RECOMMENDATIONS
Staff recommends that the Planning Commission:

1. RECOMMEND that the City Council DETERMINE that the project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061.b.3 (Common Sense Exemption) and 15301 (Existing Facilities) of the CEQA Guidelines, as the project will not have a significant effect on the environment; and

2. RECOMMEND that the City Council APPROVE Planning Case PR-2021-001082 (Zoning Code Amendment and Minor Conditional Use Permit) based on the findings outlined in the staff report and summarized in the attached findings and subject to the recommended conditions (Exhibits 1 and 2).

SITE BACKGROUND
The project site is developed with a 51,565 square foot vacant office building, formerly the Amtrak reservation call-center (Exhibit 3). Surrounding land uses include a parking lot to the north, a self- storage facility to the south, vacant land and ligh t industrial uses to the east (across Lindbergh Drive), and vacant land and single-family residential to the west (Exhibit 4).

As a matter of information, related Design Review (PR-2021-001220) request to facilitate a façade remodel and site improvements was considered by the Development Review Committee on March 9, 2022. The Development Review Commi ttee concurred that the project is approved, subject to the conditions of approval from each Department/Division.

PROPOSAL
The applicant is requesting approval of a Zoni ng Code Text Amendment and Minor Conditional Use Permit to facilitate a Tesla dealership with outdoor display of vehicles and indoor vehicle repair. Following is a summary of each component of the proposal:

Proposed Zoning Code Text Amendment
The Zoning Code Text Amendment is proposed as clean energy uses can conveniently fulfill the needs of and complement surrounding businesses in industrial areas. The proposal would amend:
o Article V, Chapter 19.130 – Industrial Zones (BMP, I, AI and AIR), Section 19.130.010 - Purpose: Revise the purpose section to emph asize that industrial zones will also offer locations for new and emerging clean energy uses within the City of Riverside. o Article V, Chapter 19.150 Base Zones Permitted Land Uses, Permitted Uses Table: Revise the permitted land uses table to allow Vehicle Sales, Rental and Leasing – New and Used (With Outdoor Display) and Indoor Vehicle Repair, when associated with Clean Energy Uses, in the BMP - Business and Manufacturing Park Zone, subject to approval of a Minor Conditional Use Permit and compliance wi th the Site Location, Operation, and Development Standards for Outdoor Storage – In cidental, pursuant to Chapter 19.510 of the Zoning Code and Vehicle Repair Facilities, pursuant to Chapter 19.420 of the Zoning Code.

Proposed Tesla Dealership
The existing building is proposed to be used by Tesla as a showroom, vehicle preparation, service, and ancillary office space. For vehicle sales, cu stomers will be able to view the show room and complete test drives during operating hours (Monday-Sunday 10am-7pm). Customers will be able to accept delivery of their new car, by appointmen t only. Delivery of the vehicles will be on site, at the rear of the building. Outdoor storage of the vehicles will be towards the rear of the site, behind the rolling security gates.

Page 3 ends

PR-2021-001082
The proposed indoor vehicle repair will consist of standard servicing and repair of the electric vehicles, including software updates, tire replac ement, tire balancing, replacement of bolt on parts (e.g., window regulators, door handles, suspension components, bumpers), etc. Other indoor services may also include:
o Battery replacement will only take place on an “as needed” basis and batteries will not be stored onsite for more than 24 hours. No battery repair (repair to damaged batteries) is proposed at this location.
o Tire replacement will be performed on an “as needed” basis, with old tires removed and stored/disposed daily.
o Auto body paint work, consisting of light collision work and painting of bolt on panels.

Service operating hours will be Monday-Friday 9:00 a.m. through 6:00 p.m. and Saturdays 9:00 a.m. through 3:00 p.m., by appointment only.

PROJECT ANALYSIS
Authorization and Compliance Summary
Consistent Inconsistent
General Plan 2025
The proposed project is consistent with the underlying General Plan 2025 land use designation of B/OP – Business/Office Park (Exhibit 5).

The proposed land use designation provides for the development of single or mixed light industrial uses that do not create nuisances due to odor, dust, noise or heavy truck traffic. Suitable uses include corporate and general business offices, supportive retail and commercial uses, research and de velopment, light manufacturing, light industrial and small warehous e uses. The proposed project is consistent with the General Plan land use designation and furthers the Objectives and Policies of the General Plan 2025, specifically:

Objective LU-24: Maximize the ec onomic impact of Riverside's industrial land by careful use of industrial properties, giving priority to clean enterprises that yield large numbers of highly skilled, high paying jobs relative to site size.

Objective LU-69: Complete buildout of the Mission Grove Specific Plan, encouraging development th at can harmoniously co-exist near the March Airport facility.
 ☐
Mission Grove Specific Plan
The project site is located within the Industrial Business Park Land Use area of the Mission Grove Specific Plan (Exhibit 6). The proposed project furthers the Objectives of the Mission Grove Specific Plan, specifically:
- Contributing to an employment base that will attract ‘clean’ industries and provide jobs for residents of Riverside County.

The Mission Grove Specific Plan refers to the Zoning Code for uses envisioned in the Industrial Business Park and requires that they conform to the standards of the BMP – Business and Manufacturing Park Zone.

