FIRST AMENDMENT TO AGREEMENT FOR
LANDSCAPE MAINTENANCE SERVICES
(Annual Landscape Maintenance of Various City Facilities) SO CAL LAND MAINTENANCE, INC.
This FIRST AMENDMENT TO AGREEMENT FOR LANDSCAPE MAINTENANCE SERVICES ("First Amendment") is made and entered into this _ _day of 2021, by and between the CITY OF RIVERSIDE, a California charter city and municipal corporation ("City"), and SO CAL LAND MAINTENANCE, INC., a California corporation, State Contractor's License No. 960258 ("Contractor"), with reference to the following facts:
RECITALS
A. WHEREAS, on November 30, 2020, City and Contractor entered into that certain Agreement for Landscape Maintenance Services ("Agreement") for the two-year term beginning January 1, 2021 and ending December 31, 2022; and
B. WHEREAS, City and Contractor desire to amend the Agreement to expand the scope of Contractor's services to two additional City facilities, the New Main Library, located at 3900 Mission Inn Avenue, and the Riverside Access Center, located at 2880 Hulen Place; and WHEREAS, City and Contractor desire to amend the Agreement to increase the compensation paid by City during the Agreement term, in consideration for the expanded scope of services, from $273,497.16 to $338,063.71.
NOW THEREFORE in consideration of the foregoing recitals, which are incorporated herein by this reference, City and Contractor mutually agree as follows:
1. Paragraph 3 of the Agreement, "Compensation", is hereby deleted and replaced with the following:
"3. Compensation. City shall pay Contractor for the performance of the Services during the initial term of this Agreement a Contract Price in the amount of Three Hundred Thirty Eight Thousand Sixty Three Dollars Seventy One Cents ($338,063.71). City shall pay Contractor for Services performed to City's satisfaction on a monthly basis in accordance with the provisions of the RFP and the Compensation Schedule, attached hereto as Exhibit "A-1" and incorporated herein by this reference."
12. Exhibit "A" of the Agreement is hereby replaced with Exhibit "A-l", attached hereto and incorporated herein by reference.
3. All terms and conditions of the Agreement not inconsistent herewith shall remain in full force and effect, and are hereby incorporated by reference into this First Amendment as though set forth in full herein.
