SECOND AMENDMENT TO SERVICES AGREEMENT
DS SERVICES OF AMERICA, INC.,
doing business as PRIMO WATER NORTH AMERICA
Citywide Bottled Drinking Water and Related Services (Bid No. 7833) This SECOND AMENDMENT TO SERVICES AGREEMENT ("Second Amendment") is made and entered into this 28th _day of June - 2023, by and between the CITY OF RIVERSIDE, a California charter city and municipal corporation ("City"), and DS SERVICES OF AMERICA, INC., a Delaware corporation authorized to do business in California, doing business as PRIMO WATER NORTH AMERICA (Contractor").
RECITALS
WHEREAS, on July 13, 2021, City and Contractor entered into a Services Agreement for Citywide Bottled Drinking Water and Related Services (Bid No. 7833) ("Agreement"); and WHEREAS, on September 15, 2022, City and Contractor entered into a First Amendment to Services Agreement for Citywide Bottled Drinking Water and Related Services ("First Amendment"); and
WHEREAS, the Agreement is set to expire June 30, 2023; and WHEREAS, City and Contractor desire to extend the term of the Agreement to June 30, 2024, and increase compensation in the amount of Thirty-Five Thousand Dollars ($35,000.00) for the extended term of the Agreement.
NOW, THEREFORE, in consideration of the foregoing recitals which are incorporated herein by this reference, City and Contractor agree as follows:
1. The term of the Agreement is hereby extended to June 30, 2024.
Paragraph 3, Compensation, is hereby amended to increase compensation in the amount of Thirty-Five Thousand Dollars ($35,000.00) for the extended term of the Agreement.
All terms and conditions of the original Agreement not inconsistent with this Second Amendment shall remain in full force and effect and are incorporated herein by this reference as though set forth in full.
