RECOMMENDATIONS:
That City Council:
Approve the American Rescue Plan Act Subrecipient Agreement with Faro Technologies, INC. dba Florida Faro Technologies, INC. for the purchase of two FARO Focus Premium 3-D laser scanners, one Freestyle 2.5 3-D Scanner, maintenance, training, and standard warranty in a total amount not to exceed $175,437.22 approved through the American Rescue Plan Act Expenditure Plan grant; and Authorize the City Manager, or designee, to execute the agreement and make minor non-substantive changes.
BACKGROUND:
On March 11, 2021, President Biden signed into law the American Rescue Plan Act to facilitate the recovery from the devastating economic and health effects of the COVID-19 pandemic. The American Rescue Plan Act established the Coronavirus State Fiscal Recovery Fund and American Coronavirus Local Fiscal Recovery Fund, which provided a combined $350 billion in assistance to eligible state, local, territorial, and Tribal governments to assist in the economic and health recovery by providing resources to address impacts resulting from the crisis.
On February 7, 2023, the City Council approved the American Rescue Plan Act Expenditure Plan, First Allocation Expenditure Plan reallocation of funds which included the purchase of FARO 3-D laser scanners for the Police Department.
DISCUSSION:
The Riverside Police Department (RPD) is proposing to purchase two FARO 3-D laser scanners (stand-alone) and one Freestyle 2.5 laser scanner (handheld) to replace the outdated scanners the department currently uses. The purchase would also include training in the use of the new scanners and a standard warranty.
The FARO scanner is a non-contact device that can take images and collect critical information from crime and traffic collision scenes to create detailed diagrams and digital replicas of the scenes through the FARO software. The devices would be primarily used to document and process crime scenes and traffic collision scenes. The FARO scanner and software makes processing scenes more efficient and effective. They would reduce the number of personnel required and time spent at a collision scene collecting measurements. Additionally, FARO’s 3D deliverables have been validated and proven admissible in court. The device will improve the quality of measurements and create collision animation to simulate the actual event for use in the courtroom.
FARO Technologies, INC. is the sole manufacturer and provider of the Focus Series and Freestyle 2.5 Laser Scanners, software, hardware service, warranty, maintenance, annual calibration, and FARO certified train the trainer programs. Additionally, FARO Technologies, INC. has a law enforcement division and is proven to be acceptable in court. RPD reviewed other similar devices and software, but they did not meet all of the features required by the Department or the reliability in the courtroom. The FARO equipment and software does meet all of the department’s needs in one package.
The Department is requesting authorization to purchase the proposed FARO scanners and training for the Department’s use from FARO Technologies Inc., in a total amount not to exceed of $175,437.22. Purchasing the equipment and training directly through the manufacturer, FARO Technologies Inc, is 12% less expensive than open market (GSA) pricing.
The City has determined that FARO Technologies Inc. meets the requirements of Purchasing Resolution No. 23914, Section 602 (d) which states which states Competitive Procurement shall not be required, “When the Procurement can only be obtained timely from a single source and the Manager is satisfied that the best price, terms and conditions for the Procurement thereof have been negotiated.” The Purchasing Manager concurs that this purchase complies with Purchasing Resolution No. 23914, Section 602 (d).
STRATEGIC PLAN ALIGNMENT:
This item contributes to Strategic Priority No. 2 Community Well-Being and Goal number No. 2.4 – Support programs and innovations that enhance community safety, encourage neighborhood engagement, and build public trust.
This item aligns with EACH of the five Cross-Cutting Threads as follows:
Community Trust – The Riverside Police Department is dedicated to improving quality of life by creating a safe environment in partnership with the people it serves. RPD’s ability to accurately document and reconstruct crime scenes and accidents, is in the public’s best interest, benefits the City’s diverse population, and results in the greater public good.
Equity – RPD provides public safety services to all residents in the City of Riverside. The addition of new 3D scanners assists in the achievement of this goal and ensures safer streets for everyone.
Fiscal Responsibility – The ARPA grant will provide funding for three 3D scanners, eliminating the financial burden on the City’s General Fund.
Innovation – RPD must constantly evolve and adapt to meet the community’s changing needs and prepare for the future. This grant provides funding for the Police Department to purchase new 3D scanners which saves hours of documentation time and preserves a digital replica of scenes that may be environmentally vulnerable.
Sustainability & Resiliency – The additional funding from this grant ensures the Police Department has the capacity to preserve, adapt, and grow with the needs of the community.
