Persection5.32.120oftheCityofRiverside'staxordinance,wearerequestinganadministrativeappealwiththe FinancialPerformanceandBudgetCommitteetoaddressthefindingthatcomplimentaryroomsaretaxable. WebelievewehavenotviolatedtheCityofRiverside'staxordinancebasedonthefollowingpointsͲ
1. The ordinance,asitiscurrentlywritten,isambiguousonwhethercomplimentaryroomsaretaxable.TheCityof Riversidehasalsoacknowledgedthis,statingtheyareworkingonacomprehensivereviewofthetaxordinance toaddressthisambiguity.
2. The previoustaxauditdidnotidentifycomplimentaryroomsasbeingtaxable.
Additionally,theauditors(HdL)usedanarbitrarypercentageofroomrevenuetocalculatethetaxesoncomplimentary rooms.Evenifweagreethatcomplimentaryroomsaretaxable,whichwedon't,wedonotagreewiththecalculation thatHdLused.
