ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE, CALIFORNIA, AMENDING CHAPTER 16.36 OF THE RIVERSIDE MUNICIPAL CODE.
The City Council of the City of Riverside does ordain as follows:
Section 1: Section 16.36.030 of the Riverside Municipal Code is hereby amended as follows:
“Section 16.36.030 Scope.
The provisions of this section shall apply to:
A. New buildings in accordance with California Fire Code Section 510 Emergency Responder Communications Coverage, and NFPA 1221, Edition 2019.
B. Existing buildings when modifications or repairs exceed 50 percent of the usable floor area; and C. All basements regardless of the occupancy type, or parking structures.” Section 2: Section 16.36.040(B) of the Riverside Municipal Code is hereby amended as follows:
“Section 16.36.040 Radio Coverage.
B. For the purpose of this section, adequate radio coverage shall constitute a successful communications test between the equipment in the building and the communications center where signal strength measurements in 95 percent of all areas and 99 percent of areas designated as critical areas by the fire code official on each floor of the building meet the signal strength and shall include all of the following:” Section 3: The City Council has reviewed the matter and, based upon the facts and information contained in the staff reports, administrative record, and written and oral testimony, hereby finds that this ordinance is not subject to CEQA pursuant to Sections 15060(c)(2), 15060(c)(3) and/or 15061(b)(3) of the State CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, in that it will not result in a direct or reasonably foreseeable indirect physical change in the environment nor have a significant impact on the environment.
Section 4: The City Clerk shall certify to the adoption of this ordinance and cause publication once in a newspaper of general circulation in accordance with Section 414 of the Charter of the City of Riverside. This ordinance shall become effective on the 30th day after the date of its adoption.
