NOTICE IS HEREBY GIVEN that the Riverside Unified School District of Riverside County, acting by and through its Governing Board, hereinafter referred to as "District," will receive up to, but no later than the above-stated time, emailed Quotes for the award of the above-stated product.
All proposals must be emailed to [email protected] on, or before, the stated submittal date.
When emailing the quote, under subject line reference : "Maintenance, Operations, and Transportation CNG Roll Off Truck - RFP Number 2022/23-17". It is each Vendor's sole responsibility to ensure the quote is timely received as specified above. Quotes not received with the requested forms and at the above-stated time, or after any extension due to material changes will NOT be considered.

GENERAL TERMS AND CONDITIONS
A. Preparation of Quotes
Quote shall be made on form(s) furnished in the quotes package by the District. The quote documents are available at

B. Award or Rejection
Vendors shall prepare their submission in compliance with the instructions in this package, and all quotes must be submitted on the quote forms provided in this package.
Failure to do so will constitute a "No Quote".
The Riverside Unified School District ("District") reserves the right to reject any or all quotes. The District will be awarding these to the lowest bidder. 30 duy s*

In the case of net tie quotes between local Vendor and out-of-district vendor, both of whom meet specifications and service requirements, the award will be made to the local Vendor. In the case of net tie quotes between local Vendors or out-of- district Vendors, both of whom meet specifications and service requirements, the award will be made by a coin toss.
D. Withdrawal of Quotes
Any quotes may be withdrawn, by written request, at any time prior to the scheduled closing time for receipt of quotes.
E. Disqualification of Vendors and Quotes
No more than one quote for the same Request for Quotation from any individual, firm, partnership, corporation or association under the same or different names will be accepted; and reasonable grounds for believing that any Vendor is interested in more than one quote for the Request for Quotation will be cause for "No Quote".
F. Errors and Corrections
All prices and quotations must be legible. Mistakes may be crossed out and corrections typed or written and must be initialed in ink by the person signing the quote proposal.
Quotations must be verified before submission and cannot be withdrawn or corrected after due date. The District will not be responsible for errors or omissions on the part of the Vendor.
It is the Vendor's responsibility to obtain and verify all information required to quote, prior to submission of your quote. To claim that you did not know or did not understand is unacceptable. No objections with regard to the application, meaning, or interpretatien of the specifications will be considered after the closing date of the quote.

No charge for freight, shipping or any other purpose will be allowed over and above the price quote
H. Quote Signature
All quotes must be signed with the firm name by a responsible officer or employee who is authorized to lend the organization to the terms and conditions herein. Obligations assumed by such signature must be fulfilled.
I. Non-Collusion Affidavit
Every bidder shall execute with his or her quote a Non-Collusion Affidavit. This form is included with the quote package and must be signed and dated by the Vendor under penalty of perjury.
J. Assignment
The Vendor shall not assign or transfer any or all of its rights, burdens, duties or obligations without prior written consent of the District. Any assignment of money due or to become due under the awarded contract shall be subject to a prior lien for services rendered, material or material supplied for performance of work called for under said contract in favor of all persons, firms or corporations rendering such services or supplying such materials to the extent that claims are filed pursuant to the Code of Civil Procedure and the Government Code and shall also be subject to deductions for liquidated damages if liquidated damages have been assessed K. District's Right to Terminate Contract
District may, without prejudice to any other right or remedy, and with or without cause, serve written notice upon Vendor of its intention to terminate this contract. At District's sole discretion, Vendor may be given ten (10) days to correct issues the District may have, but there is no guarantee the Vendor will be given an opportunity to correct. The foregoing provision is in addition to and not in limitation of any other rights or remedies available to District.
L. Hold Harmless
The Vendor shall save, defend, hold harmless and indemnify the District against any and all liability, claim and costs of whatsoever kind and nature for injury to or death of any person and for loss or damage to any property occurring in connection with or in any way incident to or arising out of the occupancy, use, services, operations or performance under the terms of this contract, resulting in whole or in part from the negligent acts of any employee, agent or representative of Vendor

