DEPARTMENT
SUBJECT: SURPLUS DECLARATION OF SUCCESSOR AGENCY-OWNED VACANT LAND PROPERTIES AS REQUIRED BY ASSEMBLY BILL 1486 ISSUE:
Recommend that the Countywide Oversight Board adopt a resolution declaring Successor Agency-owned vacant land properties as surplus pursuant to Assembly Bill 1486.
RECOMMENDATIONS:
That the Successor Agency:
Adopt the attached Resolution (Attachment 1) declaring Successor Agency-owned vacant land properties as surplus; and Recommend that the Countywide Oversight Board adopt a separate resolution declaring Successor Agency-owned vacant land properties as surplus.
BACKGROUND:
On March 6, 2014, the State’s Department of Finance approved the Successor Agency’s Long Range Property Management Plan (Plan). The approved Plan provides detailed information of the Successor Agency-owned properties for disposition, and each site is identified by a specific Site Number.
On October 9, 2019, Governor Newsom signed into law Assembly Bill 1486 (AB 1486) to promote the use of publicly owned land for affordable housing developments. The adoption of AB 1486 has expanded the Surplus Land Act to include land owned by successor agencies to the former redevelopment agencies. The Surplus Land Act is a “right of first refusal” law that requires all local agencies to offer surplus land for sale or lease to affordable home developers and other entities before selling or leasing the land to any other individual or entity.
Pursuant to AB 1486, the Successor Agency adopted Resolution No. 39 on April 7, 2020, to declare this property as surplus:

Finally, the Successor Agency adopted Resolution No. 44 on August 19, 2021, to declare this property as surplus:

Assessor’s Parcel Number
13 4271 and 4293 Market Street

When these vacant land properties were declared surplus, they were not subject to an exclusive negotiating agreement (ENA) or other legally binding agreement at the time.
DISCUSSION:
As of January 1, 2020, all Successor Agency-owned vacant land properties were subject to the requirements of AB 1486. Except for those properties that the Successor Agency had entered into an ENA or other legally binding agreement on or before December 31, 2020, and the disposition of those properties must have been completed by December 31, 2022.
In 2020 and 2021, when the Successor Agency declared the above nine vacant land sites surplus, the following properties, listed below and as shown in Attachment 2, were in legally binding disposition agreements and were not subject to AB 1486.

As such, staff is recommending that these properties (listed above as Sites 5, 16, and 31) be declared as surplus to allow for an uninterrupted process in the Successor Agency ongoing disposition of its properties.
Prior to negotiating with prospective buyers on the disposition of these properties, the Successor Agency is required to provide written notice of availability (NOA) to affordable housing developers registered with the State’s Department of Housing and Community Development (HCD) as well as the other public entities.
Additionally, prior to agreeing to terms for disposition, the Successor Agency is also required to provide HCD with a description of the NOAs offered and negotiations conducted with any responding entity. HCD has 30 days after receipt of the required notice to submit written findings if it deems that the Successor Agency is in violation of the Surplus Law Act.
When a proposed sale agreement is ready for each of the three properties listed above, staff will return for the approvals of both the Successor Agency and Countywide Oversight Board on the disposition.
STRATEGIC PLAN ALIGNMENT:
This item contributes to Strategic Priority 3 – Economic Opportunity and Goal 3.3 – Cultivate a business climate that welcomes innovation, entrepreneurship, and investment because the disposition of the property will stimulate investment.
Declaring the properties surplus aligns with each of the five Cross-Cutting Threads as follows:
Community Trust: AB 1486 establishes guidelines for the disposition of all City-owned vacant land that serves the public interest, benefits the City's diverse population, and results in the greater public good.
Equity: AB 1486 requires notification of public agencies and affordable housing developers; this requirement ensures that the surplus process is continuously fair and equitable.
Fiscal Responsibility: The SLA warrants the responsible management and disposition of the City's assets in a manner consistent with the prudent stewardship of public funds while facilitating beneficial investment in the City of Riverside.
Innovation: Direction from the City Council to move forward with the future disposition and development of the Property is consistent with the community's needs for additional housing options.
Sustainability and Resiliency: The SLA sets standards for the disposition of the Property that encourages equitable housing solutions to meet the needs of the City and ensures the City's capacity to preserve, adapt, and grow.
