This THIRD AMENDMENT TO AGREEMENT FOR MUNICIPAL TREE
MAINTENANCE SERVICES FOR CITY OF RIVERSIDE ("Third Amendment") is made and entered into this day of 2022, by and between the CITY OF RIVERSIDE, a California charter city and municipal corporation (City"), and WEST COAST ARBORISTS, INC., a California corporation located at 2200 East Via Burton Street, Anaheim, CA 92806, State Contractor's License No. 366764 ("Contractor"), as follows:
RECITALS
WHEREAS, on June 20, 2018, City and Contractor entered into that certain Agreement for Municipal Tree Maintenance Services for City of Riverside ("Agreement"); and HEREAS. on Julv 6. 2021. Citv ar

WHEREAS, on May 4, 2022, City and Contractor entered into that certain Second Amendment to Agreement for Municipal Tree Maintenance Services for the City of Riverside ("Second Amendment"); and
WHEREAS, City and Contractor desire by this Third Amendment to add Two Million Two Hundred Fifty Thousand Dollars ($2,250,000.00), for a total of Four Million Four Hundred Four Thousand Three Hundred Forty-Five Dollars ($4,404,345.00) during the extended term of the Agreement; and
NOW, THEREFORE, in consideration of the foregoing recitals which are incorporated herein by this reference, City and Contractor agree as follows:
1. Section 3 of the Agreement, Compensation, is amended to add Two Million Two Hundred Fifty Thousand Dollars ($2,250,000.00), for a total of Four Million Four Hundred Four Thousand Three Hundred Forty-Five Dollars ($4,404,345.00) during the extended term of the Agreement. City shall pay Contractor for Services performed to City's satisfaction on a monthly basis in accordance with the provisions of RFP 1775, and the updated Compensation Schedule attached hereto as Exhibit "A-3" and incorporated herein by this reference.
2. All terms and conditions of the original Agreement, First Amendment, and Second Amendment not inconsistent with this Third Amendment shall remain in full force and effect and are incorporated herein by this reference as though set forth in full.

The current rates had been in place since July 1, 2020. The proposed rates reflect a cost adjustment of 5.8%. This calculation is based on the Consumer Price Index for the Riverside-San Bernardino-Ontario region, Annual period for 2021. Upon approval, the rates will be effective July 1, 2022 and valid for 12 months. The line item for Clearance Pruning is modified to $100 due to size and location of trees.
