A RESOLUTION OF THE CITY COUNCI L OF THE CITY OF RIVERSIDE,
CALIFORNIA, DECLARING ITS INTENTION TO LEVY AN ANNUAL
ASSESSMENT IN THE DOWNTOWN PARKING AND BUSINESS
IMPROVEMENT AREA FOR CALENDAR YEAR 2024 PURSUANT TO
SECTION 36534 OF THE CALIFORN IA STREETS AND HIGHWAYS
CODE, GENERALLY DESCRIBING THE IMPROVEMENTS AND
ACTIVITIES TO BE UNDERTAKEN AND FIXING THE TIME AND PLACE
FOR A PUBLIC HEARING BEFORE TH E CITY COUNCIL OF THE CITY OF RIVERSIDE ON THE LEVY OF THE PROPOSED ASSESSMENT.
WHEREAS, the Downtown Parking and Busi ness Improvement Area (the “Area”) was established by Ordinance No. 5303 on June 25, 1985, to engage in or provide for: (a) parking improvements; (b) beautification; (c) promotion of public events; (d) furnishing of music to public places in the area; and (e) general promo tion of business activities, all of which provide specific benefits directly to the businesses within the Area at a cost which does not exceed the reasonable cost in conferring the benefit; and
WHEREAS, the Area is located in the downtown business area of the City of Riverside, and is described as generally between First Street on the north, Prospect and Tequesquite Avenues on the south, past the Riverside/91 Freeway to the railroad tracks on the east, and the first tier of lots on the west side of Brockt on Avenue on the west, ex cept that between Ninth Street and Sixth Street the westerly boundary shall be Pine Street, and also includes both sides of Market Street from First Street to the 60 Fr eeway. The Area was appr oved for expansion by Resolution No. 20054, on December 4, 2001, and by Resolution No. 21076, on November 22, 2005, and is more fully described in the legal de scription and plat title d “Business Improvement District” which is on file in the Office of the City Clerk; and WHEREAS, the City Council of th e City of Riverside has previously ordained that each business entity within the Parking and Business Improvement Area shall pay an amount equal to one hundred percent (100%) of th e non-discounted business tax char ge, as stated in Riverside Municipal Code 3.46.060, without re gard to any incentive program s or early payment discounts that may be offered at any given time; and

WHEREAS, the City Council of the City of Riverside has received and approved the Annual Report of the Riverside Downtown Partners hip (the “Report”), acting as the Advisory Board of the Area; and
WHEREAS, the Report more fully details the improvements and activities which shall be provided, as well as the proposed assessments to be levied, for the calendar year beginning January 1, 2024. The Report is on file with the City Clerk.
NOW, THEREFORE, IT IS RESOLVED by the C ity Council of the City of Riverside, California, pursuant to Section 36534 of the California Streets & Highways Code as follows:
1. It is the intention of the City Counc il to levy and collect an annual assessment within the Area for the calendar year beginning January 1, 2024, at a rate not to exceed the current rate of one hundred percent (100%) of the non-discounted business tax charge, without regard to any incentive programs or early payment discounts th at may be offere d at any given time, to be paid by each business within the Area.
2. Notice of Public Hearing. Notice is he reby given that the City Council will hold a public hearing regarding the levy of the proposed assessment for the calendar year of 2024, on October 24, 2023, at 3 p.m. at the regular meeting of the City Council to be held at the regular place of meeting at said time in the Art Pick Council Chamber at the Riverside City Hall at 3900 Main Street in the City of Riverside, California.
Any protests or objections to the proposed levy of assessment may be made orally or in writing by any interested person. However, the fo rm and manner of such protests or objections shall comply with Sections 36524 and 36525 of the California Streets and Highways Code.

Comments can also be submitte d until two hours before the start of meeting via the eC omment feature at www.riversid eca.gov/meeting. Interested persons will be afforded the opportunity to speak and be heard at 3 p.m. on October 24, 2023, by appearing in person at the public hearing at th e Art Pick Council Chambe r at 3900 Main Street, Riverside, California or calling (669) 900-6833 and entering Meeting ID: 926 9699 1265.

3. Publication of Notice. The City Clerk sh all give notice of th e public hearing by causing the Resolution of Intention to be published once in a newspaper of general circulation in the City not less than seven days before the public hearing.
Further, the City shall provi de notice of the public hearing to each holder of a business license tax certificate within the designated District by mail, postage prepaid.
