RESOLUTION NO. 20840
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE, CALlFORNIA, RECITING THE FACT OF TIIE SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON THE 2ND DAY OF NOVEMBER,
2004, DECLARING THE RESULTS THEREOF AND SETTING FORTH
SUCH OTIIER MA TIERS AS ARE PROVIDED BYLAW.
5 WHEREAS, a special municipal election was held and conducted in the City of Riverside on 6 the 2nd day of November, 2004, as required by law; and 7 WHEREAS, notice of said election was duly and regularly given in the time, form and 8 manner as provided by law; voting precincts were properly established; election officers were 9 appointed and in all respects said election was held and the returns made and declared in the time, 10 form, and manner as required by the provisions of the Charter of the City of Riverside and the 11 Elections Code of the State of California for the holding of public elections in the City of Riverside; 12 and
13 WHEREAS, pursuant to Resolution No. 20751 adopted on the 27th day of July, 2004, the 14 appropriate county official canvassed the returns of said election and has certified the resuhs to this 15 City Council and said results are received, attached and made a part hereof as Exhibit "A"; 16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Riverside, as 17 follows:
18 Section 1: That there were 103 voting precincts established for the purpose of holding said 19 election consisting of the consolidation of the regular election precincts in the City of Riverside as 20 established for the holding of state and county elections. 21 Section 2: That said special municipal election was held for the purpose of submitting to the 22 qualified electors of the City of Riverside the question as to whether proposed Charter amendments 23 known as Measures BB through MM and more particularly described in Section 1 of Resolution No. 24 2075 l of the City of Riverside, should be approved. 25 Section 3: That the full number of votes cast in said City election, excepting therefrom absent 26 voter ballots was 55,704; that the whole number of absent voters ballots cast in said City election was 27 26,412; and that the total of all votes cast in said City election was 82,116. tJ_Attoruey's Omcc

Shall the Charter of the City of Riverside be amended by amending the Preamble, changing the title of Article II, and correcting typographical errors in Sections 1110 and 1111? MEASURE CC - Approved by voters
Shall the Charter of the City of Riverside be amended to (1) add Section 201, "Access to public meetings and public records"; (2) provide that meetings of ad hoc Council committees be open to the public and that closed session Council meetings be audio recorded: (3) provide that citizens shall have the right to make comments at ad hoc Council committee meetings; and ( 4) provide that the City Clerk help the public examine and copy public records? MEASURE DD - Approved by voters
Shall the Charter of the City of Riverside be amended by adding a new Section 202, entitled "Adoption of ethics code," which would require the City of Riverside to adopt within six months a Code of Ethics and Conduct?
MEASURE EE - Approved by voters
Shall the Charter of the City of Riverside be amended to (l) provide that increases to the compensation of the Mayor and City Council be limited to five percent every two years; and (2) eliminate the Mayor and Council members salary commission? MEASURE FF - Measure Failed
Shall the Charter of the City of Riverside be amended to provide that the Mayor shall appoint the chairperson to all City Council standing committees? MEASURE GG - Approved by voters
Shall the Charter of the City of Riverside be amended to provide that each City board or commission sha11 have at least one member from each Council Ward? MEASURE RH-Measure failed
Shall the Charter of the City of Riverside be amended to provide that minors may be appointed -2-

MEASURE II - Approved by voters
Shall the Charter of the City of Riverside be amended to add a new Section 810, entitled "Community Police Review Commission" which would add the Community Police Review Commission to the Charter?
MEASURE JJ - Measure failed
Shall the Charter of the City of Ri versicle be amended to allow the City Council ( 1) to conduct an election for a bonded indebtedness by a mail-ballot election; and (2) to sell such bonds, notes or other evidences of indebtedness at public sale by notice inviting bids or be negotiated private sale?
MEASURE KK - Approved by voters
Shall the Charter of the City of Riverside be amended to ( 1) provide that bids on public works contracts can be accompanied by such other fonn of bidder's security as the City Council established by ordinance; and (2) add a new Section 1114, entitled "Use of design-build procurement for public works projects"?
MEASURE LL - Approved by voters
Shall the Charter of the City of Riverside be amended to provide that the City Council change its independent auditor at least every five years?
MEASURE MM - Approved by voters
Shall the Charter of the City of Riverside be amended to (1) allow the board of public utilities to award and execute contracts for construction, goods or services for the public utility; (2) allow the director of public utilities to approve work to be done at the request and expense of customers; and (3) allow the director of public utilities to negotiate and execute contracts with individual retail customers for water, electric and any other utility services? That the number of votes given at each precinct and the number of votes given in the City for and against each Measure are listed on the attached Exhibit "A".

1 voting on Measures BB, CC, DD, EE, GO, II, KK, ll, and MM, voted in favor thereof, and, pursuant 2 to the Constitution of the State of California and the laws of the State of California, Measures BB, CC, 3 DD, EE, GG, II, KK, ll, and MM are declared to have carried. 4 Section 6: The City Council does declare and determine that a majority of the qualified voters, 5 voting on Measures FF, HH, andJJ voted against thereof, and pursuant to the Constitution of the State 6 of California and the laws of the State of California, Measures FF, HH, and JJ are declared to have 7 failed.
8 Section 7: That the City Clerk shall enter on the records of the City Council of said City a 9 statement of the results of the special municipal election held on November 2, 2004, showing:
10 (1) The whole number of votes cast in the City;
11 (2} The Measures voted on;
12 (3) The number of votes given in the City for and against each of said Measures. 13 Section 8: That the City Clerk of the City is hereby directed to enter this resolution in full 14 in the minutes of the City Council.
