authorizing the purchase (Attachment 1) “the intent of the purchase of the Jackson & Stanislaus properties is to allow the City to implement Phase II of its Strategic Plan Objective to assist our homeless population. The property will allow the City to develop a tiny home village which will provide transitional housing, at low cost, to our residents as they continue to move through the program with Cambridge Academies. This plan, as well as other potential uses of the property, will be discussed further with the City Council once the purchase is finalized.”

Page 2 of 4 ends

Item 11.4 – CC/LRA 09/24/2024
On June 26, 2023, the City of Riverbank released a Request for Proposal (RFP) for development of a tiny home village located on this city-owned property. The purpose of the RFP is to fulfill a part of the City of Riverbank’s Strategic Plan to partner with nonprofit partners to develop programs/solutions for homeless services. With that in mind, the City Council created a vision that homeless residents have access to a full-service program. The city bought the two parcels to create transitional housing with the idea of creating more housing options for those experiencing homelessness. As a part of the RFP, “the City Council feels that it is important to incorporate an open space/ park area that will help to provide recreation opportunity for all residents in the neighborhood as there are no parks in that area. This park should be open to the public.” The total property consists of an estimated 2.08 acres. In discussion about potential designs of how the 2.08 acres will be developed, a preliminary plan was submitted to the city for review. The initial draft of the plan consisted of 24 homes, a supportive service building, community garden, dog park, a common area, and parking (Attachment 2).

In addition, the plan reflected a park site that was approximately 0.12 acres and would have a playground, BBQ, shade structure, and restroom facility. The General Plan has a policy which provides for a typical neighborhood park to be approximately 1.5 acres per 1,000 residents. Based on this standard, the initial park proposal would only be able to service approximately 80 residents, which would only serve the development. It was the City’s intention to be able to serve more residents from the neighborhood as there is no park space in the vicinity, but the proposed space would be too small to accommodate that intent.

CITY COUNCIL FEEDBACK
After reviewing the initial design, at the February 13, 2024 meeting the Parks & Recreation Director brought forth an item to discuss various options regarding the proposed park space. Options included the following:

1. Continue with the proposed plan of the park space at 0.12 acres which will be inadequate to meet the city’s need of a neighborhood park,

2. Increase the park size which would better suit the needs of the neighborhood but that would decrease the number of tiny homes to be constructed, or

3. Eliminate the park feature which will have the developer pay the city park in-lieu fees for future development and create more space to construct additional tiny homes.

A summary of the feedback from the Mayor & City Council Members, except Council Member Barber-Martinez who recused herself from this item, was as follows:

Council Member Uribe: Would like to see the park open for the community and units to the left or right of the proposed “park space” eliminated to add park space to at least a quarter acre.

Council Member Hernandez: Prioritize adding park space for Districts 1 and District 2.

Not in favor of taking away units but making it work.

Page 3 of 4 ends

Item 11.4 – CC/LRA 09/24/2024
Vice Mayor Jones Cruz: Leave as green space only to make available to the public.

Mayor O’Brien: Leaving the area as simply green space does not service the residents as they may not have children, and we would be able to add two additional units.

Brad Hawn, representing the development team, proposed the option of proactively looking for additional space that may be adequate for a park.

As noted, the feedback was varied but each recommendation desired the inclusion of green space in the vicinity, whether on-site or at an adequate site in the neighborhood.

PLANNING COMMISSION FEEDBACK
At the February 20, 2024 meeting, the Planning Commission discussed and agreed that the proposed park site would be best suited to serve the tiny home community as a gathering area for the residents and not to have it as a public park due to the small size.

The minutes to the meeting are included in this report as Attachment 4.

ALTERNATE SITES EXPLORED
Both the housing developers and city staff evaluated the potential for the purchase of property north of the Jackson/Stanislaus Property. Unfortunately, the property owners were interested in the possibility of developing their land for housing.

CURRENT DEVELOPMENT SITE PLAN
Based on Planning Commission feedback, the development team submitted the proposed updated Site Plan (Attachment 5) which does not include an open park space. This allowed them to increase the number of units to 39, with the following configurations:

TYPE # OF UNITS SQUARE FOOTAGE
STUDIO APARTMENTS 16 350
1-BEDROOM 8 435
2-BEDROOM 15 741.5
The current configuration allows for maximizing the use of the site for a permanent supportive housing program and anticipates that the developer and the City would both continue to pursue the acquisition of a site for a park in this neighborhood.

The development team has reached a point in their proposal where certainty with respect to the use of the site is required in order for them to be able to move forward with seeking grant funding that has become available through the State of California Proposition 1 funding.

Page 4 of 4 ends

Item 11.4 – CC/LRA 09/24/2024

OPTIONS TO CONSIDER
Based on the need to have certainty on this project, staff is recommending the following options:

1. Allow the development to proceed with the current development site plan thereby allowing the development team to begin work on grant applications and finalizing agreements between the City and the developer.

2. Make the entire site a park area for the benefit of the neighborhood. This would allow the City to encumber the $200,000 from the American Rescue Plan Act towards this project.

STRATEGIC PLAN
This item is directly related to the City Council’s Strategic Plan Goal to “Enhance Quality of Life.”

FINANCIAL IMPACT
While there is no direct financial impact associated with this report, based on the recommended path the City will either seek grant funding for the proposed housing development or allocate other city funds towards the construction of a park.