Fulfilling or Failing to Fulfill Requirements of Contract Vendor must be able to fulfill the requirements hereunder within thirty (30) days of issuance of the District's purchase order number. Failure by the Vendor to provide all the required items pursuant to this Bid allows the District, at its sole discretion, to annul and set aside the contract entered into with said Vendor, either in whole or in part, and may enter into a new contract for the same items in such manner as the District deems appropriate and to the best advantage for N. Public Information Act
All materials received relative to the quote will be kept confidential, until such time an award is made or the quote is canceled, at which time all materials received will be made available to the public. Quote Responses received will be subject to Government Code §6250, the Public Information Act. Quote Response Submitters should mark information they consider proprietary or confidential in the event it is exempt from the requirements of the Act.
O. No Minimum or Maximum Quantities. Order Charges. or Limitations Upon Number of Orders The District does not guarantee orders nor shall the District be required to limit its orders. This is an indefinite quantity Quote. The quantities listed on the Quote worksheets are strictly for evaluation purposes. Vendors shall not specify minimum or maximum quantities or charges. Unlimited orders within the term of the contract shall be allowed to the District at the prices resulting from award of a contract. The District shall not be obligated to purchase or reimburse the vendor (s) for any inventory of any products should purchases vary from the estimates listed or if agreement expires or is terminated
The Riverside Unified School District reserves the right to cancel any articles or services which the successful Vendor may be unable to furnish because of economic conditions, government regulations, or other similar causes beyond the control of the Vendor provided satisfactory proof is furnished to the Board of Education if requested.

SPECIAL TERMS AND CONDITIONS
A. Submission of Quote
Quote responses for furnishing the items and quantities listed in the attached specifications are hereby being requested from your company. You are asked to return the Quote form page(s) with your response.
Quotes shall be submitted digitally via email to beltran@riversideunified. org prior to the due date and time stated above.
B. Specifications/Changes
Wherever brand names are used, the words "or equal" shall be considered to appear and be a part of the specification. If you are quoting another make or model, cross out our nomenclature and insert yours. If no make or model is stipulated, insert yours. Attach applicable specifications and/or brochures. Variations in manufacturers, design, etc., may be acceptable, Vendors are encouraged to offer them as alternatives; however, the District reserves the right to reject those alternatives as non-responsive.
C. Intent
It is the intent of these specifications to describe new (unused) Trucks equivalent in style, quality and appointments to those of standard manufacture. This vehicle will be primarily used for the typical operations of our Maintenance, Operations and Transportation Department on typical State highways and city/county roads and shall be designed to operate under typical ambient temperatures and weather conditions encountered in the State. The vehicle shall be supplied with all new equipment and accessories indicated as standard equipment in the manufacturer's published literature. All equipment/options are to factory or dealer installed. If some equipment/options are not available from the factory, dealer installation is acceptable if specified as dealer installed in the Quote response and accepted by the District.
D. General Characteristic
Each truck shall be new, current model year production and equivalent in style, quality and appointments to those offered to the general public. The truck shall be supplied with all equipment and accessories indicated within.
E. "OR" Equals
Brand names are used to establish a level of quality only. For equipment and material purchases, where brand name/model are specified, the District reserves the right to evaluate any product or type of equipment offered on the Quote request and to determine acceptability as an "equal".
F. Shipping Terms
All prices quoted are to be FOB Destination, no additional Freight charges. Quotes quoting otherwise may be rejected. Seller shall also supply DMV Transfer of Ownership, Dealer's Report of Sale, documents for each vehicle as required by DMV for licensing and registration by the District.
Delivery time for each vehicle purchased may be a key consideration in the award. In terms of days based on straight calendar days, vendors are instructed to quote their best delivery time for the quoted vehicles. The vehicles selected for purchase shall be delivered on or before the number of calendar days quoted by the successful Vendor.

All public agencies are authorized by law to purchase off a contract awarded by an agency that has itself gone to Quote, including all K-12 schools districts, community college districts, special districts and JPAs serving education, pursuant to Public Contract Code Sections 20118 and 20652.
Using these statues, the Riverside Unified School District (AGENCY) hereby declares its intent and authorization to make all contracts awarded under this contract "piggybackable" by other education agencies in the state as slowed by law. The AGENCY waives any right to receive payment from other agencies making purchases off the awarded contracts and those agencies will make the payment directly to the vendors. Pricing will be valid for 60 days after the award of this Quote by the Board of Education.