Consistent Inconsistent
Zoning Code Land Use Consistency (Title 19)
The project site is zoned BMP-WC-SP – Business and Manufacturing Park, Water Course, and Specific Plan (Mission Grove) Overlay Zones (Exhibit 7). The BMP - Business and Manufacturing Park Zone is established to provide a district with low-intensity and low-impact industrial, office, and related uses. Typical uses include research and development facilities and laboratories; administrative, executive and professional offices; small-scale warehouses, light manufacturing; and support commercial.

Pursuant to Article V - Permitted Uses Table, Vehicle Sales, Rental and Leasing with Outdoor Display are not permitted in the BMP – Business and Manufacturing Park Zone. Ou tdoor Storage – Incidental is permitted by right and Indoor Vehicle Repair are permitted subject to the granting of a Use Permit.

The applicant proposes a Zoning Code Text Amendment to allow for Vehicle Sales, Rental and Leasin g – New and Used (With Outdoor Display) and Indoor Vehicle Repair, when associated with Clean Energy Uses, in the BMP - Business and Manufacturing Park Zone, subject to approval of a Mino r Conditional Use Permit and compliance with the Site Location, Operation, and Development Standards (Exhibits 8 and 9).

Based on the proposed Zoning Code Text Amendment, the
proposed Tesla Dealership would require the granting of a Minor Conditional use Permit. The outdoor display of vehicles, proposed with this project, was analyzed fo r consistency with the applicable development standards for outdoor storage and it complies. The project was also analyzed for consistency with the applicable development standards for vehicle repair facilities and it complies, except for the requirement to provide direct access to an arterial or collector street. The Zoning Code allows for consideration of Modifications to deviate from the development standards. The applicant is requesting a Modification to facilitate the proposed project.

Allowing Clean Energy Uses in the BMP Zone, such as the Tesla Dealership with ancillary outdoor display of vehicles and indoor vehicle repair facility, to be considered through the CUP process and subject to specific site location, development, and operation criteria, will continue to protect the relatively limited amount of available industrially zoned areas.
 ☐
Riverside County Airport Land Use Compatibility Plan
The proposed project is in Zone C2 (Flight Corridor Zone) of the March Air Reserve Base Land Use Compatibility Plan (MARB LUCP).

On October 14, 2021, the Riverside County Airport Land Use Commission (ALUC) determined the proposed project to be consistent with the 2014 March Ai r Reserve Base/Inland Port Airport Land Use Compatibility Plan, subjec t to conditions of approval (Exhibit 11).

FINDINGS SUMMARY
Zoning Code Text Amendment
The proposed Zoning Code Text Amendment will allow for uses that demonstrate clean energy practices, specifically Vehicle Sales, Rental an d Leasing – New and Used (With Outdoor Display) in the BMP – Business and Manufacturing Park Zone. The proposed amendment is generally consistent with the goals, policies, and objectives of the General Plan, as it will allow for a clean energy use in the BMP Zone. The proposed amendment will not adversely affect surrounding properties, as a Minor Conditional Use Permit is re quired to analyze the location, use, building or traffic characteristics. Furthermore, the prop osed amendment promotes public health, safety, and general welfare and serves the goals and purposes of the Zoning Code.

Minor Conditional Use Permit
The proposed project will occupy an existing building and will provide adequate circulation, screening, and landscaping. All business activities will be conducted inside the building. Overall, the proposed project complies with the development standards established for Outdoor Storage and a Vehicle Repair Facility and will not have substantial adverse effects on the surrounding properties or uses.

Modification of Development Standards
The applicant is requesting a modification to a development standard to allow a vehicle repair facility with direct access to a local street, where the Zoning Code requires direct access to an

PR-2021-001082
arterial or collector street. Section 19.420.050 of the Zoning Code allows for the modification of development standards through the consideration of a Minor Conditional Use Permit. Staff has prepared the following supplemental justifications in support of the modification:

1. The vehicle repair facility will only service Tesla vehicles at this location;

2. The service and repairs will be offered by a ppointment, limiting the number of customers on site at one time; and

3. The proposed indoor vehicle repair is incidental to the vehicle sales and associated outdoor storage.

Allowing a vehicle repair facility with direct access to a local street, where the Zoning Code requires direct access to an arterial or collector street, will not be detrimental to the surrounding area.

ENVIRONMENTAL REVIEW
This proposed project is exempt from California Environmental Quality Act (CEQA) review pursuant to Section 15061.b.3 (Common Sense) and 15301 (E xisting Facilities) of the CEQA Guidelines, as the proposed project will not have a significant effect on the environment.

PUBLIC NOTICE AND COMMENTS
Public hearing notices were mailed to property owne rs within 300 feet of the site. In addition, an eight-page ad was published in accordance with Zoning Code requirements for Zoning Code Text Amendments. As of the writing of this report no responses have been received by Staff.

APPEAL INFORMATION
Actions by the City Planning Commission, including any environmental finding, may be appealed to the City Council within ten calendar days after the decision. Appeal filing and processing information may be obtained from the Planning Department Public Information Section, 3rd Floor, City Hall.
