BACKGROUND:

On April 21, 2020, the City Council awarded Bid No. 7696 to H&H General Contractors, Inc., of Highland, California (H&H) to complete the Iowa Avenue Improvements from Martin Luther King Boulevard to University Avenue (Project). A 10% change order authority was authorized in the amount of $476,969 due to the age of the irrigation and drainage facilities being impacted by the Project that are owned by the University of California, Riverside (UCR). The age of the facilities outdates any UCR records, and it was anticipated that the scope of the proposed modifications may expand during construction. City Council also approved a reimbursement agreement with the Western Riverside Council of Governments (WRCOG) in the amount of $2,920,000 for Transportation Uniform Mitigation Fee (TUMF) Funds and authorized a supplemental appropriation for the same amount to the Project account.

On August 28, 2019, a reimbursement agreement between the City and UCR was executed in anticipation of the City’s Project requiring the City to restore any impacted UCR facilities to their original condition at the City’s sole expense prior to the completion of the Project.

On July 13, 2020, a Notice to Proceed was issued to H&H to commence Project construction.

On March 2, 2021, the City Council authorized an increase of change order authority with H&H to relocate an existing UCR-owned 16” irrigation line out of Iowa Avenue onto UCR property within the Project limits. Due to the complexity of repairing impacted sections of this existing line during construction, the City was unsuccessful with maintaining a sealed water line.

On November 19, 2021, the City filed a Notice of Completion to finalize completion of the Project.

DISCUSSION:

The City completely relocated a 16” UCR irrigation facility outside of City right-of-way at a negotiated construction cost of $267,000. The City collaborated with WRCOG and determined $265,000 of remaining construction phase funds were available to the City for the completion of the Project. The expense to relocate the UCR irrigation line is an eligible expense under TUMF guidelines.

On April 7, 2022, WRCOG approved the Transportation Uniform Mitigation Fee Program First Amendment to the Agreement to Reimburse TUMF Funds for the construction phase of the Iowa Avenue Widening Project in the amount of $265,000 (Attachment 2), for the relocation of the 16” irrigation line outside City right-of-way onto UCR property.

STRATEGIC PLAN ALIGNMENT:

This Project aligns to Strategic Priority No. 6 – Infrastructure, Mobility and Connectivity and Goal No. 6.2 – Maintain, protect, and improve assets and infrastructure within the City’s built environment to ensure and enhance reliability, resiliency, sustainability, and facilitate connectivity.

It also aligns with each of the Cross-Cutting Threads as follows:

Community Trust – Riverside is transparent and makes decisions based on sound policy, inclusive community engagement, involvement of City Boards & Commissions, and timely and reliable information. This Project was discussed with previous Council actions.

Equity – Activities and actions by the City serve the public interest, benefit the City’s diverse populations, and result in greater public good. Public Works strives to improve the City' s roadway network to provide safe and reliable transportation to all areas of the City. The Project benefits all residents and visitors utilizing the improvements.

Fiscal Responsibility – Riverside is a prudent steward of public funds and ensures responsible management of the City’s financial resources by awarding construction contracts to the lowest responsive and responsible bidders. By relocating this irrigation facility, the integrity of the street will not be compromised with future leaks.

Innovation – This project exemplifies established methods of street improvements. Riverside is inventive and timely in meeting the community’s changing needs and prepares for the future through collaborative partnerships and adaptive processes.

Sustainability & Resiliency – The construction materials specified for this Project are considered best practices in the industry.

FISCAL IMPACT:

The fiscal impact of this action is $265,000. With the approval of the Transportation Uniform Mitigation Fee Program First Amendment to the Agreement to Reimburse TUMF Funds with the Western Riverside Council of Governments for the construction phase of the Iowa Avenue Widening Project and at least five affirmative votes authorizing an increase of revenue and supplemental appropriation in the Transportation Uniform Mitigation Fee Fund, Iowa Avenue Widening project TUMF Revenue account no. 9899819-339100, in the amount of $265,000, and TUMF Expenditures account no. 9899819-440315, in the amount of $265,000, the City will be reimbursed the maximum available remaining TUMF funds to offset the construction costs to relocate UCR’s 16” irrigation line.
